Chapter I General Provisions Article 1 These Regulations are formulated in accordance with People's Republic of China (PRC) Environmental Protection Law, People's Republic of China (PRC) Air Pollution Prevention Law, Hunan Environmental Protection Regulations, Hunan Air Pollution Prevention Regulations and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the prevention and control of dust pollution and its supervision and management activities within the administrative area of this Municipality. Article 3 The term "dust pollution" as mentioned in these Regulations refers to the atmospheric pollution caused by building construction, demolition of buildings (structures), transportation and stacking of materials, exploitation of mineral resources, production of ready-mixed concrete and ready-mixed mortar, river regulation, stone and building materials processing, public places and road cleaning, greening construction and other activities, as well as particulate matter generated from bare ground. Article 4 The prevention and control of dust pollution shall adhere to the principles of government leading, departmental supervision, public participation and liability for damage, and implement source control, combination of prevention and control and comprehensive management. Fifth people's governments at all levels and relevant departments and units should strengthen the publicity and education of laws and regulations on the prevention and control of dust pollution, and raise the awareness of the whole society to participate in the prevention and control of dust pollution.

The news media should strengthen the public welfare propaganda of dust pollution prevention and control, and supervise the work of dust pollution prevention and control by public opinion. Article 6 Citizens, legal persons and other organizations have the right to participate in and supervise the prevention and control of dust pollution, complain and report dust pollution, and have the obligation to prevent and control dust pollution. Chapter II Responsibility for Prevention and Control Article 7 The people's governments of cities and counties (cities, districts) shall be responsible for the prevention and control of dust pollution within their respective administrative areas, organize the formulation of special plans for dust pollution prevention and control, and establish an assessment mechanism for dust pollution prevention and control.

The Municipal People's Government shall organize the formulation of the master plan for the prevention and control of dust pollution, and the county (city, district) people's government shall formulate specific implementation plans according to the master plan for the prevention and control of dust pollution, and organize the implementation.

Township people's governments and sub-district offices shall implement the specific implementation plan for the prevention and control of dust pollution formulated by the county (city, district) people's governments, and organize the prevention and control of dust pollution according to their duties. Article 8 The competent department of ecological environment shall exercise unified supervision and management over the prevention and control of dust pollution, organize dust pollution monitoring, identify and announce key dust pollution sources, coordinate and urge relevant departments to perform their management duties, and supervise and manage the prevention and control of dust pollution such as landfill sites, disposal sites, material storage yards, ore mining, stone and building materials processing.

The comprehensive law enforcement department in charge of urban management is responsible for the supervision and management of the prevention and control of dust pollution such as municipal public facilities, maintenance of urban roads and underground pipelines, city appearance and environmental sanitation operations, landscaping projects, demolition of illegal buildings, soil taking (abandonment) operations, collection and transportation of urban construction waste and urban domestic waste.

The competent department of housing and urban and rural construction is responsible for the supervision and management of the prevention and control of dust pollution in the construction of building projects, the demolition of buildings and the production of ready-mixed concrete and ready-mixed mortar.

The competent department of transportation is responsible for the supervision and management of the prevention and control of dust pollution such as highway and waterway engineering construction, highway management and maintenance, and the operation of highway and waterway transportation stations and yards.

The water conservancy department is responsible for the supervision and management of the prevention and control of dust pollution such as river regulation, water conservancy project construction and river sand mining.

Natural resources and planning, public security, agriculture and rural areas, forestry and other departments responsible for the prevention and control of dust pollution shall supervise and manage the prevention and control of dust pollution within their respective responsibilities. Ninth villagers' committees and residents' committees shall assist in the prevention and control of dust pollution. Found illegal acts of dust pollution, should be discouraged, and promptly report to the Township People's government, street offices or departments responsible for dust pollution prevention and control. Tenth construction units shall take the following measures to prevent dust pollution:

(a) dust pollution prevention and control costs as uncompetitive costs into the project cost, paid separately, and in the construction contract, the payment plan for dust pollution prevention and control is clearly defined, and paid in full and on time;

(two) environmental impact assessment in accordance with the law, in the construction project environmental impact assessment documents, it should include the evaluation content and prevention measures of dust pollution;

(three) the bid documents require bidders to formulate measures to prevent and control dust pollution on the construction site and incorporate them into the bid evaluation content;

(four) the responsibility of the construction unit for the prevention and control of dust pollution shall be included in the construction contract, and the construction unit shall be supervised to implement the measures for the prevention and control of dust pollution in accordance with the contract;

(five) the content of dust pollution prevention and control into the project supervision contract, and supervise the supervision unit to fulfill the supervision obligation of dust pollution prevention and control in accordance with the contract. Eleventh construction units shall take the following measures to prevent dust pollution:

(a) the cost of dust pollution prevention and control shall be earmarked and shall not be used for other purposes;

(two) the implementation of dust pollution prevention measures, undertake the main responsibility of dust pollution prevention during construction;

(three) to formulate specific implementation plans for the prevention and control of dust pollution, and report them to the relevant supervision and management departments for the record;

(4) Set up a bulletin board at the project site to announce information such as dust pollution prevention measures, construction site leaders, environmental supervisors, dust pollution prevention and control supervision and management departments, telephone numbers, etc., and accept social supervision;

(five) according to the warning level of heavy pollution weather and the requirements of emergency plan, the corresponding emergency measures for the prevention and control of dust pollution are implemented.
