Regulations on Prevention and Handling of Personal Injury Accidents of School Students in Hunan Province

Chapter I General Provisions

Article 1 In order to effectively prevent and properly handle personal injury accidents of students, protect the legitimate rights and interests of students and schools, and maintain the normal education and teaching order, according to the Education Law of the People's Republic of China.

the education, public security, health, food and drug supervision and administration, judicial administration and other departments of the people's governments at or above the county level shall, according to their respective responsibilities, do a good job in the prevention and handling of personal injury accidents among students.

Article 9 Schools are encouraged to take out school liability insurance and additional no-fault liability insurance, and insurance fees shall not be charged to students. Primary and secondary schools, secondary vocational schools and kindergartens shall be covered by school liability insurance, and the required funds shall be guaranteed in accordance with the relevant provisions of the state and province.

Chapter II Preventive Responsibilities of Schools

Article 11 A school shall establish and implement the following safety systems:

(1) Implement the responsibility system for student safety management with the principal (head of the school) as the first responsible person, and make clear that specialized institutions or personnel are specifically responsible for safety management;

(2) Establish a health management system and an epidemic reporting system for infectious diseases, and equip full-time medical (health care) personnel or part-time health care teachers with professional qualifications in accordance with state regulations;

(3) Establish food safety management systems such as incoming goods inspection, procurement claim, ledger records, health management of employees, food sample retention, etc. in the canteen, and equip food safety administrators to conduct regular physical examinations on employees in the canteen;

(4) Establish an internal security system such as campus patrol, and primary and secondary schools and kindergartens should strengthen the registration and management of visitors and vehicles;

(5) Implement the fire control safety system and the responsibility system for fire control work, strengthen the daily maintenance of fire control facilities and equipment, set up fire control safety signs, and ensure smooth evacuation passages, safety exits and fire truck passages;

(6) Establish a system of students' leave cancellation, register students' leave cancellation, and inform their parents or other guardians in time when minor students are found to be absent from school, leaving school without authorization or absent from class;

(7) Schools with boarders should establish a management system for students who live on campus, strengthen dormitory management, do a good job in the life management and safety protection of students who live on campus, and promptly inform their parents or other guardians of underage students who live off campus without authorization in violation of school rules;

(8) Schools with laboratories should establish a laboratory safety management system, strengthen the management of the purchase, storage, use, registration and cancellation of inflammable, explosive, toxic and harmful dangerous goods in the laboratory, and regularly check the safety precautions of the laboratory;

(9) Schools equipped with school buses and school bus service providers should establish and improve the school bus safety management system, equip safety management personnel, strengthen the safety maintenance of school buses, conduct regular safety education for school bus drivers, and organize school bus drivers to learn road traffic safety laws and regulations, as well as safety prevention, emergency handling and emergency rescue knowledge, so as to ensure the safety of students riding school buses;

(11) other safety systems.

Article 11 Schools shall take the following measures to ensure the safety of students:

(1) Formulate emergency plans for emergencies and organize emergency drills regularly. In case of emergencies, start the emergency plans in time, take emergency safety measures to protect the personal safety of students, and report to the competent education department and other relevant departments in time;

(2) Reasonably arrange students' time of going to class and the order of passage, set up obvious warning signs in passages, stairs and places prone to congestion, take necessary protective measures, and arrange special personnel to be on duty and patrol to prevent crowding and trampling;

(3) Plan to build a video surveillance system. The storage time of video surveillance information shall be in accordance with the relevant provisions of the state and the province, but the use of video information shall not infringe on personal privacy;

(4) Check the product labels, quality certificates or qualification certificates of service providers when purchasing products and services, and do not purchase products or services that do not meet the quality, hygiene standards and safety requirements;

(5) organizing students to participate in comprehensive practical activities such as internship, inspection and labor, as well as military training, cultural entertainment and other collective activities, necessary safety protection measures shall be taken;

(6) organize students to carry out escape, self-help and mutual rescue drills;

(7) When renting a vehicle to pick up and drop off students, the driver's license and the legal and valid documents of the vehicle shall be checked;

(8) Give necessary care to students with special physique or diseases who are not suitable to participate in specific education and teaching activities, make appropriate adjustments to their education and teaching activities, take timely measures to rescue students when they find physical and psychological abnormalities, and inform their parents or other guardians;

(9) If the teaching staff suffers from infectious diseases, mental disorders or bad behaviors, they shall adjust their posts in time or make other treatments;

(11) Establish a safety work ledger to record daily safety work, implementation of safety responsibilities, safety inspection and elimination of potential safety hazards;

(11) Other safety measures.

Article 12 A school shall set up a mental health education consulting room in accordance with the relevant provisions of the state and the province, equipped with mental health education teachers, and provide psychological consultation and counseling services for students.

Article 13 A school shall formulate a safety education and training plan for its teaching staff, provide them with safety knowledge and skills training, ensure them to master the corresponding common sense of safety rescue, and improve their safety rescue guidance ability.

article 14 schools should strengthen the investigation of potential safety hazards on campus, and if it is found that there are situations endangering students' personal safety or major safety hazards in schools or the surrounding areas of schools, they should take effective measures in time to prevent safety accidents and report them to the competent education departments and relevant departments. Article 15 Schools are prohibited from engaging in the following acts:

(1) Organizing students to participate in emergency rescue activities that should be engaged by professionals;

(2) using the school premises for production and operation or storing inflammable, explosive, toxic and harmful dangerous goods;

(3) using school playgrounds and other educational and teaching places for parking motor vehicles during education and teaching;

(4) other acts prohibited by laws and regulations.

article 16 school staff should abide by professional ethics, respect students' personality, and must not discriminate against students, and must not commit corporal punishment, disguised corporal punishment, beatings, insults, indecency and other harmful acts against students, and must not infringe on their legitimate rights and interests.

when teachers and staff find that students have been infringed or may be infringed, they should take timely measures such as warning, stopping or rescuing, and report to the school or relevant departments.

