Article 1 These Regulations are formulated in accordance with relevant laws and regulations, combined with the actual situation of this Municipality, in order to strengthen the management of dog-raising, restrict and standardize dog-raising behavior, safeguard citizens' health and personal safety, and maintain social order and city appearance and environment.
Article 2 These Regulations shall apply to dog raising, management and related management activities within the administrative area of this Municipality. Military dogs, police dogs, search and rescue dogs, guide dogs and dogs raised by zoos, professional performance groups and scientific research institutions for special work shall be implemented in accordance with relevant state regulations.
Article 3 Dog management within the administrative area of this Municipality is divided into key management areas and general management areas. Key management areas are urban areas, built-up areas of county towns and key areas determined by the people's governments of cities and counties (districts). General management area refers to other areas outside the key management area. The scope of key management areas shall be delineated by the people's governments of cities and counties (districts) and announced to the public.
Article 4 The people's governments of cities and counties (districts) shall be responsible for the management of raising dogs within their respective administrative areas. A dog management coordination mechanism involving public security, urban management and law enforcement, agriculture and rural areas, health and hygiene, market supervision and management, housing and urban and rural construction should be established to coordinate and solve major problems in dog management; Take dog management as an important part of civilized city construction and comprehensive management of social security, and organize special rectification activities for dog management every year; Incorporate dog management funds into the fiscal budget at the corresponding level, implement necessary personnel, places and facilities, and ensure the normal operation of dog management. The town people's government and sub-district offices shall organize and coordinate the residents' committees and villagers' committees to control and dispose of stray dogs within their respective jurisdictions.
Fifth city and county (District) public security organs are responsible for dog registration and annual inspection, catching stray dogs, killing rabies, and investigating relevant illegal acts. Urban management and law enforcement departments are responsible for investigating the behavior of dogs that affect the city appearance and environmental sanitation, and guiding and supervising the setting of signs prohibiting dogs from entering public places. The agricultural and rural departments are responsible for dog immunization and quarantine, stray dog management, harmless treatment of dog carcasses, and monitoring of canine rabies epidemic. The health department is responsible for the prevention and control of rabies, epidemic monitoring and health education. The market supervision and management department is responsible for the supervision and management of dog business activities. The housing and urban-rural construction department is responsible for urging property service enterprises or other managers to do a good job in discouraging and reporting illegal dog-raising behavior within the management area.
Article 6 Community residents' committees and villagers' committees shall assist the relevant departments to do a good job in dog registration management, epidemic prevention and dog dispute mediation within their respective jurisdictions, carry out publicity activities on raising dogs according to law and in a civilized manner, and guide and urge dog owners to abide by the dog-raising code of conduct. The owners' congress may incorporate dog-raising matters into the management statute and supervise the implementation. Property service enterprises or other managers shall carry out publicity and education on civilized dog raising according to law, discourage illegal dog raising, and report to the relevant administrative departments.
Article 7 Dog owners shall keep dogs in a civilized manner according to law, respect social morality and shall not harm public interests or the legitimate rights and interests of others.
Eighth city and county (District) people's governments and their relevant departments shall, through various forms, carry out publicity and education on civilized dog raising and rabies prevention and control according to law. Radio, television, newspapers, websites and other news media should strengthen dog-raising knowledge propaganda and social morality education, guide dog owners to form good dog-raising habits, and expose illegal dog-raising behaviors.
Article 9 Any unit or individual has the right to report and complain about acts in violation of the provisions of these Regulations. The dog management department shall publish the telephone number, e-mail, online platform, e-mail and other ways to accept reports and complaints, handle them in a timely manner according to the division of responsibilities after receiving reports or complaints, keep confidential the relevant information of informants, and feed back the handling situation to informants.
chapter two
Dog registration and epidemic prevention
Tenth key management areas of individual dogs, each household is limited to one. In key management areas, other units are prohibited from raising dogs except those registered in dog business activities according to law.
Eleventh key management areas prohibit the breeding of strong dogs and large dogs. The list of strong dogs and large dogs shall be determined by the municipal agricultural and rural departments in conjunction with the public security organs and announced to the public.
