chapter I general provisions article 1 these regulations are formulated in accordance with the law of the people's Republic of China on safety in production and relevant laws and administrative regulations, in combination with the actual situation of this province, in order to strengthen the work of safety in production, prevent and reduce production safety accidents, ensure the safety of people's lives and property, and promote sustained and healthy economic and social development. Article 2 These Regulations shall apply to the safety production of production and business units and their supervision and management activities within the administrative area of this province.

the term "safety in production" as mentioned in these regulations refers to related activities that take preventive and control measures to avoid casualties and property losses and ensure the normal production and operation. Article 3 Work safety in production should adhere to people-oriented, safety first, prevention first, and comprehensive management. According to the requirements of managing industry, business and production and operation, safety in production and occupational health must be managed, territorial management, graded responsibility and dual responsibility for one post should be implemented, and a mechanism should be established for production and business units to be responsible, employees to participate, government supervision, industry self-discipline and social supervision to promote safe development. Article 4 The production and business operation entity is the main body responsible for production safety, and shall abide by the laws, regulations and standards of production safety, guarantee the investment in production safety, improve the conditions of production safety, promote the standardization construction of production safety, strengthen the investigation and management of hidden dangers of production safety accidents, strengthen the infrastructure construction of production safety, implement production safety measures, improve the level of production safety and ensure production safety. Article 5 The people's governments at or above the county level shall strengthen their leadership over the work of production safety, incorporate the work of production safety into the national economic and social development plan, formulate and organize the implementation of the work safety plan, establish the inspection system of production safety, implement the target responsibility system and accountability system for production safety, improve the supervision and guarantee system for production safety, and support and urge relevant departments to perform their duties of supervision and management of production safety according to law.

the safety production committees of the people's governments at all levels are responsible for studying, deploying, coordinating and solving major issues in the work of safety production within their respective administrative areas, and the director of the safety production Committee is the principal responsible person of the people's government at the same level.

the agencies of the people's governments such as township people's governments, subdistrict offices, development zones (parks, port areas) and other administrative agencies shall strengthen supervision and inspection on the safety production situation of production and business units within their respective jurisdictions, and assist the relevant departments of the people's governments at higher levels to perform their duties of supervision and administration of safety production according to law.

the village (neighborhood) committees shall assist the people's governments and relevant departments in the supervision and management of production safety, and do a good job in the publicity and information submission of production safety. Article 6 The safety production supervision and management departments of the people's governments at or above the county level shall, in accordance with the law, implement comprehensive supervision and management of the safety production work within their respective administrative areas, and guide, coordinate, supervise and assess the safety production work of the relevant departments of the people's governments at the corresponding levels and the people's governments at lower levels.

the competent departments of other industries and fields shall perform their duties such as industry planning and administrative licensing in accordance with the law, guide the production and business operation entities to implement the main responsibility of safety production in terms of industrial policies, regulations and standards, and strengthen the work of safety production in their own industries and fields. Article 7 The people's governments at or above the county level and relevant departments shall promote the construction of socialized service system for safety production, cultivate and standardize safety production service institutions, and improve the systems of information disclosure and credit evaluation of safety production service institutions.

the department responsible for the supervision and administration of production safety can adopt the mode of government purchasing services and entrust qualified production safety service agencies to participate in the work of production safety. Article 8 People's governments at all levels and relevant departments shall strengthen the construction of safety culture in various forms, incorporate the popularization of safety knowledge into national education, and carry out activities such as safety skill training and accident warning education, so as to enhance the safety awareness and accident prevention ability of the whole society.

Radio, television, newspapers, internet and other media should carry out public welfare propaganda on production safety and strengthen public opinion supervision on production safety. Article 9 People's governments at or above the county level and relevant departments shall commend and reward units and individuals that have made remarkable achievements in improving safe production conditions, preventing production safety accidents, participating in emergency rescue, researching and popularizing advanced safety technologies, promoting safety culture construction and occupational health work. Chapter II Safety in Production of Production and Business Units Section 1 General Provisions Article 11 A production and business unit shall meet the following conditions for safety in production when engaging in production and business activities:

(1) It shall have complete rules and regulations for safety in production and operating procedures;

(2) safety investment meets the requirements of safety production, and the production and business premises, facilities and equipment and production technology meet the requirements of relevant laws, regulations and standards on safety production;

(3) set up a safety production management organization in accordance with the regulations, and be equipped with safety production management personnel;

(4) the main person in charge and the safety production management personnel have the corresponding knowledge and management ability of safety production, the employees have passed the safety production education and training, and the special operators have obtained the relevant qualifications;

(5) having an emergency rescue plan for production safety accidents, establishing an emergency rescue organization according to the needs, and providing emergency rescue personnel and necessary equipment;

(6) provide qualified labor protection articles for employees and take effective protective measures against occupational hazards;

(7) Other conditions for safe production as stipulated by laws, regulations and standards.

production units such as mines, construction, dangerous chemicals, fireworks and firecrackers, and civil explosives shall obtain safety production licenses according to law; Those who have not obtained the safety production license shall not engage in related production activities.

production and business units should adopt new technologies, new technologies, new materials and new equipment that are conducive to improving the conditions for safe production, and use modern science and technology to improve the level of safe production and the ability to prevent accidents.
