Intermediary service agencies engaged in real estate price appraisal business shall be handled in accordance with relevant state laws and regulations. Article 3 Anyone who engages in real estate intermediary service activities within the administrative area of this Municipality shall abide by these regulations. Article 4 The Municipal Real Estate Management Bureau is the competent authority of this Municipality's real estate intermediary service activities. Counties (cities) and district real estate management bureaus (offices) (hereinafter referred to as local real estate management departments) are responsible for the management of real estate intermediary service activities within their respective administrative areas.
Industry and commerce, land, prices, taxation, public security, labor and other departments shall, according to their respective responsibilities, coordinate in the management of real estate intermediary service activities. Article 5 Engaged in real estate intermediary service activities shall abide by the provisions of laws and regulations and follow the principles of voluntariness, equality, fairness, honesty and credibility; Observe professional ethics. Chapter II Qualification Management of Intermediaries Article 6 A person engaged in real estate consulting business shall have a technical secondary school degree or above in real estate or related majors, have a junior professional title or above in real estate related majors, and have passed the examination by the municipal real estate management department. Article 7 Personnel engaged in real estate brokerage business shall pass the examination of the municipal real estate management department and the municipal administrative department for industry and commerce, and obtain the Qualification Certificate of Ningbo Real Estate Broker issued by the municipal real estate management department and the municipal administrative department for industry and commerce (hereinafter referred to as the Qualification Certificate of Real Estate Broker).
Applicants for the "Real Estate Broker Qualification Certificate" must meet the following conditions:
(a) through the brokerage business knowledge examination;
(2) Having full capacity for civil conduct;
(3) Employees who hold local permanent or temporary residence permits or are legally employed upon approval;
(four) with a high school education or equivalent;
(5) On-the-job staff of non-state organs;
(6) Having not received criminal punishment within three years before the application.
In line with the conditions specified in the preceding paragraph, the municipal real estate management department and the municipal administrative department for industry and commerce shall issue the "Qualification Certificate for Real Estate Brokers" within one month from the date of accepting the application. It is strictly forbidden to forge, alter or transfer the certificate of real estate broker. Article 9 If a person who has obtained a brokerage qualification certificate according to the Regulations on the Administration of Brokers in Zhejiang Province needs to engage in real estate brokerage activities, he shall also apply for a real estate brokerage qualification certificate in accordance with the provisions of Article 7 of these Regulations. Chapter III Administration of Intermediary Service Organizations Article 10 Whoever engages in real estate intermediary service activities shall set up corresponding intermediary service organizations. Intermediary service institutions include legal person intermediary service institutions, partnership intermediary service institutions and individual intermediary service institutions. Eleventh to apply for the establishment of a legal person intermediary service institution (including part-time operation), the following conditions shall be met:
(1) Having its own name and organization;
(2) Having a fixed business place;
(three) engaged in real estate consulting business, the real estate consulting business knowledge assessment qualified full-time consultants accounted for more than fifty percent of the total number of employees; Engaged in real estate brokerage business, there should be more than two professional technicians who are familiar with real estate business and above titles, and more than five full-time real estate brokers who have obtained the "Real Estate Brokerage Qualification Certificate";
(4) The registered capital is more than 100,000 yuan;
(5) Conforming to other relevant provisions on the administration of enterprise legal person registration. Article 12 To apply for the establishment of a partnership intermediary service institution (including part-time operation), two or more partners shall pass the knowledge examination of real estate consulting business or obtain the certificate of real estate brokerage, and meet the relevant provisions on the registration and administration of partnership enterprises. Thirteenth to apply for the establishment of individual intermediary service institutions (including part-time business), the applicant shall pass the examination of real estate consulting business knowledge or obtain the certificate of real estate brokerage, and comply with the relevant provisions on the registration and management of individual industrial and commercial households. Fourteenth the establishment of intermediary service institutions shall apply to the local administrative department for Industry and commerce for a business license before they can start business.
An intermediary service institution shall file with the local real estate management department within one month after receiving the business license. Article 15 Where an intermediary service institution closes its business or terminates its intermediary service activities for other reasons, it shall go through relevant formalities with the administrative department for industry and commerce within 15 days. At the same time, report to the local real estate management department for the record. Chapter IV Management of Intermediary Services Article 16 Intermediary service institutions must engage in intermediary service activities by personnel who have passed the examination of real estate consulting business knowledge or obtained the qualification certificate of real estate brokers.
Those who have passed the knowledge examination of real estate consulting business or obtained the qualification certificate of real estate broker must engage in real estate intermediary service activities in the name of intermediary service institutions.
