Measures of Lianyungang Municipality on the Administration of Kitchen Wastes

chapter I general provisions article 1 in order to strengthen the management of kitchen waste, promote the harmless treatment and resource utilization of kitchen waste, maintain the city appearance and environmental sanitation, and ensure food safety and people's health, these measures are formulated in accordance with the law of the people's Republic of China on the prevention and control of environmental pollution by solid waste, the measures for the management of urban domestic waste, the measures for the management of kitchen waste in Jiangsu province and other relevant provisions, and in combination with the actual situation of this municipality. Article 2 These Measures shall apply to the generation, collection, transportation, disposal and related supervision and management activities of kitchen waste within the administrative area of this Municipality. Article 3 The term "kitchen waste" as mentioned in these Measures refers to food residue and waste edible oil and other wastes generated in food processing, catering service, collective feeding and other activities other than residents' daily life.

the waste edible oils and fats mentioned in the preceding paragraph refer to hogwash fat, gutter oil, other inedible animal and vegetable oils and various oil-water mixtures. Article 4 The treatment of kitchen waste in this Municipality follows the principles of reduction, harmlessness and recycling, and implements the integrated operation mode of collection, transportation and disposal. Article 5 The competent department of city appearance and environmental sanitation of the Municipal People's Government shall be responsible for the supervision and management of kitchen waste in this Municipality.

the county and district people's governments shall lead the management of kitchen waste in their respective administrative areas. The competent department of city appearance and environmental sanitation of the county and district people's governments shall be specifically responsible for the daily supervision and management of kitchen waste within their respective jurisdictions.

the township (town) people's government and sub-district offices are responsible for the management of kitchen waste within their respective jurisdictions according to the division of responsibilities. Article 6 The catering trade association shall play the role of industry self-discipline, standardize industry behavior, participate in the formulation of relevant standards, bring the standardization, standardized classified storage and treatment of kitchen waste into the scope of rating and integrity management of catering enterprises, and urge catering enterprises to do a good job in the harmless disposal of kitchen waste. Article 7 The collection, transportation and disposal expenses of kitchen waste shall be charged in the municipal solid waste treatment fee, and the insufficient part shall be appropriately subsidized by the municipal and county (District) people's governments according to their respective scope of commitment, and shall be included in the financial budget of the government at the same level. The specific measures shall be formulated separately by the competent department of city appearance and environmental sanitation in conjunction with the relevant departments such as finance and submitted to the people's government at the same level for approval. Eighth all units and individuals have the right to complain and report acts in violation of the provisions of these measures.

the competent department of city appearance and environmental sanitation shall establish and improve the complaint reporting system for the management of kitchen waste, publicize the complaint reporting channels, investigate and deal with illegal acts of kitchen waste in a timely manner according to law, and commend and reward those found to be true. Chapter II Planning and Facilities Construction Article 9 The municipal and county (district) competent department of city appearance and environmental sanitation shall, jointly with relevant departments, formulate a plan for the treatment of kitchen waste, which shall be incorporated into the special plan of city appearance and environmental sanitation, and make overall arrangements for the layout, land use and scale of kitchen waste collection, transportation and disposal facilities. Article 11 The land for kitchen waste disposal facilities shall be incorporated into urban and rural planning as the land for environmental sanitation facilities, and no unit or individual may occupy or change its use without authorization. Eleventh kitchen waste disposal facilities construction projects, should comply with the kitchen waste treatment planning and relevant national technical standards.

after the completion of a construction project, the construction unit shall organize the completion acceptance according to law, and those that have not passed the acceptance or are unqualified shall not be delivered for use. Chapter III Declaration, Collection, Transportation and Disposal of Kitchen Wastes Article 12 The collection, transportation and disposal of kitchen wastes in this Municipality shall be franchised.

the competent department of city appearance and environmental sanitation of the people's government of the city or county shall determine the collection, transportation and disposal units of kitchen waste through fair competition such as public bidding, sign a franchise agreement with the winning bidder, issue a service license, and announce it to the public.

the franchise agreement for kitchen waste shall clearly stipulate the operating period, service standards, liability for breach of contract, etc., and be an annex to the service license for collection, transportation and disposal of kitchen waste.

without permission, no unit or individual may engage in the collection, transportation and disposal of kitchen waste. Thirteenth units engaged in the collection, transportation and disposal of kitchen waste shall meet the conditions stipulated by laws, regulations and rules. Article 14 The kitchen waste producing unit shall sign an agreement with the unit that has obtained the service license of kitchen waste collection and transportation, and report it to the county (district) city appearance and environmental sanitation department for the record.

the kitchen waste producing unit shall take the initiative to show the agreement when handling the relevant registration or administrative license with the environmental protection, food and drug supervision and other departments. Article 15 The newly established kitchen waste generating unit shall, within 11 days from the first generation of kitchen waste, report the generation of kitchen waste to the county (district) city appearance and environmental sanitation department.

when the business premises of the kitchen waste generating unit change or the amount of kitchen waste changes greatly, it shall promptly report to the county (district) city appearance and environmental sanitation department. Article 16 kitchen waste generating units shall abide by the following provisions:

(1) Separate kitchen waste and non-kitchen waste, store them separately, and set up pollution prevention facilities such as oil-water separators or grease traps in accordance with the relevant provisions of environmental protection;

(2) The kitchen waste shall not be stored naked;

(3) It is not allowed to mix kitchen waste with other wastes or mix kitchen waste with other discarded objects;

(4) Place kitchen waste collection containers according to the designation of the competent department of city appearance and environmental sanitation, ensure that the kitchen waste collection containers and pollution prevention facilities are intact, sealed and tidy, and keep the surrounding environment clean and tidy;

(5) hand over the kitchen waste to the kitchen waste collection and transportation unit that has signed an agreement with it within 24 hours after the kitchen waste is generated;

(6) kitchen waste shall not be handed over to units or individuals that have not obtained service licenses for collection, transportation and disposal;

(7) kitchen waste shall not be discharged into rainwater pipes, sewage pipes, rivers, lakes, ditches and public toilets;

(8) other acts prohibited by laws, regulations and rules.
