Measures of Shaoguan Municipality on Property Management (for Trial Implementation)

chapter I general provisions article 1 in order to standardize property management activities, safeguard the legitimate rights and interests of owners, interested parties and property service enterprises, and promote the construction of civilized and harmonious communities, these measures are formulated in accordance with the property law of the people's Republic of China, the regulations on property management, the regulations on property management of Guangdong province and other laws and regulations, combined with the actual situation of this municipality. Article 2 These Measures shall apply to property management activities within the administrative area of this Municipality.

the term "property management" as mentioned in these measures refers to the activities that the owner selects a property service enterprise, and the owner and the property service enterprise, in accordance with the property service contract, repair, maintain and manage the house, supporting facilities, equipment and related sites, and maintain the environmental sanitation and public order in the relevant areas. Article 3 The people's governments of cities and counties (cities, districts) shall incorporate property management into the development planning of modern service industry, community construction and community management system, and establish and improve a professional, market-oriented and standardized property management mechanism. Article 4 Advocate green property management, encourage the adoption of new technologies and methods to promote the use of resource saving and environmental protection means such as energy saving, water saving, garbage disposal, environmental greening and pollution prevention in the property management area, and promote the intensification, informationization and low carbonization of property management. Article 5 The municipal administrative department of property management shall be responsible for the supervision and management of property management activities in the whole city, and perform the following duties:

(1) Formulating relevant policy documents on property management in the whole city;

(2) to guide and supervise the property management administrative departments of counties (cities, districts) and other relevant administrative departments, sub-district offices, township people's governments and trade associations to carry out property management work according to law;

(3) administrative acts of making administrative penalties related to property management according to law;

(4) to co-ordinate the supervision of the city's property special maintenance funds;

(5) supervise the bidding activities of property management in the whole city;

(6) establishing a credit system for property management;

(7) Other duties as stipulated by laws, regulations and rules. Article 6 The county (city, district) property management administrative department shall be responsible for the supervision, management and guidance of property management activities within its administrative area, and perform the following duties:

(1) To guide the subdistrict offices and township people's governments to perform their duties of property management supervision;

(2) handling disputes over the division of property management areas in conjunction with sub-district offices and township people's governments;

(3) to guide the bidding activities of property management;

(4) handle the filing matters such as the division of property management areas, owners' committees, property service contracts, and property management bidding;

(5) to approve the application for hiring the realty service enterprise in the early stage by agreement;

(6) confirm that the election of the owners' committee is illegal;

(7) to revoke the decisions made by the owners' assembly and the owners' committee that violate the mandatory provisions of laws and regulations; Revoking the contents in the management statute that violate the mandatory provisions of laws and regulations;

(8) coordinate and handle property management disputes according to law;

(9) administrative acts of making administrative penalties related to property management according to law;

(11) Other duties as stipulated by laws, regulations and rules. Article 7 the subdistrict offices and township people's governments, under the guidance of the county (city, district) property management administrative departments, are responsible for organizing and coordinating the establishment of the owners' meeting and the election of the owners' committee, guiding and supervising the daily activities of the owners' meeting and the owners' committee, and are specifically responsible for the following duties:

(1) verifying the establishment conditions of the owners' meeting, organizing and coordinating the establishment of the preparatory group for the first owners' meeting, and guiding the preparatory group to carry out preparatory work;

(2) organizing to convene a meeting of the owners' congress in case of collective resignation of the owners' committee, failure of the owners' committee to convene a meeting of the owners' congress as required and refusal to implement the decision of convening the meeting within a time limit;

(3) If the director or deputy director of the owners' committee cannot convene or fails to convene a meeting of the owners' committee without justifiable reasons, appoint a member to convene and preside over the meeting of the owners' committee;

(4) to investigate the decisions of the owners' assembly and owners' committee that violate the mandatory provisions of laws and regulations, and order them to make corrections within a time limit or report them to the county (city, district) competent department for cancellation;

(5) If the owners' committee fails to complete the general election according to law, supervise the owners' committee to organize the general election;

(6) Designate personnel to manage the property, seal and materials of the owners' committee that has been dissolved or whose term of office has expired but has not completed the general election;

(7) coordinate and handle property management disputes according to law;

(8) handling property management complaints, reports and letters and visits according to law;

(9) Other duties of property management supervision as stipulated by laws, regulations and rules. Eighth neighborhood (village) committees accept the business guidance of the county (city, district) property management administrative departments, cooperate with the supervision, coordination and guidance of property management activities within their respective jurisdictions, and mediate property management disputes. Ninth county (city, district) people's government is the responsible unit of property management within its jurisdiction, and should strengthen the organization and leadership of property management. Counties (cities, districts) property management administrative departments, sub-district offices, township people's governments and neighborhood (village) committees shall clarify personnel and work funds to ensure the normal development of property management activities within their jurisdiction.
