(2) For the sea areas and inland waters that are collectively owned or owned by the whole people and used by agricultural collective economic organizations, the right to contracted management of sea areas and inland waters shall be determined in accordance with the Fisheries Law, the Land Management Law and the relevant provisions on contracted management of land;

Those who use sea areas and inland waters without a license to engage in aquaculture production shall be registered by the fishery administrative department of the local people's government at or above the county level, and the aquaculture facilities shall be dismantled within a time limit.
3. Units and individuals engaged in aquaculture production activities using sea areas and inland waters shall apply to the fishery administrative department of the local people's government at or above the county level.
Second, the application materials:
An application form for aquaculture; Two, the applicant's identity certificate or unit certificate. The unit shall also submit the following materials: 1, and proof of the source of funds suitable for the breeding scale; 2. Description of breeding technical conditions; 3. Other certification materials stipulated by laws and regulations. When applying for the use of collectively owned sea areas and inland waters for aquaculture production, in addition to providing the above materials, an effective contract for contracted management of sea areas and inland waters should also be provided.
Third, the declaration process:
1, application. Units and individuals that use sea areas and inland waters to engage in aquaculture production activities shall apply to the fishery administrative department of the local people's government at or above the county level and fill in the application form. The unit should also submit the credit certification materials and the description of the technical conditions of breeding that are suitable for the scale of breeding.
2. Review. The fishery administrative department of the local people's government at or above the county level shall carefully examine the application materials, and conduct on-site inspection together with the personnel of the relevant units to confirm the demarcation and verify the relevant situation.
3. approval. Upon examination, the fishery administrative department shall report to the people's government with the power of examination and approval for approval, and issue a breeding certificate.
4, collectively owned or owned by the whole people by the agricultural collective economic organizations in the use of sea areas and inland waters, the contractor in accordance with the provisions, after signing the contract, to the jurisdiction of the people's governments at or above the county level for registration, to obtain a breeding certificate.
5, register, announcement. The fishery administrative department shall register the aquaculture certificates that have been issued, and draw signs for the sea areas and inland waters that have been issued, and announce them to the public in a timely manner.
