Shanghai Food and Drug Administration officially released on the 27th and the Shanghai Municipal Communications Bureau jointly developed the "Shanghai network food service supervision and management approach". The approach will be formally implemented on September 1st.

Accordingly, food and drug regulatory authorities at all levels in Shanghai will implement food safety credit management of network food service operators, third-party platforms, the establishment of a food safety credit file, record of the results of daily supervision and inspection, investigation and handling of violations, responsibility for the interview and rectification, etc., and according to the credit record, to adjust the frequency of supervision and inspection. At the same time, the third-party platform there are violations and serious consequences, according to law should be revoked license, the Shanghai Food and Drug Administration will write to the Shanghai Municipal Communications Bureau, the Shanghai Municipal Communications Bureau according to the revocation of the license.

Previously, the People's Republic of China **** and the State Food Safety Law added a third-party platform provider of network food trading legal obligations and legal responsibility.

It is understood that the "Measures" on the network food service operators, delivery links and third-party platforms have put forward requirements, while encouraging network food service operators and third-party platforms to participate in food safety social **** governance.

On the network food service operators, "Measures" provides that the network food service operators of the actual business address, business projects, etc. should be consistent with their food business license. Network food service operators should be in the home page of its website or the main page of business activities in a conspicuous position, complete, true and clear display of business license, food business license information. Network food service operators to send their own food, should strengthen the training and management of food delivery personnel, food delivery process should be consistent with food safety requirements.

The food delivery link has a certain food safety risk, "Measures" put forward food safety requirements in the food delivery link. Network food service operators to send their own food, should comply with the relevant requirements; entrusted network food service third-party platforms, third-party logistics delivery, should be verified whether it has the required conditions.

In addition to the implementation of the health management system for food delivery personnel, "Measures" provides that the containers used to hold food should be in line with food safety standards; food delivery should be able to take to prevent dust, rain and other contamination of effective measures to ensure that the process of delivery of food is not contaminated; the use of the delivery box or delivery bag should be cleaned and disinfected on a regular basis.

For food with special temperature requirements such as refrigeration, such as cold dishes, raw food, cold-processed pastries, pre-mixed salad, etc., the distribution conditions should be in line with the temperature requirements to ensure food safety, food and toxic, harmful substances shall not be distributed together. In addition, the "Measures" to encourage the food containers or packaging labeled food production cooking time and safe consumption time limit, and to remind consumers to receive as soon as possible after consumption.

"Measures" on the third-party platform put forward the relevant provisions: the third-party platform should be on the network food service operators for real-name registration, record their social credit code, food license number, license expiration date, approved name, address, business projects, contact person, contact information. The third-party platform inspection found that the platform of the network food service providers in violation of the law, should be stopped in a timely manner and reported to the local market supervision authority; found that the network food service providers have no license to operate, operating prohibited production and operation of food, food safety accidents and other serious violations of the law, it should be immediately stopped to provide network trading platform services.

The Shanghai Municipal Food and Drug Administration said on the same day, to encourage the establishment of platforms within the network food service providers food safety credit evaluation system, and online publicity credit evaluation; at the same time, to encourage the establishment of consumer pre-payment system and insurance food safety liability.
