Rule number one In order to implement the classified management of environmental impact assessment of construction projects, this catalogue is formulated in accordance with the provisions of Article 16 of the Environmental Impact Assessment Law.
Rule number two According to the degree of environmental impact of construction projects, the state implements classified management of environmental impact assessment of construction projects.
The construction unit shall, in accordance with the provisions of this catalogue, organize the preparation of environmental impact reports, environmental impact reports or fill in environmental impact registration forms respectively.
Rule three. The environmentally sensitive areas mentioned in this catalogue refer to all kinds of natural and cultural protected areas established according to law, as well as areas that are particularly sensitive to some pollution factors or ecological impact factors of construction projects.
Article 4? The sensitive nature and degree of the environment in which the construction project is located is an important basis for determining the environmental impact assessment category of the construction project. Construction projects involving environmentally sensitive areas shall determine their environmental impact assessment categories in strict accordance with this catalogue, and shall not raise or lower the environmental impact assessment categories without authorization. Environmental impact assessment documents should focus on the impact of the project on environmentally sensitive areas.
Article 5? The environmental impact assessment category of cross-industry and compound construction projects shall be determined according to the highest level of individual projects.
Article 6? For construction projects not specified in this catalogue, the environmental impact assessment category is proposed by the provincial environmental protection administrative department according to the characteristics of pollution factors and ecological impact factors of the construction project and the sensitive nature and degree of the environment, and reported to the the State Council environmental protection administrative department for identification.
Article 7? This catalogue shall be interpreted by the competent administrative department of environmental protection of the State Council, and revised and promulgated in due course.
Article 8? This catalogue shall be implemented as of June, 2065438 1 day. The Catalogue for Classified Management of Environmental Impact Assessment of Construction Projects (Order No.2 of the Ministry of Environmental Protection) shall be abolished at the same time.
Extended information The Catalogue of Classified Management of Environmental Impact Assessment of Construction Projects was revised and adopted at the ministerial meeting of the Ministry of Environmental Protection on March 15, 2006. It is hereby promulgated and shall come into force on June 15, 2006. The original Catalogue for Classified Management of Environmental Impact Assessment of Construction Projects (Order No.2 of the Ministry of Environmental Protection) shall be abolished at the same time.
The Classified Management Catalogue for Environmental Protection of Construction Projects was abolished on June 65438+ 10/day, 2008, and was replaced by the Classified Management Catalogue for Environmental Impact Assessment of Construction Projects.
The Catalogue for Classified Management of Environmental Impact Assessment of Construction Projects was deliberated and adopted at the ministerial meeting of the Ministry of Environmental Protection on February 27, 20 16, and is hereby promulgated and shall come into force on September 27, 20 17. The original Catalogue for Classified Management of Environmental Impact Assessment of Construction Projects (Order No.33 of the Ministry of Environmental Protection) issued on April 9, 20 15 shall be abolished at the same time.