Twelfth key management areas to implement the dog registration management system. After the dog has obtained the immunization certificate, the dog owner shall go through the dog registration formalities with the public security organ within fifteen days. Without registration, dogs are not allowed. Dog registration certificate is inspected once a year. City, county (District) public security organs shall promptly announce the dog registration places to the public.
Thirteenth key management areas to apply for dog registration, shall meet the following conditions:
(1) Having full capacity for civil conduct;
(two) with the city's household registration or residence permit;
(3) Dogs have been vaccinated against rabies;
(4) No record of punishment for abandoning or maltreating dogs;
(5) There is no record of dogs being confiscated within three years;
(six) dogs are not included in the list of prohibited feeding, and the number of dogs meets the requirements.
Encourage dog owners to sterilize dogs, and appropriately reduce or limit dog management fees when registering or inspecting sterilized dogs.
Fourteenth public security organs shall complete the examination within ten working days from the date of receiving the application materials for dog registration. In line with the registration conditions, dog registration certificate and dog license will be issued, and electronic identification will be implanted for dogs. If it does not meet the registration conditions, it shall not be registered, and the reasons shall be explained in writing.
Fifteenth key management areas, under any of the following circumstances, dog owners should apply to the public security organ for change or cancellation of registration within thirty days from the date of occurrence of related matters:
(1) Changing the dog-raising place and the dog-raising person;
(2) the dog is dead;
(3) Giving up breeding and sending dogs to dog shelters;
(four) other circumstances that need to be changed or cancelled.
Sixteenth key management areas, individuals who do not keep dogs to receive temporary dogs, should have full capacity for civil conduct, and dogs have been registered. The number of dogs in foster care shall not exceed one.
Article 17 This Municipality implements a compulsory rabies immunization system for dogs. Within 30 days after the dog is born for three months, and within 30 days before the expiration of the immunization period, the dog owner shall go to the immunization point to vaccinate the dog with rabies vaccine and apply for a rabies immunization certificate. Agricultural and rural departments should set up and publicize immunization spots in accordance with the principles of reasonable layout and convenient inoculation. When dogs are vaccinated with rabies vaccine for the first time, the agricultural and rural departments shall issue dog immunization cards to dog owners.
Article 18 If a dog owner discovers that his dog is suspected of being infected with rabies or other serious zoonotic infectious diseases, he shall immediately report to the local agricultural and rural departments or animal epidemic prevention and control institutions, and quickly take control measures such as isolation to prevent the spread of animal epidemic. When rabies epidemic occurs, the people's governments of cities and counties (districts) and relevant departments shall designate epidemic spots and epidemic areas according to the epidemic situation, take emergency prevention and control measures according to law, and dog owners shall cooperate unconditionally.
Nineteenth dogs in key management areas need to pay limited dog management fees, and the specific charging standards are determined by the municipal price management agencies according to the procedures prescribed by laws and regulations.
Twentieth public security organs should establish and improve the dog management electronic files and information management system, and realize information sharing with urban management and law enforcement, agriculture and rural areas, health and other departments.
chapter three
Code of conduct for raising dogs
Twenty-first dog owners shall abide by the following codes of conduct:
(a) dogs in key management areas are kept in places where dog owners live, and shall not occupy roofs, corridors and other parts; In the general management area, strong dogs are tied up or kept in captivity, and other dogs are encouraged to be tied up;
(2) If barking interferes with the normal life of others, effective measures shall be taken to stop it in time;
(3) Do not allow or drive away dogs to intimidate or hurt others;
(4) Do not abandon or abuse dogs;
(five) after the death of the dog, the dog's body will be sent to the harmless treatment site announced by the agricultural and rural departments, and the dog's body shall not be abandoned;
(six) other dog-raising behaviors as prescribed by laws and regulations.
Twenty-second dogs are prohibited from entering the following places:
(1) Party and government organs, medical institutions, educational institutions, public service halls, etc. ;
(two) theaters, museums, libraries, art galleries, cultural centers, science and technology museums, stadiums, archives, memorial halls, city exhibition halls, etc.;
(3) Hotels, shopping malls and restaurants;
(four) scenic spots and cultural relics protection units;
(5) public transportation;
(six) other public places as prescribed by laws and regulations.
No dog-raising places other than those specified in the preceding paragraph shall be clearly marked.
