Rural villagers building houses shall conform to the overall land use planning and township (town) village planning, and shall not occupy permanent basic farmland, and try to use the original homestead and village parents. The overall land use planning and village planning of townships (towns) shall make overall planning and reasonable arrangement of homestead, and improve the living environment and conditions of rural villagers.
According to the fourth paragraph of Article 31 of the Interim Measures for the Management of Homestead promulgated by the Ministry of Agriculture and Rural Affairs, if the inherited house collapses, is demolished according to law or is identified as a D-class dangerous house, the heirs who do not meet the application conditions of the homestead will recover the right to use the homestead according to law.
Rural houses inherited by urban residents cannot be rebuilt or renovated, that is to say, urban household registration personnel can inherit rural houses left by their parents in their hometown, but they can only use them, but they cannot be rebuilt or renovated.
Because according to the relevant provisions of the Rural Collective Economic Organization Law, it is obvious that urban residents do not enjoy the right to rebuild and renovate rural houses. Once a farm house is uninhabited for a long time, it is easy to collapse.
