chapter I general provisions article 1 these regulations are formulated in accordance with the provisions of the fire protection law of the people's Republic of China and other relevant laws and administrative regulations, and in combination with the actual situation of Shenzhen special economic zone, in order to prevent fires, reduce fire hazards, and protect citizens' personal and property safety. Article 2 The fire control work shall follow the principle of putting prevention first and combining prevention with elimination, adhere to the principle of combining specialized organs with the masses, and implement the responsibility system for fire control safety. Article 3 People's governments at all levels shall strengthen their leadership over fire control work, incorporate fire control work into economic and social development plans, and ensure that fire control work is compatible with economic construction and social development.
the municipal public security organ is the competent authority for fire control, and the municipal public security fire control institution is responsible for the implementation of fire control supervision and management.
relevant government administrative departments such as land planning, construction, quality and technical supervision, industry and commerce, labor, urban management, etc. shall cooperate with public security fire control institutions to do a good job in fire control within their respective responsibilities. Article 4 All units and individuals shall strictly abide by fire laws and regulations, fulfill their fire safety responsibilities and take effective measures to prevent fires.
any unit or individual has the right to dissuade, stop or report to public security fire control institutions for acts endangering fire control safety. Article 5 People's governments at all levels shall regularly carry out fire prevention publicity and education to raise citizens' awareness of fire prevention.
October 9th every year is the city's fire prevention publicity day. Sixth people's governments at all levels and their relevant departments shall commend and reward units and individuals that have made outstanding contributions or made remarkable achievements in fire control work. Chapter II Fire Prevention Article 7 The legal representative or main leader of an organ, a public organization, an enterprise or a public institution is the first person responsible for fire control safety of the unit. The first person responsible for fire safety shall perform fire safety duties in accordance with fire laws and regulations and take full responsibility for the fire safety of the unit. Article 8 The labor department shall incorporate fire-fighting laws, regulations and professional fire-fighting knowledge into the content of labor skill training; Educational institutions shall carry out basic knowledge education on fire control for students; News units such as radio, television, newspapers and periodicals should regularly carry out publicity work on fire laws, regulations and fire knowledge. Article 9 When formulating a city plan, the municipal planning and land department shall, jointly with the municipal public security fire control institutions, formulate special plans for public fire control facilities such as fire safety layout, fire stations, fire water supply and fire communication. Article 11 District and town people's governments (street offices) and villagers' committees shall meet the requirements of urban fire safety when making plans and carrying out construction, and shall make plans and gradually transform the building layout and buildings that do not meet the requirements of fire safety. Article 11 The establishment of factories, warehouses, special stations, docks, filling stations, supply stations, pressure regulating distribution stations and other places for producing, storing, loading and unloading inflammable and explosive dangerous goods shall comply with fire laws, regulations and special plans for urban fire control, and the development of construction projects that do not meet their safety requirements shall be restricted around them.
if the above-mentioned places and construction projects do not conform to the special plan for urban fire protection, the people's governments at all levels and relevant departments such as planning and land shall arrange and urge them to move gradually. Article 12 Construction, urban management and other administrative departments and urban water supply, power supply, telecommunications and other units shall build public fire-fighting facilities in accordance with the special fire-fighting plan, and strengthen the maintenance of public fire-fighting facilities to keep them complete and applicable. Thirteenth in accordance with the provisions of the state, the fire design of building projects should be reported to the public security fire control institutions for examination and approval, and the fire design after examination and approval shall not be changed without authorization, and can only be put into use after the project is completed and accepted by the public security fire control institutions. Article 14 Before using or opening public gathering places such as industrial workshops, dance halls, theaters, auditoriums, hotels, restaurants, shopping malls and bazaars, the owners or operators shall declare to the public security fire control institutions, and only after passing the fire safety inspection can they use or open. Fifteenth temporary buildings and residential houses of residents and villagers for production and commercial purposes shall be reported to the public security fire control institutions for examination and acceptance.
if the buildings and houses mentioned in the preceding paragraph are used as production and business premises, the administrative department for industry and commerce shall check the acceptance opinions issued by the public security fire control institutions when handling the business license. Article 16 Employees' dormitories, kitchens and public gathering places shall not be set up in the same industrial production building with workshops and warehouses.
if the fire safety requirements are not met in entertainment and dining places, bazaars and other commercial premises, no staff dormitory shall be set up. Seventeenth crowded production workshops, dormitories and public gathering places are not allowed to install anti-theft nets, except those that meet the requirements of emergency evacuation and do not affect fire fighting and rescue. Eighteenth buildings should be set up in accordance with the provisions of the state fire control facilities and maintenance.
the design, construction, installation, supervision, inspection and maintenance of building fire protection facilities must be undertaken by units with professional fire protection qualifications. Article 19 A property management unit shall perform the following fire safety duties for the properties it manages:
(1) Establish and improve the fire safety system and define the fire safety responsibilities;
(2) manage, repair, maintain and update the public fire-fighting facilities and equipment in the property area;
(3) Implement the patrol system on duty, eliminate fire hazards in time and report them to public security fire control institutions;
(4) Establish a voluntary fire brigade, organize to put out the initial fire, and guide the safe evacuation.
