The competent customs shall be responsible for the inspection, quarantine, supervision and administration of import and export aquatic products within its jurisdiction. Article 5 The Customs shall carry out inspection and quarantine, supervision and spot check on imported and exported aquatic products according to law, and implement credit management and classified management system for imported and exported aquatic products production and processing enterprises (hereinafter referred to as production enterprises) according to the needs of supervision and the relevant provisions of the General Administration of Customs. Article 6 Enterprises producing aquatic products for import and export shall engage in production and operation in accordance with laws, administrative regulations and relevant standards, be responsible to the society and the public, ensure the quality and safety of aquatic products, accept social supervision and assume social responsibilities. Article 7 The General Administration of Customs shall implement the filing management system for the inspection and quarantine issuing agencies of import and export aquatic products, and those without filing shall not be issued. Chapter II Import Inspection and Quarantine Article 8 Imported aquatic products shall meet the requirements of China laws, administrative regulations and national food safety standards, as well as the inspection and quarantine requirements in relevant agreements, protocols and memorandums signed between China and exporting countries or regions and the quarantine requirements in trade contracts.
Imported aquatic products without national food safety standards shall be inspected by the customs according to the standards temporarily applied by the health administrative department of the State Council. Article 9 The General Administration of Customs shall, according to the provisions of laws and administrative regulations, the requirements of national food safety standards, the results of risk analysis of aquatic products at home and abroad, and the results of effectiveness evaluation of the quality and safety management system of countries or regions planning to export aquatic products to China, formulate and publish the inspection and quarantine requirements for imported aquatic products in China; Or sign inspection and quarantine agreements with countries or regions that intend to export aquatic products to China, and determine inspection and quarantine requirements and relevant certificates. Article 10 The General Administration of Customs shall put on record the exporters or agents who export aquatic products to China, and regularly publish the list of qualified overseas production enterprises and the exporters and agents for the record.
The registration management of overseas production enterprises importing aquatic products shall be implemented in accordance with the relevant provisions of the General Administration of Customs. Article 11 The customs shall record the consignees of imported aquatic products. The consignee who has implemented the record management can go through the import formalities of aquatic products. Article 12 The consignee of imported aquatic products shall establish a record system for the import and sale of aquatic products. Records shall be authentic and shall be kept for no less than two years. Article 13 The General Administration of Customs shall implement the quarantine examination and approval system for imported amphibians, reptiles, aquatic mammals and other aquatic products with high safety and health risks. The consignee of the above products shall go through the quarantine examination and approval procedures before signing the trade contract, and obtain the Quarantine Permit for Entry Animals and Plants.
The General Administration of Customs may, according to needs and relevant regulations, send personnel to export countries or regions for pre-inspection of imported aquatic products. Article 14 Before or at the time of import of aquatic products, the consignee or his agent shall submit the original inspection and quarantine certificate, certificate of origin, trade contract, bill of lading, packing list, invoice and other documents issued by the exporting country or region to the customs at the port of import for inspection.
The official inspection and quarantine certificate of the exporting country or region attached to the imported aquatic products shall meet the requirements of the General Administration of Customs for the certificate. Article 15 The customs shall examine the relevant documents submitted by the consignee or its agent, and if they meet the requirements, they shall accept the inspection and write off the quarantine quantity. Article 16 Imported aquatic products shall be stored in cold storage or other places designated by the customs. The import port shall have a cold storage suitable for the quantity of imported aquatic products. Cold storage shall meet the inspection and quarantine requirements of imported aquatic products cold storage. Article 17 The means of transport and containers of imported aquatic products shall be subject to epidemic prevention and disinfection under the supervision of the customs at the import port. Without the permission of the customs, imported aquatic products shall not be unloaded from the means of transport and containers without authorization. Article 18 The customs at the port of import shall conduct on-site inspection and quarantine of imported aquatic products in accordance with regulations. On-site inspection and quarantine includes the following contents:
(1) Examining certificates and goods;
(two) check whether the packaging meets the basic requirements of imported aquatic products packaging;
(three) the implementation of plant quarantine on imported salt (dry) aquatic products prone to plant diseases and insect pests, and the implementation of pesticide treatment when necessary;
(four) check whether the goods are corrupt, whether they contain foreign objects, whether they are dry, and whether there is too much blood ice frost.
