According to the Price Law of the People's Republic of China, the Regulations on Property Management in Zhejiang Province and the Implementation Measures for the Management of Property Service Charges in Zhejiang Province (for Trial Implementation), we have revised the Implementation Rules for the Management Measures for Property Service Charges in Jinhua City (No.23 [2115]) formulated in 2115, and now the revised Jinhua Property,

measures for the implementation of property service charge management in Jinhua city

article 1 in order to standardize the behavior of property service charge in residential quarters, safeguard the legitimate rights and interests of owners and property service enterprises, and promote the healthy development of the property management service industry, this regulation is formulated in accordance with the relevant provisions of the Price Law of the People's Republic of China, the Regulations on Property Management in Zhejiang Province and the Measures for the Implementation of Property Service Charge Management in Zhejiang Province (for Trial Implementation), and in combination with the actual situation of our city.

article 2 Jinhua municipal price bureau shall, jointly with Jinhua municipal construction bureau, manage, coordinate, supervise and guide the property service charges within the urban area according to law.

article 3 the term "property service charges" as mentioned in these measures refers to the fees charged by the property service enterprises to the owners for the maintenance, conservation and management of the houses, supporting facilities and related sites, and the maintenance of environmental sanitation and order in the relevant areas. Its property services should include:

1, the use management and maintenance of * * * parts of the property and * * * facilities and equipment;

2. Cleaning of public places in the property management area, collection and removal of domestic garbage and cleaning of septic tanks;

3. Maintenance and management of public green space, flowers and trees;

4. Maintain public order and assist in the safety precautions in the management area;

5. Archives management and decoration management of various properties;

6. Other public services agreed between the owner and the realty service enterprise.

article 4 the charging of property services shall follow the principles of reasonableness, openness and the adaptability of fees to service levels.

article 5 property service charges shall be subject to government-guided prices and market-regulated prices respectively according to the types of properties, different stages of property services, and the nature and characteristics of services provided.

ordinary residential quarters (excluding villas, row houses, etc., the same below) shall be charged at the government-guided price. Non-residential, villas, townhouses and ordinary residential areas after the establishment of the owners' Committee shall be subject to market-adjusted prices for property service charges.

article 6 property service charges can be charged by contract system or fee system. During the prophase property management, the property service charges shall be contracted out, and the charging method after the establishment of the owners' committee shall be agreed by the owners' committee and the property service enterprise.

contract responsibility system refers to the way that the owner pays the fixed property service fee to the property service enterprise, and the profit or loss is enjoyed or borne by the property service enterprise. Its service fee consists of property service cost, statutory tax and profit. The contract system can take both comprehensive service contract and menu-based sub-service contract.

the gratuity system refers to the way in which the owner pays the realty service fee to the realty service enterprise in advance, and the realty service enterprise extracts the gratuity from the prepaid realty service fund according to the agreed proportion or amount, and all the rest is used for the expenses agreed in the realty service contract, and the balance or deficiency is enjoyed or borne by the owner. The property service funds received in advance include property service expenditure and property service enterprise remuneration.

article 7 the charging system for property services in residential quarters with government-guided prices shall be graded, and the charging grades shall be assessed by the residential quarters where the services are implemented.

the rating standards of fees and the quasi-prices and floating ranges of fees at various levels shall be formulated by the Municipal Price Bureau in conjunction with the Municipal Construction Bureau according to the service contents, service quality and service standards of public property services provided by property service enterprises for owners, and the scale, grade, environment and service facilities of residential quarters, and announced to the public.

the specific implementation standards of property service charges in residential quarters shall be determined by the property service enterprises (or development and construction units) within the specified range of quasi-price and floating range, and shall be specified in the property service contract.

article 8 for residential quarters with market-regulated prices, the owners' committee and the realty service enterprise shall determine their own specific charging standards in accordance with relevant regulations, and make them clear in the realty service contract.

in the residential quarters that should be established according to the regulations, but the owners' committee has not been established, the property service charges shall be determined by the property service enterprises with reference to the relevant provisions of the previous property service charges, and shall be implemented with the consent of more than half of the owners in the property management area.

article 9 the total construction area of residential quarters where the pre-stage property services are assessed by charging level shall be no less than 21,111 square meters (inclusive). For residential quarters with a total construction area of less than 21,111 square meters, the charging standard shall be determined through consultation between the owners and the realty service enterprise. If no agreement can be reached through consultation between the two parties, the charging standard may be reported to the competent pricing department according to the service cost.

article 11 for the implementation of property management in newly-built residential quarters, the property service enterprise shall refer to the rating standard of property service charges and self-evaluate the charging standard, and submit a written application to the competent price department, which shall provide information according to the requirements in the second paragraph of Article 11 of these Measures, and the competent price department shall determine the temporary charging standard according to the actual situation of the residential quarters.

for ordinary residential quarters that implement pre-bidding for property management, the real estate development enterprise shall report the charging level and charging standard to the competent price department according to the scheme of implementing property services in the quarters and the reference range of the charging level evaluation method and charging standard of property services. According to the configuration of residential facilities and equipment and the audited property service plan, the competent price department shall verify the quasi-price and floating range of the charging level and standard, and the specific charging standard shall be determined by the real estate development enterprise through bidding within the approved quasi-price and floating range.

article 11 the assessment of property service charge level shall be organized by the district price department in conjunction with the property department. Jinhua Economic Development Zone is organized by the Municipal Price Bureau in conjunction with the municipal and development zone property departments.

a realty service enterprise shall submit a written application to the competent pricing department 31 working days before the charging. The following materials shall be provided when applying:

(1) Business License of Enterprise as a Legal Person;

(2) Qualification Grade Certificate of Property Service Enterprise;

(3) relevant information such as the property service contract and the content standard of the property service in the residential area;

(4) Jinhua Property Service Charge Level Approval Form;

(5) Other information required.

