Regulations of Chaoyang Municipality on the Administration of Urban Motor Vehicle Parking

chapter I general provisions article 1 in order to strengthen the construction and management of parking facilities, standardize the parking order and improve the road traffic environment, these regulations are formulated in accordance with the law of the people's Republic of China on urban and rural planning, the law of the people's Republic of China on road traffic safety and other laws and regulations, combined with the actual situation of this municipality. Article 2 These Regulations shall apply to the planning, construction and management of parking facilities and the management of motor vehicle parking behavior in the built-up areas of cities where the people's governments are located. Article 3 Parking facilities as mentioned in these Regulations refer to outdoor or indoor places for parking motor vehicles, including public parking lots, special parking lots, road parking berths and related supporting facilities.

the public parking lot refers to the motor vehicle parking place that is built independently according to the plan or with the public building, and is open to the public.

the special parking lot refers to the place where the motor vehicles of the unit and the residential area are parked.

Road parking spaces refer to temporary parking spaces for motor vehicles set up on urban roads according to law.

the term "roads" as mentioned in these regulations refers to highways, urban roads and places where social motor vehicles are allowed to pass, including squares, public parking lots and other places for public access. Article 4 The traffic administrative department of the municipal public security organ shall be responsible for the daily supervision of parking facilities and the management of motor vehicle parking order in the built-up area of the city where the Municipal People's Government is located.

the departments of comprehensive administrative law enforcement of urban management, housing and urban-rural construction management shall, according to their respective responsibilities, do a good job in motor vehicle parking management.

the county people's government is responsible for coordinating and organizing the implementation of the planning, construction, installation, use and parking order management of parking facilities in the urban built-up area where the county people's government is located.

the town (township) people's government and sub-district offices shall assist the relevant administrative departments to do a good job in the management of motor vehicle parking within their respective jurisdictions, and guide neighborhood (village) committees, owners' congresses and owners' committees to carry out motor vehicle parking autonomy. Article 5 The traffic administrative department of the public security organ and the comprehensive administrative law enforcement department of urban management shall establish a platform for accepting complaints and reports, publicize the ways of complaints and reports, handle the complaints and reports of units and individuals on illegal parking, illegal parking operations, unauthorized installation of obstacles, etc. according to law, and make the results public in a timely manner. Chapter II Planning and Construction of Parking Facilities Article 6 The planning and construction of parking facilities shall adhere to the principle of "mainly providing parking facilities, supplemented by off-street parking facilities and supplemented by on-street parking", and focus on areas with prominent contradiction between supply and demand such as old communities, schools, large hospitals and key business areas. Article 7 The comprehensive administrative law enforcement departments of urban management of cities and counties shall, jointly with the traffic management, housing and urban-rural construction management, urban-rural planning, development and reform departments of public security organs at the same level, work out the parking facilities planning according to the national land space planning and urban comprehensive transportation system planning, and in combination with the needs of urban construction and urban road traffic development, and incorporate it into the regulatory detailed planning after being approved by the people's government at the same level.

the planning of parking facilities should comprehensively consider the population size, the number of motor vehicles, the contradiction between parking supply and demand and other factors, and the contents should include the policy orientation and objectives of parking management, the regional layout of parking facilities, the setting scale, the medium and long-term construction plan, the construction sequence and so on. Article 8 The municipal and county housing and urban-rural construction management departments shall, jointly with the traffic management departments of the public security organs at the same level and the comprehensive administrative law enforcement departments of urban management, formulate the annual construction plan of public parking lots in their respective administrative areas according to the parking facilities planning in their respective regions, and organize the implementation after being approved by the people's government at the same level.

the annual construction plan of the public parking lot should include the comprehensive improvement plan for parking in old residential areas, schools, large hospitals, key business areas and other areas where the contradiction between supply and demand is prominent. Ninth Municipal People's Government shall, according to the relevant provisions of the state and province and the planning of parking facilities, distinguish different regions and formulate differentiated standards for the allocation and construction of parking facilities for construction projects.

the standards for the allocation of parking facilities for construction projects should be evaluated every three years according to the urban development and urban traffic changes, and adjusted in time according to the evaluation results. Article 11 Newly-built, rebuilt and expanded public buildings, commercial blocks, residential areas, large (medium) buildings, etc. shall be equipped with and built with parking facilities in accordance with the parking facilities planning and parking facilities allocation standards of construction projects, and shall be designed, constructed, accepted and used synchronously with the main project. Article 11 If the following buildings are not equipped with parking facilities in accordance with the regulations, they shall be supplemented in accordance with the parking facilities planning and the parking facilities allocation standards of construction projects when rebuilding or expanding:

(1) Transportation hubs such as railway stations and passenger stations;

(2) public places such as hospitals, schools, stadiums, tourist attractions and business offices;

(3) large (medium) business places such as shopping malls, hotels, restaurants and entertainment;

(4) office space for administrative affairs.

when parking facilities are built in the above areas and places, three-dimensional parking facilities should be the main ones.

if the parking facilities can't be built up due to objective conditions, they should be built in another place or take other measures to remedy it, and the number of parking spaces should not be lower than the standard of allocation.
