The waste edible oils and fats mentioned in the preceding paragraph include edible animal and vegetable oils and various oil-water mixtures. Article 3 These Regulations shall apply to the generation, collection, transportation, disposal and related management activities of kitchen waste within the urban area of this Municipality. Article 4 The treatment of kitchen waste shall follow the principles of reduction, harmlessness, recycling and whoever produces it shall be responsible. Implement unified collection and transportation and centralized fixed-point disposal.
It is advocated to reduce the amount of kitchen waste by listing clean vegetables, improving processing technology and civilized dining. Article 5 The municipal administrative department of city appearance and environmental sanitation (hereinafter referred to as the municipal competent department) shall be responsible for the supervision and management of the collection, transportation and treatment of urban kitchen waste within the administrative area of this Municipality.
The district city appearance and environmental sanitation management department (hereinafter referred to as the district competent department) is specifically responsible for the supervision and management of the collection, transportation and treatment of kitchen waste within its administrative area.
Environmental protection, food and drug supervision, quality supervision, health and family planning, industry and commerce, development and reform, agriculture and animal husbandry, commerce, public security, transportation and other departments shall, according to their respective functions and duties, do a good job in the supervision and management of kitchen waste. Article 6 The collection, transportation and disposal of kitchen waste shall be provided with paid services, and the kitchen waste generating unit shall pay the kitchen waste disposal fee according to the regulations. Specific standards and measures shall be formulated separately by the municipal competent department in conjunction with the price and financial departments in accordance with the relevant provisions of the state, and shall be implemented after being approved by the people's government.
The kitchen waste treatment fee shall be earmarked for the collection, transportation and disposal of kitchen waste, and it is strictly prohibited to use it for other purposes. Article 7 The chief executive is responsible for the management of kitchen waste, and the municipal and district people's governments shall strengthen the unified leadership over the management of kitchen waste, and increase the capital investment in the management of kitchen waste year by year according to the national economic and social development plan to ensure the reduction, harmlessness and resource utilization of the management. The specific measures shall be formulated separately by the municipal competent department in conjunction with the administrative departments of development and reform, finance, water affairs and environmental protection at the same level, and shall be implemented after being approved by the Municipal People's Government. Eighth any unit or individual has the right to report violations of these regulations.
The municipal and district competent departments shall establish a complaint reporting system, accept complaints and reports from the public about the illegal activities of kitchen waste generation, collection, transportation and disposal, and keep the complainant or informant confidential. After accepting a complaint or report, the municipal or district competent department shall promptly go to the site for inspection and handling, and inform the complainant or informant of the handling result within fifteen working days after accepting the complaint or report. Chapter II Governance Planning and Facilities Construction Article 9 The municipal competent department shall, jointly with relevant departments, formulate a governance plan for kitchen waste and make overall arrangements for the layout, land use and scale of kitchen waste collection and disposal facilities in accordance with the overall urban planning and national economic and social development planning of this Municipality.
To formulate a plan for the treatment of kitchen waste, public opinions should be widely solicited. Article 10 The land for kitchen waste disposal facilities shall be included in the scope of urban yellow line protection, and no unit or individual may occupy or change its use without authorization. Article 11 The construction of kitchen waste collection, transportation and disposal facilities shall conform to the kitchen waste management planning and relevant national technical standards. Chapter III Generation, Collection and Transportation of Kitchen Wastes Article 12 A kitchen waste generating unit shall pre-declare to the local competent department in the first half of every year, record the basic situation of kitchen waste generation, and obtain a receipt.
The newly established kitchen waste generating unit shall, within 10 days from the date of kitchen waste generation, pre-declare to the local competent department and record the basic situation of kitchen waste generation, and obtain a receipt.
When handling the pre-declaration and filing of kitchen waste generation, a copy of the contract signed by the kitchen waste generation unit and the enterprise engaged in the collection and transportation service of kitchen waste shall be taken as the attachment for filing.
The district competent department shall promptly notify the departments of industry and commerce, food and drug supervision, commerce and other departments at the same level about the filing of kitchen waste. Thirteenth kitchen waste generating units shall comply with the following provisions:
(a) set up a standard kitchen waste collection container;
(two) kitchen waste should be collected and stored separately, and pollution prevention facilities such as oil-water separator or grease trap should be set up in accordance with the relevant provisions of environmental protection;
(3) Collection containers and facilities shall be kept intact, closed and clean, and the surrounding environment shall be kept clean and tidy;
(four) within the specified time by the kitchen waste collection and transportation service enterprises in accordance with the provisions of this Ordinance. Fourteenth kitchen waste generating units, prohibit the following acts:
(a) Open storage of kitchen waste;
(2) Mixing kitchen waste with other municipal domestic waste for transportation and treatment, or mixing other domestic waste with kitchen waste for collection;
(3) Discharging kitchen waste into rainwater pipes, sewage drainage pipes, rivers, ditches and public toilets;
(four) the kitchen waste is collected and transported by units and individuals that do not meet the provisions of these regulations;
(five) other acts as prescribed by laws and regulations.