Article 12 Property service charges subject to government-guided prices shall be collected according to the residential construction area; The billing time shall be calculated from the month following the date when the owner purchases the newly-built commercial residence and goes through the handover procedures. If the owner fails to go through the handover procedures within the specified time, it shall be calculated from the month following the agreed handover period. The purchase of non-newly-built commercial housing is calculated from the month following the date of property right transfer of the house.

the property service charge of the owner's leased property can be paid as agreed by both parties. If it is paid by the lessee, the owner shall be jointly and severally liable.

article 13 for the houses that have been completed but not yet sold, or have not been delivered to the property buyer on time due to the reasons of the development and construction unit, the property service fee shall be paid in full by the development and construction unit. For the property that has been handed over but the owner has not lived, and has been vacant for more than half a year after living, after verification by the property service enterprise, the property service fee shall be paid at 71% of the receivable standard. If the house is not vacant during the renovation period, the property service fee shall be paid in full according to the prescribed standards.

Article 14 The cost of property services (expenditure on property services) consists of the following items:

(1) Wages of management service personnel, social insurance and welfare funds drawn according to regulations;

(2) the daily operation and maintenance expenses of the parts, facilities and equipment used by the property;

(3) the cost of cleaning and sanitation in the property management area;

(4) the cost of greening and maintenance in the property management area;

(5) Maintenance cost of regional order in property management;

(6) office expenses;

(7) depreciation of fixed assets of property service enterprises;

(8) the parts, facilities, equipment and public liability insurance fees of the property;

(9) other expenses agreed by the owner.

article 15 the electricity charges required for the operation of high-energy-consuming facilities such as elevators and booster pumps, and the electricity charges for lighting and ventilation, cleaning and order maintenance of underground motor vehicle garages and parking spaces in residential quarters shall be shared with the beneficial owners according to the actual amount. The specific allocation method shall be determined by both parties through consultation.

Article 16 Within the property management area, water supply, power supply, gas supply, heat supply, communication, cable TV and other units shall charge relevant fees to the end users. Where the realty service enterprise accepts the entrustment to collect the above fees, both parties shall sign a paid service contract, and the realty service enterprise shall charge the entrusting party the agency service fee, and shall not charge the owner any additional fees such as handling fees.

Article 17 Where a realty service enterprise adopts the fee system, the funds for realty management shall be established in accordance with the regulations, and its income and expenditure shall be announced regularly, subject to the supervision of all owners; The implementation of the contract fee system, it shall regularly publish the income and expenditure of the property * * * parts, * * * facilities and equipment and related venues.

article 18 when providing property management services, a property service enterprise shall sign a property service contract with the owner, and provide services with quality and price in accordance with the service items and standards agreed in the contract.

article 19 except as provided by laws, regulations and rules, a realty service enterprise shall not collect the deposit or security deposit from the owners under any name.

Article 21 The property service fee shall be charged by the property service enterprise to the owner within the time limit stipulated in the property service contract signed with the owner; If no agreement is made, the advance harvest period shall not exceed 1.2 months.

article 21 the expenses for overhaul, medium repair, renewal and transformation of the parts and facilities used by the property shall be charged to the special maintenance funds of the property, and shall not be included in the property service cost or property service expenditure. The collection, use and management of property special maintenance funds shall be implemented in accordance with relevant regulations.

article 22 the property service charges shall be clearly marked. The charging items, charging standards, charging scope and service contents shall be announced in a prominent position in the business premises or charging places, and shall be subject to the supervision of the owner and the competent price department.

article 23 the owner shall pay the property service fee in full and on time as agreed in the property service contract. If the owner fails to pay the property service fee within the time limit in violation of the property service contract, the owners' committee shall urge him to pay it within a time limit; Fails to pay, the realty service enterprise can be recovered according to law.

article 24 after the owners pay the property service fees to the property service enterprises, unless otherwise stipulated by the state, no department or unit may repeatedly charge the owners the fees with the same nature and content.

article 25. except as otherwise provided by the competent pricing department of the government, the charges related to vehicle parking service, decoration garbage removal, agency service and other special services in the process of implementing property management in residential quarters shall be subject to market-adjusted prices.

article 26 the municipal price bureau will punish the price behavior in violation of these measures in accordance with the price law of the people's Republic of China and the provisions on administrative penalties for price violations.

article 27 these measures shall come into force as of August 1, 2111. Former Jinhua Municipal Price Bureau and Jinhua Municipal Construction Bureau "On Printing and Distributing Jinhua <; Measures for the administration of property service charges > Detailed Rules for the Implementation (No.23 [2115] of the Golden Price Management) shall be abolished at the same time.
