article 2 the term "organic products" as mentioned in these measures refers to products for human consumption and animal consumption whose production, processing and sales meet the national standards for organic products.

the term "organic product certification" as mentioned in these measures refers to the activities of certification bodies to evaluate the production and processing of organic products in accordance with the national standards for organic products and the provisions of these measures.

article 3 these measures shall be observed in the activities of certification, production, processing and sales of organic products within the people's Republic of China.

Article 4 The National Certification and Accreditation Administration (hereinafter referred to as CNCA) is responsible for the unified management, comprehensive coordination and supervision of organic product certification activities.

local quality and technical supervision departments and local entry-exit inspection and quarantine institutions (hereinafter referred to as local certification supervision and administration departments) shall, according to their respective duties, supervise and inspect organic product certification activities within their respective jurisdictions.

article 5 the state formulates unified basic norms and rules for organic product certification, unified conformity assessment procedures, unified standards and unified marks.

article 6 the state conducts international mutual recognition of organic product certification and accreditation on the principle of equality and mutual benefit.

institutions engaged in organic product certification (hereinafter referred to as organic product certification institutions) shall carry out relevant mutual recognition activities in accordance with the mutual recognition agreement on organic product certification signed by CNCA.

article 7 an organic product certification institution shall be established in accordance with the law, have the basic conditions stipulated in the regulations on certification and accreditation of the people's Republic of China, have the technical ability to engage in organic product certification, and be recognized by a recognized institution determined by the national certification and accreditation administration (hereinafter referred to as the recognized institution) before engaging in organic product certification activities.

if an overseas organic product certification institution conducts organic product certification activities in China, it shall comply with the Regulations of the People's Republic of China on Certification and Accreditation and other relevant laws, administrative regulations and the relevant provisions of these Measures.

article 8 an inspector engaged in organic product certification shall be registered by a recognized institution before engaging in organic product certification activities.

article 9 institutions engaged in environmental testing and product sample testing activities at the place of origin (base) related to organic product certification (hereinafter referred to as organic product testing institutions) shall have corresponding testing conditions and capabilities, and have passed metrological certification or obtained laboratory accreditation. Article 11 The CNCA shall approve the certification bodies of organic products that meet the requirements of Article 7 of these Measures.

CNCA regularly publishes the directory of organic product certification institutions and organic product testing institutions that meet the requirements of Articles 7 and 9 of these Measures. Certification institutions and product testing institutions not listed in the catalogue shall not engage in certification and related testing activities of organic products.

article 11 organic product certification institutions shall implement organic product certification according to the national standards for organic products.

Article 12 An organic product certification body shall disclose information such as standards, basic certification norms, rules and charging standards on which organic products are certified.

Article 13 Units and individuals producing and processing organic products or their agents (hereinafter collectively referred to as applicants) may voluntarily apply for organic product certification to an organic product certification body. When applying, the following written materials shall be submitted:

(1) the name, address and contact information of the applicant;

(2) the regional scope of product origin (base) and the scale of production and processing;

(3) the production, processing or sales plan of the product;

(4) an environmental description of the place of origin (base), processing or sales;

(5) quality management system documents that meet the requirements of production and processing of organic products;

(6) qualification certification materials of relevant professional technical and management personnel;

(7) a statement to ensure the implementation of organic product standards, technical specifications and other special requirements;

(8) other materials.

if the applicant is not a direct producer or processor of organic products, it shall also provide a written contract signed with the producer or processor of organic products.

Article 14 An organic product certification body shall, within 11 days from the date of receiving the applicant's written application, complete the examination of the application materials and make a decision on whether or not to accept it; If it is not accepted, it shall notify the applicant in writing and explain the reasons.

article 15 after accepting the certification of organic products, an organic product certification institution shall carry out certification activities in accordance with the procedures stipulated in the basic norms and rules of organic product certification, so as to ensure the integrity, objectivity and truthfulness of the certification of organic products, and make a complete record of the certification process and keep it on file.

article 16 an organic product certification body shall make a certification conclusion in time according to the requirements of relevant standards or technical specifications, and ensure that the certification conclusion is objective and true.

the certification body of organic products shall be responsible for the certification conclusions it has made.

Article 17 For those who meet the requirements of organic product certification, the organic product certification institution shall issue an organic product certification certificate to the applicant and allow him to use the China organic product certification mark; If it does not meet the certification requirements, it shall notify the applicant in writing and explain the reasons.

article 18 for products produced during the conversion period according to the national standards for organic products, or processed products with products produced during the conversion period as raw materials, the word "conversion" and the conversion period shall be indicated in the certificate, and the certification mark of organic conversion products in China shall be used.

Article 19 An organic product certification body shall effectively follow up and inspect the certified units and individuals and the certified products in accordance with regulations, so as to ensure that the certification conclusion can continuously meet the certification requirements.

Article 21 An organic product certification body shall not carry out organic certification on processed products whose organic ingredient content (weight or liquid volume, excluding water and salt) is less than 95%.

article 21 units, individuals and organic product certification bodies that produce, process and sell organic products shall take effective measures to sell organic products according to the product range and quantity determined by the certification certificate, so as to ensure the consistency of production and sales quantity of organic products.

article 22 the CNCA stipulates the basic format of certification certificates for organic products and the pattern of certification marks for organic products.

Article 23 The organic product certification certificate shall include the following contents:

(1) The name and address of the certified unit and individual;

(2) the quantity, area of origin and product category of the certified products;

(3) categories of organic product certification;

(4) the standards or technical specifications on which it is based;

(5) the scope, quantity, form or mode of use of the certification mark for organic products;

(6) issuing institution, issuing date, validity period and signature of the person in charge;

(7) products produced during the conversion period of organic products or processed products made from products produced during the conversion period shall be marked with the word "conversion" and the conversion period.

article 24 the certificate of organic product certification is valid for one year.

Article 25 Any unit or individual that has obtained the organic product certification certificate shall go through the formalities for change with the organic product certification institution in case of any of the following circumstances within the validity period of the organic product certification certificate:

(1) The certified unit or individual has changed;

(2) the production and processing units or individuals of organic products have changed;

(3) the product category changes;

(4) the organic products need to be changed upon expiration of the conversion period.

Article 26 A unit or individual that has obtained an organic product certification certificate shall reapply for certification to an organic product certification institution in any of the following circumstances within the validity period of the organic product certification certificate:

(1) The place of origin (base), processing site or business activities have changed;

(2) Other products that can't continuously meet the requirements of organic product standards and relevant technical specifications.

Article 27 In case of any of the following circumstances, the certification institution shall make a decision to suspend or cancel the certification certificate in a timely manner:

(1) The certified products cannot continuously meet the requirements of standards and technical specifications;

(2) the certified entity or individual has changed;

(3) the production and processing units of organic products have changed;

(4) the product type is inconsistent with the certificate;

(5) failing to add or use the organic product mark as required.

for the revoked certificate, the organic product certification body shall take it back.

article 28 organic product certification marks are divided into China organic product certification mark and China organic conversion product certification mark, and the patterns are shown in the annex.

the certification mark of ORGANIC products in China is marked with the words "organic products in China" in Chinese and the corresponding English (organic).