Twenty-third individual dogs in key management areas shall comply with the following norms:
(a) wear a valid dog tag for the dog, and be led by a person with full capacity for civil conduct to use the leash; The traction belt shall not exceed1.5m. When pedestrians are crowded, consciously tighten the traction belt;
(2) Wearing masks for dogs;
(three) take the initiative to avoid the elderly, the disabled, pregnant women and minors;
(four) when taking the elevator with the dog, you should avoid the peak hours of elevator operation and take effective control measures to avoid others;
(5) Clean up the dog manure immediately.
Twenty-fourth general management area, for dogs to wear effective immunization card. Fierce dogs and large dogs really need to go out for immunization, diagnosis and treatment. Dog owners should use a leash and put a muzzle on the dog or put it in a kennel.
Twenty-fifth community residents' committees, villagers' committees and owners' committees may, according to the actual situation, delimit dog walking areas in their residential areas and set up obvious signs.
Twenty-sixth dogs hurt others, dog owners should immediately send the victims to medical institutions for diagnosis and treatment, and bear legal responsibility according to law.
chapter four
Dog management
Twenty-seventh engaged in dog breeding, sales, dog diagnosis and treatment, beauty treatment, foster care and other business activities, should meet the requirements of animal epidemic prevention in accordance with the law, and handle the relevant permits in accordance with the law.
Twenty-eighth engaged in dog trading activities, should be in the city and county (District) people's government unified planning of dog trading places. When trading dogs, the seller shall hold an animal quarantine certificate.
Twenty-ninth it is forbidden to engage in dog breeding, trading, diagnosis and treatment activities in public places such as urban roads, overpasses, overpasses and underground passages.
Thirtieth it is forbidden to engage in dog breeding and sales activities in residential buildings.
chapter five
Dog kennel management
Thirty-first city and county (District) people's governments shall set up dog shelters to receive, inspect and dispose of stray dogs and confiscated dogs, and set up harmless treatment sites.
Dog shelters shall meet the requirements for animal epidemic prevention, formulate special work norms and take measures to prevent the breeding of dogs.
Thirty-second kennels receive stray dogs, should check the electronic identification, immune tags and dog tags of stray dogs, check the dog owner's identity information.
Unable to find out the identity information of the dog owner, it is regarded as an ownerless dog. If the identity information of the dog owner can be ascertained, the dog owner shall be notified to claim it within five days. Dog owners who take back their dogs shall bear the expenses incurred during the dog receiving period; Dog owners who fail to claim it within the time limit shall be regarded as abandoned.
Thirty-third individuals who meet the requirements for dog registration can adopt ownerless dogs in dog shelters.
Thirty-fourth registered dog-raising associations, animal protection organizations and other social organizations can carry out non-profit activities such as dog shelter and adoption, and accept the supervision of relevant departments.
Chapter vi
Legal liability
Thirty-fifth in violation of the provisions of the first paragraph of article tenth of this Ordinance, more than the limited number of dependents, the public security organ shall order it to make corrections within a time limit; If no correction is made within the time limit, the dogs raised in excess of the limit shall be confiscated, and each dog raised in excess of the limit shall be fined from 50 yuan to 200 yuan.
Thirty-sixth in violation of the provisions of the first paragraph of article eleventh of this Ordinance, the public security organ shall order it to make corrections within a time limit, and each dog shall be fined between two hundred yuan and five hundred yuan; If no correction is made within the time limit, the dogs will be confiscated.
Thirty-seventh in violation of the provisions of the first and second paragraphs of Article 12 of these regulations, if a dog is not registered or inspected, the public security organ shall order it to make corrections within a time limit and impose a fine of more than 200 yuan and less than 500 yuan on each dog; If no correction is made within the time limit, the dogs will be confiscated.
Article 38 In violation of the provisions of the first paragraph of Article 17 of these regulations, if the dogs kept are not vaccinated with rabies vaccine, the competent agricultural and rural authorities shall order them to make corrections within a time limit and may impose a fine of 1000 yuan; If no correction is made within the time limit, a fine of not less than 1,000 yuan but not more than 5,000 yuan shall be imposed. The competent agricultural and rural authorities shall entrust animal clinics and harmless treatment sites to handle it on their behalf, and the expenses required shall be borne by the violator.
