Notice on further implementing the labor security policy for some retired soldiers
The labor and social security departments (bureaus), civil affairs departments (bureaus) and finance departments (bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government, the Labor and Social Security Bureau of Xinjiang Construction Corps, the Civil Affairs Bureau, the Finance Bureau: the Ministry of Labor and Social Security, the Ministry of Civil Affairs, the Ministry of Finance and other departments jointly issued the Notice on Seriously Doing a Good Job in the Employment, Re-employment and Social Security of Demobilized Military Cadres (issued by the Ministry of Labor [2005]1.
The first is to further implement the labor security policy for some retired military personnel.
(A) the implementation of re-employment support policies
For some unemployed ex-servicemen who have the desire to re-employment, they should apply for a re-employment concession card and enjoy the corresponding re-employment support policies with their retirement certificates and ID cards to apply for job registration in the labor and social security department, which meets the requirements stipulated in the Notice of the State Council on Further Strengthening Employment and Re-employment (Guo Fa [2005] No.36).
(two) to solve the problem of basic old-age insurance.
1, some retired soldiers and demobilized military cadres are not insured, but they can go through the registration formalities at the local social security agencies where the government is effective. The former length of military service can be regarded as the payment period, and those who have reached the statutory retirement age and the payment period (including length of military service with the same payment period) 15 can enjoy the basic old-age insurance benefits on a monthly basis. For those who have gone through the registration formalities in length of military service and paid fees according to regulations, the actual payment period will be combined with the original length of military service to calculate the payment period.
2. Some ex-servicemen and demobilized military cadres who are unemployed, retain the old-age insurance relationship in the social insurance agency of the insured place, reach the statutory retirement age and the payment period (including length of military service as the payment period) is full 15 years, and can enjoy the basic old-age insurance benefits on a monthly basis. Do not pay old-age insurance premiums during the period of receiving unemployment insurance benefits.
3. For some retired soldiers and demobilized military cadres who have not terminated their labor relations with enterprises, individuals are required to pay fees, and it is indeed difficult for enterprises to pay fees. However, the enterprises where retired soldiers work can negotiate with local social insurance agencies and sign deferred payment or overdue payment agreements, so that they can participate in the insurance and continue the basic old-age insurance relationship.
4. For some retired soldiers and demobilized military cadres who continue to participate in insurance payment and re-employment, social insurance agencies should promptly accept and do a good job in the connection of basic old-age insurance.
(3) Solving the problem of basic medical insurance.
According to the Regulations on Unemployment Insurance, people who participate in unemployment insurance can enjoy Medicaid in accordance with the regulations during the period of receiving unemployment insurance benefits. Retired soldiers and demobilized military cadres who do not meet the conditions for receiving unemployment insurance benefits and receive unemployment insurance benefits at the expiration of the period can participate in medical insurance in accordance with the relevant policies for flexible employment, continue the medical insurance relationship, and enjoy corresponding medical insurance benefits in accordance with regulations. Their length of military service is regarded as the payment period. Local governments should urge enterprises and individuals to pay insurance premiums for retired soldiers and demobilized military cadres who have not terminated their labor relations with enterprises. For enterprises with real difficulties, all localities should raise funds through multiple channels to help their enterprises participate in medical insurance. Retired soldiers and demobilized military cadres who are unable to participate in medical insurance and have a heavy burden of personal medical expenses after participating in medical insurance should be included in the scope of medical assistance according to regulations to ensure their basic medical treatment.
Other personnel who joined the army after Enterprise 1 954165438+1October1and took part in military actions against the enemy by force to resist foreign aggression, complete the reunification of the motherland, defend the territorial and sovereign integrity of the country and safeguard national security. So far, according to the Ministry of Labor [2008], those who have retired from the army (referring to those who have participated in the war) and those who have seen nuclear tests,
Second, strengthen departmental coordination and cooperation.
Labor and social security, civil affairs and finance departments at all levels should strictly implement the division of responsibilities defined by the central government to implement relevant policies, further improve the sharing of resources such as information exchange and briefing, and form a coordinated working mechanism.
(a) labor and social security departments at all levels should strengthen communication and cooperation with the local civil affairs departments, do a good job in the civil affairs departments to receive the information of demobilized veterans, and organize special forces to verify. It is necessary to give full play to the role of the street community labor security platform, carry out in-depth investigations, find out the base number, and strive to leave no dead ends. It is necessary to further strengthen employment services and vocational training for retired military personnel, give priority to recommending jobs, and implement various employment and reemployment support policies in accordance with regulations. It is necessary to do a good job in the registration of some retired military personnel in length of military service, accurately verify the deemed payment period, actively preach the policies and regulations of endowment insurance and medical insurance, conscientiously do a good job in the continuation of social insurance relations, and provide convenient and fast services for the insured payment and treatment payment of retired military personnel. It is necessary to correctly publicize the spirit of the two "documents 17" in an appropriate form, so that veterans can understand and master relevant policies and enhance their awareness of employment and insurance.
(2) The Ministry of Civil Affairs, taking the district (county) as the unit, will provide all the information of retired soldiers in this area within the scope of two "17 documents" to the labor and social security departments and financial departments at the same level within the prescribed time limit. If the situation is not clear, the relevant departments should take the initiative to cooperate and verify.

Third, the provincial supervision and inspection
The relevant departments of all provinces (autonomous regions and municipalities directly under the Central Government) should keep track of the work situation in this city and county, and study and solve the situations and problems in the work in a timely manner. According to the progress of local work, we should strengthen supervision and guidance to grassroots departments to ensure that all policies are in place. Outstanding problems encountered in the implementation of policies in various places should be reported in a timely manner. All relevant departments in the State Council should strengthen their work guidance and promptly supervise the implementation of relevant policies.
