article 1 in order to ensure food safety, standardize the production and operation behaviors of small food workshops, restaurants, grocery stores and food vendors, and ensure the public's health and life safety, these provisions are formulated in accordance with the Food Safety Law of the People's Republic of China and relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Provisions shall apply to the production, operation, supervision and management activities of small food workshops, restaurants, grocery stores and food vendors within the administrative area of this province.
The term "small food workshops" as mentioned in these Provisions refers to producers who have fixed production and processing sites, fewer employees, small production and processing scale and simple production conditions, and are engaged in food production and processing activities.
The term "small food and beverage outlets" as mentioned in these Provisions refers to operators who have fixed business premises, small use area, small business scale and simple operating conditions and are engaged in catering services.
The term "small grocery store" as mentioned in these Provisions refers to the operators of non-staple food stores, canteens, convenience stores, etc. with fixed business premises, small use area and small business scale, which mainly sell prepackaged foods and bulk food.
The food vendors mentioned in these Provisions refer to operators who sell prepackaged foods and bulk food or produce and sell food on the spot without a fixed store.
if small food workshops, restaurants, grocery stores and food vendors are mixed, the food and drug supervision and administration department shall determine the business type according to the highest food safety risk level and the priority of food products.
the specific identification conditions for small food workshops, restaurants, grocery stores and food vendors shall be formulated by the provincial food and drug supervision and administration department and implemented after being submitted to the provincial people's government for approval. Article 3 The people's governments at or above the county level shall uniformly lead, organize and coordinate the supervision and management of small food workshops, restaurants, grocery stores and food vendors within their respective administrative areas, strengthen the capacity building of supervision and management, and provide funds, personnel and other guarantees suitable for the supervision and management. Article 4 The food and drug supervision and administration department shall supervise and manage the food safety of small food workshops, restaurants, grocery stores and food vendors within their respective administrative areas.
health, urban management administrative law enforcement, quality supervision, industrial and commercial administration, environmental protection, public security, ethnic affairs and other departments, in accordance with laws, regulations and the provisions of the people's government at the same level, undertake the supervision and management work related to small food workshops, restaurants, grocery stores and food vendors.
township (town) people's governments and sub-district offices shall, in accordance with laws, regulations and the provisions of the people's governments at higher levels, do a good job in food safety related to small food workshops, restaurants, grocery stores and food vendors within their respective jurisdictions.
village (neighborhood) committees shall assist relevant departments and township (town) people's governments and sub-district offices in the supervision and management of small food workshops, restaurants, grocery stores and food vendors, and may organize food safety mass supervisors to conduct regular inspections, admonish food safety violations, and report to urban management administrative law enforcement, food and drug supervision and management departments in a timely manner. Article 5 The production and operation activities of small food workshops, restaurants, grocery stores and food vendors shall meet the requirements of food safety, environmental protection, fire control and safe production, be responsible for the safety of their food production and operation, accept social supervision and assume social responsibilities. Article 6 The food and drug supervision and administration department shall publicize and train food safety laws and regulations, food safety standards and knowledge for small food workshops, restaurants, grocery stores and food vendors, and provide free food safety publicity materials.

the food and drug supervision and administration department shall establish and improve the credit management system for small food workshops, restaurants, grocery stores and food vendors. Seventh food workshops, small restaurants, small grocery stores and food vendors prohibit the production and operation of food, the implementation of directory management. The prohibition list shall be formulated by the provincial food and drug supervision and administration department and implemented after being approved by the provincial people's government; The food and drug supervision and administration department of a city divided into districts may increase the types of foods that are prohibited from production and operation on the basis of the prohibited catalogue approved by the provincial people's government, and shall be implemented after being reported to the people's government at the same level for approval. Article 8 The food and drug supervision and administration department shall register small food workshops, restaurants, grocery stores and food vendors, issue registration certificates to small food workshops, restaurants and grocery stores, and issue registration cards to food vendors. No fees shall be charged for the implementation of registration and the issuance of registration certificates and cards. Article 9 Small food workshops, restaurants and grocery stores shall register with the local food and drug supervision and administration department after obtaining the business license and before producing, processing and operating, and provide the following materials:
(1) Identification certificate of producers and operators;
(2) food varieties to be produced, processed or operated;
(3) food safety commitment;
(4) the plan of the production, processing or business premises.
if small food workshops, restaurants and grocery stores provide the materials specified in the preceding paragraph when applying for business licenses, the food and drug supervision and administration department shall simultaneously register and issue registration certificates.
the registration certificate shall specify the names and addresses of small food workshops, restaurants and grocery stores, the names of producers and operators, the types of foods produced and operated, and whether they are engaged in online food business or not.
