Interim Measures for Supervision and Inspection of Feed Product Quality Management

Article 2 The Henan Provincial Department of Animal Husbandry Administration is responsible for the supervision and management of the feed industry in the province, is responsible for organizing the feed product quality industry supervision, the organization of the province's feed product quality monitoring agencies certified on the feed product quality testing and inspection work.
Article 3 The province engaged in the supervision and management of feed product quality, inspection, arbitration units and staff shall comply with these measures.
Article IV feed management departments at all levels in the province should strengthen the supervision and management of feed product quality leadership, supervision and management of feed product quality to provide the necessary conditions.
Article 5 The supervision and inspection of feed product quality includes supervision and sampling, regular supervision and inspection, daily supervision and inspection, tracking supervision and inspection and other forms.
(A) supervision and sampling. Is the main form of supervision and inspection of feed product quality, is the feed management department in accordance with the national or provincial feed management department approved the inspection plan for the inspection of feed product quality.
(B) regular supervision and inspection. Above the county level by the feed management department in accordance with local practice, in accordance with the approved plan for the inspection of feed product quality.
(C) daily supervision and inspection. Refers to the feed management department at or above the county level according to users, consumers and relevant organizations to report, reflect and have obtained evidence of suspected quality violations, specific feed enterprises, specific feed products for inspection.
(D) tracking supervision and inspection. Refers to the supervision and sampling, regular supervision and inspection, routine tracking inspection of unqualified feed products, ordered the producer to rectify, the tracking inspection of its products.
In addition to the supervision and inspection in accordance with the provisions of the preceding paragraph, shall not carry out any other form of inspection.
Article 6 Feed product quality supervision and regular supervision and inspection must be planned, the national and provincial feed product quality supervision and inspection work plan issued by the provincial feed management department to break down the issued by the feed management department at or above the county level to cooperate with the organization and implementation of the feed management department; municipalities in the province, counties (cities, districts), feed product supervision and inspection and regular supervision and inspection plan, reported to the provincial feed management department for approval at all levels. Article 8 The application of feed product quality supervision and sampling work plan, should indicate the source of funding, the name of the feed company being tested and the type of feed products, the number of statutory inspection agency, the organization and implementation of the unit and other matters.
Article IX of the provincial feed management department in the first half of the year under the regular supervision and inspection work plan, the second half of the supervision and sampling work plan. Article 14 The feed management department in the implementation of feed product quality supervision and inspection of post-processing work, to correctly grasp the boundaries of general quality problems and serious quality problems. Serious quality problems refers to: (1) product quality does not meet the national standards for the protection of human health, industry standards, enterprise standards; (2) in the feed products mixed, adulterated, counterfeiting, substandard; (3) belongs to the state expressly eliminated products; (4) failure, deterioration of; (5) counterfeiting the origin of the product; forged or fraudulently use the name of the factory address of another person; counterfeit or fraudulent use of certificates, licenses, numbers, certification marks and other Quality mark.
Article 15 engaged in the supervision of feed product quality departments and their staff unauthorized inspection of the quality of feed products, the quality of feed products to repeat the inspection, the competent department shall order correction, give notice of criticism, the circumstances are serious, to give directly responsible for the supervisor and other personnel directly responsible for the administrative sanctions; to the parties concerned to cause losses, shall be compensated according to law. Engaged in the supervision and management of feed product quality staff, abuse of power, dereliction of duty, favoritism, harboring violations of the competent authorities to give administrative sanctions, constitutes a crime, shall be investigated for criminal responsibility.
