The term "temporary population" as mentioned in these Regulations refers to people who leave the town where their permanent residence is located and live in other areas. Third people's governments at all levels should strengthen the leadership of the public security management of the temporary population, and organize and coordinate the relevant departments to manage the temporary population.
The public security organ is the competent authority for the public security management of the temporary population. Public security organs and family planning, industry and commerce, labor, civil affairs, health and other relevant administrative departments shall carry out their duties and cooperate with each other to do a good job in the management of temporary population. Fourth organs, organizations, enterprises and institutions, neighborhood (village) committees should actively assist the public security organs to do a good job in the public security management of temporary residents.
Units that accept temporary population accommodation or employ temporary population shall establish and improve the public security management system of temporary population and implement management responsibilities. Article 5 The legitimate rights and interests of temporary residents are protected by law, and no unit or individual may infringe upon them.
The temporary population shall abide by laws, regulations and the relevant provisions of the temporary residence, and obey the public security management of the temporary residence. Chapter II Registration Article 6 The public security police station shall be responsible for the public security management of the temporary population within its jurisdiction.
The police station can set up temporary population registration stations (points) according to the needs of public security management of temporary population, and be responsible for temporary population registration, temporary residence permit issuance and daily public security management. Article 7 Temporary residents who intend to stay in urban areas for more than five days or in towns and villages for more than seven days shall, within five days of their arrival in urban areas or seven days of their arrival in towns and villages, apply for temporary registration with their resident identity cards or other valid documents to the local police station or temporary population registration station (point):
(a) temporary residence in residents' homes, declared by the householder or temporary staff with the householder's household registration book;
(two) temporary rental housing, housing lessors and temporary staff to declare the rental housing security management license and housing lease contract;
(3) staying temporarily in government agencies, organizations, military units, enterprises and institutions, construction sites, sheds, workshops, shops, water ships and other workplaces. Should be registered and declared by the unit or employer;
(four) temporary residence in religious places, unified registration and declaration by religious places;
(five) lodging hotels, according to the provisions on the administration of public security in the hotel industry;
(six) inheritance, purchase or self-built housing, I hold the housing property certificate or other relevant certification materials to declare and register. Article 8 The medical staff approved by the prison reeducation-through-labor institution to go out or be released shall hold the certificate of the approving authority and report to the police station for temporary registration within 24 hours after arriving at the temporary residence. Article 9 The following persons who intend to live in their temporary residence for more than 1 month and have reached the age of 16 shall apply for a temporary residence permit at the same time as registering for temporary residence:
(a) personnel employed by organs, organizations, military units, enterprises and institutions;
(2) Personnel engaged in industry, handicrafts, construction and transportation;
(3) Personnel engaged in commerce, catering, repair and service industries;
(4) Personnel engaged in planting and breeding;
(five) other personnel who need to apply for a temporary residence permit. Tenth temporary employees such as visiting relatives, friends, foster care, sending students to school, seeing a doctor and going to school. , as well as the full-time employees of floating units owned by the whole people who have lived temporarily for 1 month or more, only need to declare temporary residence registration, and do not need to apply for temporary residence permits. Eleventh temporary staff in the temporary residence to change the address, it should be to the public security police station or temporary population registration station (point) for the change.
If a temporary resident dies in the temporary residence, the unit or individual that accepts the temporary resident or employs the temporary resident shall report to the local police station. Twelfth police stations or temporary population registration stations (points) should be civilized management, enthusiastic service and convenient for the masses in the public security management of temporary population. To apply for temporary residence registration, a temporary residence permit shall be issued within seven days after examining the applicant's certificate.
The public security police station or the temporary population registration station (point) shall check the family planning certificate of married women of childbearing age when handling the temporary residence procedures, and inform the township (town) people's government and the family planning work institution of the city street office of the temporary residence. Thirteenth temporary residence permit is valid for one year. If you need to stay temporarily after the expiration, you should go through the extension procedures. If the temporary residence permit is lost or damaged, it shall be replaced or renewed in time. Article 14 Where a private house, unit house or housing management department rents public houses to the temporary population, the lessor of the house shall, with the property right certificate or other legal documents in advance, report to the local police station for obtaining the public security management license of the rented house, and report the annual inspection according to the regulations.
The lessor and lessee of the house shall abide by the relevant provisions on the public security management of the leased house. Fifteenth persons who receive temporary residence permits shall pay the administrative fees for public security of the temporary population.
The lessor shall pay the rental housing security management fee when applying for the "Rental Housing Security Management Permit".
The charging items, standards and management measures shall be formulated by the provincial public security department and approved by the provincial finance and price departments.
