Where laws and regulations have other provisions on waste recycling management, those provisions shall prevail. Article 4 The administrative department of economy and informatization of the people's governments at or above the county level shall be responsible for the management of recycling of renewable resources within their respective administrative areas.
Development and reform, finance, science and technology, public security, housing and urban construction, environmental protection and industrial and commercial administration departments shall, in accordance with their duties, do a good job in the management of renewable resources recovery. Article 5 The people's governments at or above the county level and their relevant departments shall strengthen the propaganda work of recycling renewable resources, enhance the awareness of recycling renewable resources in the whole society, and improve the comprehensive utilization level of renewable resources. Article 6 All walks of life and urban and rural residents in the whole society are encouraged to accumulate and sell renewable resources.
Encourage the harmless and recycling of renewable resources.
Encourage institutions of higher learning, scientific research units, enterprises and individuals to conduct scientific research, technology development and popularization and application of the comprehensive utilization of renewable resources. Seventh renewable resources recycling industry associations should strengthen industry self-discipline, standardize industry behavior, organize personnel training, and carry out information consultation and services on renewable resources recycling. Chapter II Management of Recycling Article 8 The administrative department in charge of recycling renewable resources shall, jointly with relevant departments, formulate a plan for the construction of recycling system of renewable resources in accordance with the principle of overall planning and rational distribution, and in combination with the local economic development level, population density, environment and resource conditions.
Supply and marketing cooperatives shall, in accordance with the prescribed responsibilities, do a good job in the management of renewable resources recovery. The sorting, processing, distribution and storage of renewable resources shall be carried out in designated centralized sorting and processing places. Tenth new residential areas within the urban planning area shall, according to the construction plan of renewable resources recycling system, reserve the required sites for recycling stations (points); Completed residential areas can provide the required sites for recycling stations (points) according to the construction plan of renewable resources recycling system through the owners' meeting or the property management enterprises entrusted by the owners. Eleventh renewable resources recycling enterprises and individual operators shall meet the conditions prescribed by the registration authority, and within 30 days after obtaining the business license, they shall file with the administrative department of renewable resources recycling at the same level of the registration authority.
Recycling enterprises that recycle productive scrap metal and unproductive scrap metal and individual operators that recycle unproductive scrap metal shall also file with the public security organ of the local people's government at the county level within 15 days after obtaining the business license; Where the record items are changed, the change procedures shall be handled in accordance with the relevant provisions of the state.
The productive scrap metal mentioned in the second paragraph of this article refers to metal materials and metal products that have completely or partially lost their original use value and are used in production fields such as construction, railways, communications, electric power, water conservancy, oil fields and urban public utilities. Thirteenth renewable resources recycling enterprises to recover productive scrap metal, should sign an acquisition contract with the sales unit. The purchase contract shall stipulate the name, quantity, specifications, recovery period and settlement method of the recycled productive scrap metal. Article 14 When recycling productive scrap metal, a renewable resource recycling enterprise shall truthfully register the name, quantity, specifications and degree of newness of the articles.
Where the unit sells productive scrap metal, the renewable resource recycling enterprise shall examine the certificate issued by the sales unit and truthfully register the name of the sales unit and the name, address and ID number of the agent; Where an individual sells productive scrap metal, the renewable resource recycling enterprise shall truthfully register the name, address and ID number of the seller.
The retention period of registration materials shall not be less than two years. Fifteenth renewable resources recycling enterprises and individual operators in the process of recycling and transporting renewable resources, should take cleaning measures to prevent waste flying, splashing or omission. Sixteenth renewable resources recycling enterprises and individual operators shall not recycle the following items:
(1) Urban public facilities such as manhole covers and well grates;
(two) railway, petroleum, electric power, communications, mining, water conservancy, surveying, fire fighting and other special equipment. No legal source certificate;
(3) Toxic and radioactive substances and their containers;
(4) Stolen goods or articles suspected of stolen goods notified by public security organs;
(five) other items prohibited by laws and regulations.