Article 39 In violation of the provisions of the first paragraph of Article 18 of these regulations, if dogs are found to be infected, suspected to be infected, or have not taken isolation and other control measures, the competent agricultural and rural departments shall order them to make corrections and may impose a fine of not more than 10,000 yuan; Those who refuse to make corrections shall be fined 1 10,000 yuan but not more than 50,000 yuan, and may be ordered to suspend business for rectification.
Fortieth in violation of the provisions of the first paragraph of Article 21 of these regulations, the public security organ shall order it to make corrections if it fails to tie or pen dogs in the general management area; If no correction is made within the time limit, a fine of more than 200 yuan and less than 500 yuan may be imposed on each dog.
Article 41 Anyone who violates the fourth paragraph of Article 21 of these regulations shall be fined between 200 yuan and 500 yuan by the public security organ, and the dog shall be confiscated.
Article 42 Whoever, in violation of the provisions of Item (5) of Article 21 of these regulations, litters the dead bodies of dogs shall be ordered by the urban management law enforcement department to make corrections, take remedial measures, clean up or remove them, and shall be given a warning according to the seriousness of the case. Individuals may be fined from 50 yuan to 200 yuan, and units may be fined from 200 yuan to 2,000 yuan.
Forty-third in violation of the provisions of the provisions of article twenty-second, with dogs into the dog ban area, the public security organs shall order it to make corrections, and each dog may be fined from 50 yuan to 200 yuan.
Forty-fourth in violation of the provisions of the first paragraph of article twenty-third, the public security organ shall order it to make corrections, and may impose a fine of fifty yuan to five hundred yuan. Refuses to correct, confiscate the dog.
Article 45 In violation of the provisions of the fifth paragraph of Article 23 of these regulations, dogs who urinate anywhere are not cleaned up, and the urban management law enforcement department shall order the dog owners to correct, take remedial measures, clean up or clear up, give a warning according to the seriousness of the case, and impose a fine of more than 50 yuan 100 yuan.
Article 46 If, in violation of the provisions of Article 24 of these regulations, strong dogs and large dogs need to go out for immunization and diagnosis and treatment, and do not wear muzzle or put them in dog cages, the public security organ shall order them to make corrections, and each dog may be fined from 50 yuan to 200 yuan.
Forty-seventh in violation of the provisions of article twenty-ninth, the urban management law enforcement department shall be ordered to stop the illegal act; Refuses to correct, can temporarily detain the dog and business activities related items, and impose a fine of fifty yuan to two hundred yuan.
Forty-eighth dogs, interfere with the normal life of others, or let dogs intimidate and drive dogs to hurt others, shall be punished in accordance with the "People's Republic of China (PRC) Public Security Management Punishment Law"; If a crime is constituted, criminal responsibility shall be investigated according to law.
Forty-ninth hinder the dog management staff to perform their duties according to law, by the public security organs according to law.
Fiftieth city, county (District) people's government, town people's government, street offices and relevant departments directly in charge and other directly responsible personnel, one of the following acts, by the unit or the supervisory organ shall be punished according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
(1) Handling dog registration or annual inspection procedures for unqualified dog owners;
(two) to meet the conditions of raising dogs, without justifiable reasons, or not to go through the formalities of dog registration, annual inspection, change and cancellation within the prescribed time limit;
(3) Inadequate supervision of dog immunization, resulting in serious consequences;
(four) the illegal dog-raising behavior that has been found and should be dealt with according to law is not dealt with, and the circumstances are serious;
(five) the report and discovery of stray dogs do not perform their duties in accordance with the provisions of these regulations, and the circumstances are serious or cause serious consequences;
(six) other acts of abuse of power, dereliction of duty, favoritism.
Fifty-first other acts in violation of the provisions of this Ordinance, laws and regulations have been punished, from its provisions.
Chapter VII
supplementary terms
Article 52 The term "dog owners" as mentioned in these Regulations refers to the actual dog owners and managers.
The term "stray dogs" as mentioned in these Regulations refers to dogs that are not effectively controlled and cannot find out the identity information of dog owners on the spot, including dogs that have no owners, abandoned or lost.