Article 18 Students who are suffering from mental disorders or infectious diseases that have not been cured and meet the conditions for suspension from school shall apply for suspension from school; If you don't apply for suspension, the school can make a written suspension decision according to the hospital diagnosis conclusion. Students, their parents or other guardians who are dissatisfied with the decision made by the school to suspend their studies may appeal to the relevant education authorities. During the appeal period, the implementation of suspension measures will not be affected.

Article 19 School sponsors shall provide school buildings, venues, facilities and equipment that meet the national safety standards; Do not meet the mandatory standards, the school sponsor shall timely repair, renovation or replacement.

Article 21 Schools should incorporate students' safety education into the teaching content according to the national curriculum standards and local curriculum requirements, and carry out safety education on traffic safety, fire safety, food safety, network safety, drug prevention, mental health, drowning prevention, sexual assault prevention and abduction prevention according to the cognitive ability, psychological and physiological characteristics of students of different ages.

Colleges and universities should strengthen the education of students' financial safety knowledge and legal common sense, enhance students' awareness of self-prevention, guide students to develop a scientific and rational consumption concept, and prevent the infringement of bad campus loans on students.

Article 21 Primary and secondary schools and kindergartens may, according to actual needs, establish a parent committee system to promote the prevention and treatment of personal injury accidents in schools.

Twenty-second primary and secondary schools and kindergartens should organize guards and security personnel to be on duty at the school gate during school hours, and organize teaching staff or adult volunteers to maintain order; For students and children under the age of eight, a transfer system should be established.

Article 23 Primary and secondary schools and secondary vocational schools shall establish and improve the prevention and handling system in school bullying, establish the emergency response plan for the school bullying incident, clarify the responsibilities of the teaching staff in relevant positions to prevent and handle school bullying, and promptly investigate and handle the school bullying incident; School bullying's acts suspected of violating the law and committing crimes shall be reported to the public security organ in a timely manner.

article 24 secondary vocational schools and institutions of higher learning shall establish and improve the internship management system when arranging students' internships. Practice units shall provide corresponding education and training on safety in production for practice students, provide practice environment and conditions that meet the requirements of labor safety and health and occupational disease hazard protection, and abide by the provisions of the state on working hours.

if students from secondary vocational schools and institutions of higher learning take part in on-the-job or on-the-job internships, the schools, internship units and students should sign an internship agreement, which should include provisions on student safety and security, and clarify the responsibilities and obligations of the schools and internship units for student safety and security; If they are underage students, they shall also obtain the informed consent signed by their parents or other guardians. No internship can be arranged for students who have not signed an internship agreement or informed consent.

Schools and internship units should insure internship liability insurance for internship students in accordance with state regulations; In line with the conditions of work-related injury insurance, the internship unit shall handle work-related injury insurance for the internship students. Students shall not be charged or deducted from their internship remuneration for internship liability insurance.

Article 25 Kindergartens should give priority to the protection of children's life and health; According to the principle of combining conservation with education, follow the characteristics and laws of children's physical and mental development, and promote the harmonious development of children's body and mind; Do not engage in activities that violate the laws of early childhood education and are harmful to children's physical and mental health, and do not engage in competitions, performances or training that are harmful to children's health.

Chapter III Preventive Duties of Administrative Organs

Article 26 The competent department of education shall perform the following duties:

(1) Establish and improve the prevention system for students' personal injury accidents and the assessment and supervision mechanism for school safety work, and implement the responsibility system for school safety work and the accountability system for accidents;

(2) to guide schools to carry out safety education for students, establish a safety training system for teaching staff, and organize and guide safety knowledge training for teaching staff;

(3) Organize regular safety inspections of school buildings, venues and other public facilities, as well as teaching supplies, teaching and living facilities and equipment provided by the school for students;

(4) make emergency plans for school emergencies, and organize and guide students' personal injury accident emergency handling drills;

(5) to guide and supervise the school to establish, improve and implement the system and measures to prevent students' personal injury accidents;

(6) to guide and supervise schools equipped with school buses to establish and improve the school bus safety management system and implement the school bus safety management responsibility;

(7) Other duties as stipulated by laws and regulations.

Article 27 The public security organ shall perform the following duties:

(1) To guide and supervise the school to build an internal public security prevention and control network and do a good job in internal security;

(2) Strengthen the public security work in the school and its surrounding areas, install monitoring facilities, carry out targeted public security patrols, set up police offices or public security sentry box in the surrounding areas of schools with complex public security situations, and promptly stop and investigate illegal and criminal acts such as disrupting school order and infringing on students' personal and property safety;

(3) Strengthen the traffic safety and traffic order management of the school and its surrounding roads, set up traffic safety signs, set up vehicle no-stopping, warning and speed limit signs on the road section in front of the school, and draw crosswalk markings to maintain the traffic order of the entrance and exit roads of primary and secondary schools and kindergartens in busy traffic sections during school hours;

(4) Strengthen the supervision and inspection of school buses' operation, ban school buses that are unlicensed and do not meet safety standards, and investigate and deal with school buses' road traffic safety violations;
