chapter I general provisions article 1 these regulations are formulated in accordance with the law of the people's Republic of China on the prevention and control of environmental pollution by solid waste, the regulations of the State Council municipality on the administration of city appearance and environmental sanitation, and in combination with the actual situation of this municipality, in order to protect people's health, maintain the city appearance and environmental sanitation, strengthen the management of kitchen waste and promote the harmless treatment and recycling of kitchen waste. Article 2 These Regulations shall apply to the collection, transportation, disposal and related management activities of kitchen waste within this Municipality. Article 3 The term "kitchen waste" as mentioned in these Regulations refers to food residues, food processing wastes and discarded edible oils and fats produced in activities such as food processing, food service and unit feeding, except the daily life of residents.

County (district, city) people's government is responsible for the management of city appearance and environmental sanitation (hereinafter referred to as the county (district, city) department in charge of kitchen waste), and carries out daily supervision over the treatment of kitchen waste in this area, and accepts the guidance and supervision of the municipal administrative department of urban management.

Article 7 Encourage, support and guide the scientific research and technological improvement on the treatment of kitchen waste, promote the harmless treatment and resource utilization of kitchen waste, advocate civilized catering methods, and reduce the output of kitchen waste. Eighth city and county (district, city) department in charge of kitchen waste shall establish a reporting system, and accept the public's report on the illegal activities of collection, transportation and disposal of kitchen waste. Chapter II Collection, Transportation and Disposal of Kitchen Waste Article 9 The collection, transportation and disposal of kitchen waste shall be franchised. Without permission, no unit or individual may engage in the collection, transportation and disposal of kitchen waste. Article 11 An applicant who applies for the franchise of the collection and transportation of kitchen waste shall meet the following conditions:
(1) The applicant is an enterprise legal person registered according to law with a registered capital of not less than RMB 3 million;
(2) having a fully enclosed special collection container with classified collection function;
(3) There are more than ten special vehicles for transporting kitchen waste with the functions of preventing odor from spreading, spilling and dripping;
(4) having a fixed office and parking place for machinery, equipment and vehicles;
(5) Other conditions stipulated by laws and regulations. Article 11 An applicant who applies for the franchise of kitchen waste disposal shall meet the following conditions:
(1) The applicant is an enterprise legal person registered according to law with a registered capital of not less than 21 million yuan;
(2) The location of kitchen waste treatment facilities conforms to urban and rural planning, and planning permission documents have been obtained;
(3) The daily processing capacity is not less than 111 tons;
(4) having at least five personnel with professional titles above junior level, including technical personnel in environmental engineering, machinery and food safety;
(5) having perfect facilities for treating pollutants such as waste water, waste gas and waste residue, and establishing relevant systems such as normal operation of pollutant treatment facilities and discharge of pollutants up to standard;
(6) having an emergency plan to control pollution and emergencies;
(7) Other conditions stipulated by laws, regulations and rules. Article 12 The municipal department in charge of kitchen waste shall make a decision on the license for the collection, transportation and disposal of kitchen waste through bidding, and issue the franchise license for the collection, transportation and disposal of kitchen waste to the winning enterprise.
the municipal department in charge of kitchen waste shall sign a franchise agreement for the collection, transportation and disposal of kitchen waste with the winning bidder, and clearly stipulate the operating period, business scope, service standards, termination and change of franchise rights, liability for breach of contract, etc. Article 13 Newly-established food processing enterprises, catering enterprises, unit canteens and other kitchen waste generating units shall sign an agreement on the collection and transportation of kitchen waste with the enterprises that have obtained the franchise rights for the collection and transportation of kitchen waste before handling the environmental impact assessment and catering service license. If no agreement is signed, the environmental protection department shall not pass the environmental impact assessment, and the food and drug supervision and administration department shall not apply for the catering service license. Before the implementation of this Ordinance, the kitchen waste generating unit that has obtained the relevant license has not signed an agreement on the collection and transportation of kitchen waste, and the environmental protection department shall not handle the annual inspection of the sewage discharge permit.
an enterprise that has obtained the franchise right for the collection and transportation of kitchen waste shall file the signed agreement for the collection and transportation of kitchen waste with the municipal department in charge of kitchen waste every quarter. Article 14 A kitchen waste generating unit shall abide by the following provisions:
(1) Establish a kitchen waste disposal account, indicating the type, quantity and flow direction of kitchen waste;
(2) Set up clearly marked kitchen waste collection containers, and keep them intact, airtight and clean;
(3) install pollution prevention facilities such as oil separator and slag separator and keep them in normal use;
(4) kitchen waste and non-kitchen waste should be collected separately, and food residues, food processing wastes and waste edible oils should be collected separately.
