Article 2 These Measures shall apply to the protection and management, supervision and inspection, administrative law enforcement and other activities of unused land within the administrative area of this Municipality.

the term "unused land" as mentioned in these measures refers to the unused land such as bare land, bare rock gravel land, sandy land, marshland, saline-alkali land, inland beaches and other grasslands determined by the national land use status survey and the annual land use status change survey. Article 5 The administrative department of natural resources of the people's governments of cities and counties (districts) is the competent department for the protection and management of unused land, and is responsible for the protection, management, supervision and inspection of unused land within the administrative area at the corresponding level.

Article 6 All units and individuals shall abide by the laws, regulations and rules on the management of unused land, and have the right to supervise and report violations of the laws, regulations and rules on the management of unused land. Article 7 To protect the unused land according to law, the following acts are prohibited: (1) buying and selling without authorization or illegally transferring the unused land by other means;

(2) building buildings and structures on unused land without authorization and occupying unused construction;

(3) Reclaiming unused land without authorization;

(4) mining, quarrying, dredging and taking soil from unused land without authorization;

(5) Dumping, piling up, discarding, scattering and discharging pollutants such as industrial solid waste, sewage and hazardous waste on unused land without authorization;

(6) Dumping, scattering and piling up construction waste and domestic waste on unused land without authorization;

(7) Dumping, scattering and piling up agricultural production wastes on unused land without authorization;

(8) other acts prohibited by laws, regulations and rules. Article 8 Whoever, in violation of the provisions of these measures, buys or sells unused land without authorization or illegally transfers unused land in other forms shall be dealt with according to law by the administrative department of natural resources of the municipal or county people's government in accordance with the Law of the People's Republic of China on Land and Land Administration, the Regulations for the Implementation of the Law of the People's Republic of China on Land and Land Administration and other relevant laws, regulations and rules. Article 9 Whoever, in violation of the provisions of these measures, arbitrarily builds buildings and structures on unused land and occupies unused land for construction shall be dealt with according to law by the competent department of urban and rural planning of the county (District) people's government or the people's government of a township (town) in accordance with the Urban and Rural Planning Law of the People's Republic of China and other relevant laws, regulations and rules. Tenth in violation of the provisions of these measures, unauthorized reclamation of unused land, by the administrative department of natural resources of the people's government of the city or county in accordance with the "people's Republic of China and land management law" and other relevant laws, regulations and rules, according to the law. Article 12 Whoever, in violation of the provisions of these measures, dumps, piles up, discards, scatters or discharges pollutants such as industrial solid waste, sewage and hazardous waste on unused land without authorization shall be dealt with according to the relevant laws, regulations and rules of the Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste and the Law of the People's Republic of China on the Prevention and Control of Soil Pollution. Article 13 Whoever, in violation of the provisions of these measures, dumps, scatters or piles up construction waste and domestic waste on unused land without authorization shall be dealt with according to law by the competent department of city appearance and environmental sanitation of the county (district) people's government in accordance with the Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste and other relevant laws, regulations and rules. Article 14 Whoever, in violation of the provisions of these measures, dumps, scatters or piles agricultural production wastes on unused land without authorization shall be dealt with according to law by the competent agricultural and rural departments of the county (District) people's government in accordance with the relevant provisions of the Law of the People's Republic of China on the Prevention and Control of Soil Pollution. Article 15 The relevant departments and units of the people's governments of cities and counties (districts) and the people's governments of townships (towns) shall, in the protection and management of unused land, promptly notify in writing or hand it over to the relevant departments and units for investigation, and if it is necessary to enforce it, hand it over to the people's governments of counties (districts) for organization and implementation.
