Article 3:
Taiwanese investors may invest in the mainland's industrial, agricultural, and service industries, as well as in other industries that are consistent with the direction of social and economic development. Taiwan investors may choose their investment projects from those announced by the relevant departments of each local people's government.
They may also put forward their own intentions for investment projects and apply to the foreign economic and trade departments of the regions where they intend to invest or to the examination and approval authorities designated by the local people's governments. The State encourages Taiwan investors to invest in the organization of product export enterprises and advanced technology enterprises, and gives corresponding preferential treatment.
Article 4
Taiwanese investors investing in the mainland to organize enterprises, joint ventures and cooperative ventures with full capital (hereinafter collectively referred to as enterprises invested by Taiwan compatriots) shall, in addition to the application of the present Provisions, refer to the implementation of the State's relevant laws and regulations on foreign-related economy, and enjoy the corresponding treatment for foreign-invested enterprises.
Taiwanese investors who make other forms of investment in the mainland, as well as those who do not set up business establishments in the mainland but have dividends, interests, rents, royalties and other income originating in the mainland, may also refer to the implementation of the State's relevant foreign-related economic laws and regulations, except for the application of the present Provisions.
Article 10:
Taiwanese-invested enterprises shall be exempted from the payment of import tariffs, unified industrial and commercial taxes, and import licenses for the importation of machinery and equipment, vehicles for production and office equipment required by the enterprise, as well as a reasonable number of daily necessities and means of transportation brought in by individual Taiwan compatriots for their own use during the period of work of the enterprise within the total amount of their investment.
Taiwanese investment enterprises shall be exempted from paying import tariffs, unified industrial and commercial taxes and obtaining import licenses for the import of raw materials, fuels, bulk parts, spare parts, components and ancillary parts used in the production of export products, which shall be supervised by the Customs. The above imported materials, such as products for sale in the mainland, should be in accordance with national regulations to supplement the import procedures, and the tax accordingly.
Taiwanese-invested enterprises are exempted from the payment of export tariffs and the unified industrial and commercial tax on exported products, except for those restricted by the State.
