Beijing's prepaid card consumption problems have a "tightrope".

"Overbearing terms" are invalid

On June 1, the Regulations came into force, and the new rules regulate the issuance of single-use prepaid cards by regulated operators and the safety of prepaid funds.

The information shows that the single-purpose prepaid card (hereinafter referred to as "prepaid card") refers to the operator to pre-receive funds issued for consumers, for consumers to agree only in the scope of the operator and its cooperation, can be redeemed in a number of goods or services of the physical or virtual vouchers. Among them, physical vouchers include magnetic stripe cards, chip cards, paper coupons and other carriers; virtual vouchers include passwords, serial codes, graphics, biometric information and other agreed information and other carriers.

The Regulations stipulate that consumers who have not redeemed goods or services within 7 days from the date of purchase of the prepaid card have the right to request the operator to return the card. At the same time, the operator shall return the full amount of the advance payment within 5 days from the date of the consumer's request for the return of the card.

Preventing operators from "rolling money and running away"

Overall, the current commercial prepaid card is divided into two categories: one is a franchised card issuer issued by the multi-purpose prepaid card that can be used across regions, industries, and legal entities; the other is a commercial enterprise issued by a company that only uses the same brand of chain store in its own enterprise or the same brand of chain store. The other is issued by commercial enterprises, only in the enterprise or the same brand chain of enterprises to pay for goods, services, single-purpose prepaid cards.

In recent years, the application of single-purpose prepaid cards has become more and more extensive, involving various aspects such as education and training, commercial retailing, culture and entertainment, beauty salon, accommodation and catering, sports and fitness, etc., which has played a positive role in facilitating payment and promoting consumption. However, with the growing volume of card issuance, violations of the legitimate rights and interests of consumers also occur frequently.

Statistics show that in 2020, Beijing single-use prepaid card consumer complaints *** counted 170,000 cases. Among them, 120,000 cases in the field of education and training, the number of complaints is 10 times that of 2019; 50,000 cases in sports, fitness, beauty salon and other industries, the number of complaints is 6 times that of 2019.

In addition, in order to prevent merchants from running away with their money. The Regulations put forward into the depository management of the operator should be in the depository bank to open a prepaid card pre-received funds dedicated depository account, will meet the prescribed requirements of the pre-received funds deposited into the dedicated depository account and in accordance with the provisions of the way to withdraw. According to the regulations should be filed or funds depository operators should be from the date of implementation of the regulations within ninety days to complete the filing or funds depository.

Wang Pengbo believes that the "Regulations" for the management of funds is the highlight of the relevant provisions. Specifically, "prepaid funds" have a depository bank and the establishment of prepaid card pre-received funds depository system can ensure the safety of consumer funds, to prevent the operator "rolled money to run". But the depository bank specific how to access, depository service specification and other related rules remain to be seen.
