Article 1 In order to strengthen the management of kitchen waste, maintain city appearance and environmental sanitation, and ensure food safety and human health, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes, the Regulations of the State Council on the Administration of City Appearance and Environmental Sanitation and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the discharge, collection, transportation, disposal and related management activities of kitchen waste in the urban built-up areas of this Municipality. Article 3 The term "kitchen waste" as mentioned in these Regulations refers to processing waste, kitchen waste, waste cooking oil and other wastes generated in food production, processing and sales, unit catering, catering service and other activities other than residents' family life.

The waste edible oils and fats mentioned in the preceding paragraph refer to animal and vegetable oils and fats that can no longer be eaten and various oil-water mixtures. Article 4 The Municipal People's Government shall exercise unified leadership over the kitchen waste treatment in this Municipality, incorporate the funds for kitchen waste treatment into the budget management, formulate the planning for kitchen waste treatment, strengthen the publicity of kitchen waste treatment, and organize relevant departments to do a good job in kitchen waste treatment.

The municipal administrative department of environmental sanitation is responsible for the supervision and management of kitchen waste in this Municipality. The competent administrative department of environmental sanitation of each district (including Jilin Hi-tech Industrial Development Zone and Jilin Economic and Technological Development Zone) shall be specifically responsible for the daily supervision and management of kitchen waste within its jurisdiction according to the division of responsibilities.

Urban management administrative law enforcement departments shall, in accordance with the provisions of these regulations, investigate and deal with violations of the provisions on the management of kitchen waste.

The food and drug supervision and administration department is responsible for the supervision and management of food production, processing, circulation and catering services, supervising catering service units to establish and implement the inspection system for purchasing edible oil, and investigating and dealing with illegal acts of producing and selling edible products with kitchen waste as raw materials according to law.

The competent department of environmental protection is responsible for the supervision and management of pollution prevention measures of kitchen waste discharge units and disposal enterprises.

The administrative department of animal husbandry shall be responsible for the supervision and inspection of livestock and poultry breeding sites, and investigate and deal with the illegal acts of raising livestock and poultry with kitchen waste without harmless treatment according to law.

The public security organ is responsible for investigating and dealing with food safety crimes that endanger human health by using kitchen waste to manufacture and sell edible products and road traffic violations of kitchen waste collection and transportation vehicles according to law.

Development and reform, finance, price, quality and technical supervision, industry and commerce, tourism, commerce and other relevant departments shall do a good job in the management of kitchen waste according to their respective responsibilities. Article 5 The treatment of kitchen waste shall follow the principles of reduction, harmlessness, recycling and whoever produces it pays.

The Municipal People's Government shall give appropriate subsidies to the collection, transportation and harmless disposal of kitchen waste, and the specific measures shall be formulated separately by the Municipal People's Government. Article 6 The catering trade association shall play the role of industry self-discipline, participate in the formulation of relevant standards, popularize the methods of reducing kitchen waste, and include the management of kitchen waste in the rating scope of catering units. Article 7 Any unit or individual has the right to complain and report any act that violates the provisions on the management of kitchen waste.

After receiving the complaint report, the relevant departments shall promptly investigate and handle it, and inform the complainant or informant of the handling result within 15 working days after receiving the complaint report.

The administrative department of city appearance and environmental sanitation shall reward the verified report. Article 8 The collection, transportation and disposal of kitchen waste shall be franchised.

The kitchen waste discharge unit shall hand over the kitchen waste to the enterprise that has obtained the franchise right for collection and transportation. Units and individuals that have not obtained the franchise right shall not engage in the collection, transportation and disposal of kitchen waste. Article 9 The municipal administrative department of environmental sanitation shall, in accordance with the law, select enterprises for the collection, transportation and disposal of kitchen waste through public bidding and other fair competition methods, issue franchise licenses to the winning enterprises, and make an announcement to the public.

The municipal environmental sanitation administrative department shall sign a franchise agreement for the collection, transportation and disposal of kitchen waste with the winning bidder, and clearly stipulate the operating period, business scope, service standards, termination and change of franchise rights, liability for breach of contract, etc. Tenth kitchen waste discharge units shall comply with the following provisions:

(1) Signing an agreement on the collection and transportation of kitchen waste with the kitchen waste collection and transportation enterprise, and reporting the agreement to the district environmental sanitation administrative department for the record;

(2) Hand it over to the kitchen waste collection and transportation enterprise within 24 hours after the kitchen waste is generated, and notify the kitchen waste collection and transportation enterprise in advance or in time when the output changes greatly;

(three) kitchen waste should be collected separately, and shall not be mixed with tableware, glass, waste paper, plastic and other garbage;

(4) The kitchen waste collection containers shall be kept intact, sealed and tidy, and the oil-water separation facilities set up in accordance with regulations shall be kept in normal use;

(5) Food waste shall not be dumped or piled up at will, and shall not be directly discharged into municipal public facilities such as domestic waste collection facilities, sewage drainage pipelines and rainwater pipelines, and places such as rivers, channels, lakes and reservoirs. Article 11 An applicant applying for the franchise of food waste collection and transportation shall meet the following conditions:

(1) Having the qualification of an enterprise legal person;

(2) Special closed transport vehicles for kitchen waste with the function of preventing odor from spreading, spilling and dripping, and installing management information systems and other related facilities and equipment as required;

(three) to obtain the road transport business license of freight cars and the urban road driving license according to law;

(four) there are fixed office and mechanical equipment, vehicle parking places;

(five) responsible for setting up kitchen waste collection containers in kitchen waste discharge units;

(six) other conditions stipulated by laws, regulations and rules.
