article 1 in order to prevent and control environmental pollution in catering services, further improve environmental quality, safeguard public health, and promote the healthy development of catering services, these regulations are formulated in accordance with the environmental protection law of the people's Republic of China, the law of the people's Republic of China on the prevention and control of air pollution, the regulations on the prevention and control of air pollution in Ningxia hui autonomous region and other relevant laws and regulations, and in combination with the actual situation of this municipality. Article 2 These Regulations shall apply to the prevention and control of environmental pollution in catering services and related management activities within the administrative area of this Municipality.

the prevention and control of environmental pollution and related management activities of kitchen waste in catering service places shall be carried out in accordance with the regulations of Yinchuan municipality on the management of kitchen waste. Article 3 The municipal competent department of ecological environment shall be responsible for the unified supervision and management of the prevention and control of environmental pollution in the catering service industry in this Municipality. County (city) ecological environment department is responsible for the supervision and management of environmental pollution prevention and control of catering services in this area.

natural resources, housing and urban and rural construction, examination and approval services, market supervision, comprehensive law enforcement supervision, public security and other departments shall do a good job in the prevention and control of environmental pollution in the catering service industry according to their respective responsibilities.

township people's governments and sub-district offices shall, in accordance with their duties, assist in the supervision and management of the prevention and control of environmental pollution in catering services in their respective areas. Article 4 Any unit or individual has the right to make complaints and reports on violations of these Regulations. The department that receives the complaint or report shall promptly investigate and deal with it in accordance with the management authority, and inform the complainant or informant of the handling result. Article 5 The development plan of catering service industry shall conform to the requirements of environmental functional zones and pollution prevention and control, promote the separation of catering service places from residential buildings, and build a relatively independent catering service place gathering business area.

in the catering service places with conditions, a special centralized treatment facility for lampblack should be built. Article 6 It is forbidden to build, rebuild or expand catering service projects that produce oil smoke, odor and waste gas in residential buildings, commercial and residential complex buildings without special flues and commercial floors adjacent to residential floors in commercial and residential complex buildings.

when selling or renting a house, the building owner mentioned in the preceding paragraph shall inform the buyer or lessee that the house shall not be used for catering services that produce oil smoke, odor and waste gas. Seventh new, rebuilt and expanded catering service projects, the implementation of the construction project environmental impact registration form online filing management system.

before the catering service project is completed and put into operation, the unit or individual applying for catering service project shall log on to the online filing system of the environmental impact registration form of construction project (hereinafter referred to as the online filing system) to register the real information, and submit it online to the local competent department of ecological environment for filing.

the applicant is responsible for the authenticity, accuracy and completeness of the contents of the environmental impact registration form of the construction project. Article 8 The municipal, county (city) department in charge of ecological environment shall, through television, radio, newspapers, internet and other media, announce to the public the address link information of the online filing system, the management requirements related to the filing of the environmental impact registration form of catering service projects in environmental protection laws, regulations and rules, the reporting method, matters needing attention, etc. Article 9 if the following catering service projects are newly built, rebuilt or expanded, which do not produce oil fume, odor or waste gas, the online filing of the environmental impact registration form of the construction project will not be handled:

(1) the chilled hot drinks and food without a kitchen are reheated;

(2) Desserts, Western-style cakes, Chinese-style pastries, etc. that do not have an open-flame stove and do not have frying, frying, frying, barbecue and other production processes that produce oil smoke and waste gas.

the list of catering service items that do not produce oil fume, odor and waste gas as mentioned in the preceding paragraph shall be formulated by the municipal competent department of ecological environment and announced to the public after being approved by the municipal people's government. Tenth ecological and environmental departments or other departments responsible for environmental protection supervision and management have the right to conduct on-site inspections of catering service places. The inspected shall cooperate with the inspection, truthfully reflect the situation, and provide information related to the inspection content, and shall not conceal it; Shall not refuse or obstruct the inspection. Eleventh catering service projects in high-pollution fuel no-burn zones shall use clean energy such as natural gas, liquefied petroleum gas and electricity, and prohibit the use of high-pollution fuels such as coal, trees, straws and sawdust.

promote the use of clean energy in catering service projects outside high-pollution fuel no-burn areas. Article 12 A catering service place that produces oil fume pollution shall install oil fume purification facilities matching its business scale, or take other oil fume purification measures to discharge oil fume up to the standard and prevent pollution to the normal living environment of nearby residents.

catering service operators shall ensure the normal use of fume purification facilities, and shall not leave them idle or dismantle them without authorization.

Encourage catering service operators to upgrade and install advanced fume purification facilities in time to improve the level of environmental pollution prevention and control. Thirteenth city, county (city) department in charge of ecological environment shall establish and improve the platform of online monitoring system for soot in catering service places, and strengthen the supervision and management of the operation of pollution prevention facilities and soot emission in catering service places. Fourteenth large catering service units located in environmentally sensitive areas shall install online monitoring facilities for lampblack.

small and medium-sized catering service units are encouraged to install online monitoring facilities for oil fume.

the installation cost, daily operation and maintenance cost of the online monitoring facilities for oil fume shall be borne by the catering service unit, and it shall be networked with the local competent department of ecological environment.
