The registration, content review, supervision and management of outdoor advertisements shall be implemented in accordance with the Advertising Law of People's Republic of China (PRC) and relevant laws and regulations. Article 3 The term "outdoor advertising" as mentioned in these Measures refers to the following outdoor commercial advertisements in which commodity producers, operators or service providers directly or indirectly introduce the commodities they sell or provide services through certain media and forms, and bear the expenses:
(a) the use of outdoor advertising facilities to publish advertisements;
(two) the use of colored flags and banners in outdoor advertising;
(three) the use of wall advertising;
(four) advertisements published by vehicles, boats and other means of transportation;
(5) Advertisements issued by using airship, balloon and other lift-off tools;
(six) other outdoor advertisements.
The term "outdoor advertising facilities" as mentioned in these Measures refers to material carriers such as light boxes, neon lights, electronic display screens (cards), electronic copiers, windows and advertising racks. , set up to advertise outdoors. Fourth city management department is responsible for the supervision, management and comprehensive coordination of outdoor advertising in the city; District urban management department is responsible for the supervision and management of outdoor advertising in this area in accordance with the management authority.
The competent department of urban and rural planning is responsible for the supervision and management of outdoor advertising planning.
Industry and commerce and other relevant departments shall be responsible for the supervision and management of outdoor advertising according to their respective responsibilities. Fifth outdoor advertising should follow the principles of unified planning, rational layout, beauty, firmness and safety. Article 6 The municipal urban management department shall, jointly with the urban and rural planning, industry and commerce, landscaping, housing management, environmental protection, public security, transportation and other relevant departments, formulate a plan for setting up outdoor advertising facilities in this Municipality, which shall be promulgated and implemented after being approved by the Municipal People's Government.
The planning of outdoor advertising facilities shall include the conditions, location, type, scale, specifications and effective period of outdoor advertising facilities.
The municipal urban management department shall, according to the planning of outdoor advertising facilities and the standards of urban appearance, prepare the technical specifications for outdoor advertising facilities.
All units and individuals shall abide by the planning and technical specifications of outdoor advertising facilities. Seventh city management departments should listen to opinions when preparing outdoor advertising facilities planning and technical specifications. Eighth outdoor advertising settings, should comply with the outdoor advertising facilities planning and technical specifications.
In any of the following circumstances, outdoor advertising shall not be set up:
(a) the use of traffic safety facilities, traffic signs, residential;
(two) affect the use of municipal public facilities, traffic safety facilities and traffic signs;
(three) hinder production or life, damage the appearance of the city;
(four) the construction control zone of state organs, cultural relics protection units and scenic spots;
(five) the Municipal People's Government prohibits the establishment of outdoor advertising areas. Ninth outdoor advertising facilities or the right to use the facilities can be obtained through public bidding, auction, agreement and other means. Among them, the right to use public places and public facilities of outdoor advertising facilities shall be obtained through bidding, auction or other open competition. The scope of public places and public facilities and the specific measures for bidding and auction shall be formulated separately by the Municipal People's Government. Tenth the establishment of outdoor advertising facilities shall go through the relevant examination and approval procedures such as planning according to law, and shall be handled according to law.
The right to use public * * * venues and public * * * facilities that meet the provisions of Article 9 of these Measures shall be deemed to have gone through the relevant examination and approval procedures such as planning. Eleventh outdoor advertising facilities set in public places or public facilities, its service life shall not exceed 5 years. If it is necessary to extend the time limit for setting, the setter shall go through the extension formalities at the original examination and approval authority 30 days before the expiration of the time limit for setting.
Temporary outdoor advertising facilities set up for holding large-scale cultural, sports, public welfare activities or holding various commodity fairs, trade fairs and other activities shall be dismantled within two days after the end of the activities. Twelfth large-scale outdoor advertising, the setting should apply to the competent department of city management, and submit the following materials:
(1) an application;
(2) Proof of the right to use outdoor advertising location;
(three) outdoor advertising location map and effect map;
(four) structural design drawings, construction instructions and architectural drawings issued by professional design institutions with corresponding qualifications;
(five) other materials as prescribed by laws, regulations and rules.
The municipal urban management department shall, within 3 working days from the date of acceptance, make a written decision on whether to approve or not, and issue an outdoor advertising license; If the license is not granted, the reasons shall be explained in writing. Among them, if large outdoor advertisements are set up in important places and on both sides of main roads, the municipal urban management department shall make a decision after reporting to the Municipal People's Government for approval. No unit or individual may forge, alter, lease, lend, resell or illegally transfer the outdoor advertising license in other forms.
The standards for large-scale outdoor advertisements shall be determined by the municipal competent department of urban management and announced to the public.
