(two) to establish, improve and implement the safety production responsibility system, safety production rules and regulations and safety technical operation procedures of the unit;
(three) to establish a safety production management organization to meet the needs of safety production work according to law, and to be equipped with safety production management personnel;
(four) according to the provisions of the full extraction and use of safety production costs, pay risk of mortgage, to ensure the effective implementation of the unit's safety production investment;
(five) accept the supervision and management of production safety of the government and its relevant departments, organize and supervise and inspect the production safety of the unit at least once every quarter, eliminate the hidden dangers of production safety accidents in time, and record the inspection and handling;
(six) to organize the formulation and implementation of emergency rescue plans for production safety accidents, establish emergency rescue organizations, improve emergency rescue conditions, carry out emergency rescue drills, and submit them to the safety production supervision and management departments or relevant departments for the record as required;
(seven) in accordance with the provisions of timely and truthful reporting of production safety accidents, the implementation of related work to deal with production safety accidents;
(eight) the implementation of safe production target management, regularly publish the safety status of the unit, listen carefully and actively adopt the reasonable suggestions and requirements of trade unions and workers for safe production.
Article 7 A production and business operation entity shall establish and improve the following safety production rules and regulations:
(a) the safety production input guarantee system;
(two) the safety demonstration, evaluation and management system of new construction, renovation and expansion projects;
(3) Comprehensive safety management system for facilities and equipment and maintenance, maintenance and overhaul system for safety facilities and equipment;
(four) the safety management system of the production and business premises, facilities and equipment with major dangers and harmful factors;
(five) the safety management system of major hazard sources;
(6) Occupational health management system;
(seven) the use and management system of labor protection articles;
(eight) safety inspection and accident investigation and rectification system;
(nine) the target management of production safety and accountability system;
(ten) safety education and training management assessment system;
(eleven) special operations personnel management system;
(twelve) the standardized operating system of on-site safety management and post safety production;
(thirteen) the management system of production safety meeting;
(fourteen) emergency rescue plan and emergency system management system;
(fifteen) production safety accident reporting and investigation and handling system;
(sixteen) other safety production rules and regulations such as fire protection, transportation, warehousing and disaster prevention.
Article 8 Production and business operation entities must establish and improve their own safety production responsibility system and safety production target management system according to law, decompose the safety production responsibility target into various departments and posts, and define the responsible personnel, responsibility content and requirements for assessment, rewards and punishments.
The safe production responsibility system and the safe production target management system include the following contents:
(a) the main person in charge of production safety responsibilities and objectives;
(two) the responsibilities and objectives of the person in charge of production safety and other responsible persons;
(three) the responsibility and goal of production safety of management departments, workshops, branches and other departments and their responsible persons;
(four) the safety production responsibilities and objectives of the team and team leader;
(five) the responsibilities and objectives of employees in production safety.
Article 9 A production and business operation entity must establish a safety production management organization in accordance with the following provisions, and be equipped with safety production management personnel:
Mines, construction units, production, management and storage units of dangerous chemicals, fireworks and firecrackers, civil explosives, road and water passenger and cargo transport business units and other dangerous production and business units must set up separate safety production management institutions, and be equipped with full-time safety production management personnel suitable for the safety production work of their own units.
Where there are more than 300 employees in production and business operation entities other than those specified in the preceding paragraph, a safety production management organization shall be set up, and full-time safety production management personnel shall be equipped according to the standard of 3‰, of which no less than 2 are full-time safety production management personnel; Employees under 300 shall be equipped with full-time or part-time safety production management personnel, or entrust personnel with relevant professional and technical qualifications stipulated by the state or occupational safety management personnel to provide safety production management services.
Where a production and business operation entity has subordinate units, the safety production management institutions and personnel of its subordinate units shall be set up and equipped in accordance with the above provisions.
Article 10 When assisting decision-making bodies and relevant responsible persons in safety production management, the safety production management institutions or safety production management personnel of production and business operation entities shall perform the following duties:
(a) to assist the decision-making body of the unit and the relevant person in charge to organize the formulation of the annual management objectives of production safety of the unit and implement the assessment work;
(two) to formulate the work plan for the safety production management of this unit, clarify the safety production responsibilities of all departments and posts of this unit, and carry out supervision and inspection;
(three) to participate in the formulation of the unit's safety production investment plan and safety technical measures plan and organize the implementation or supervise the implementation of the relevant departments;
(four) to organize the formulation or revision of the safety production rules and regulations of the unit, participate in the review of safety technical operating rules and related technical specifications, and supervise and inspect the implementation;
(five) to conduct on-site safety inspection of the production and business premises, and to order the relevant personnel to deal with the problems found in the inspection in a timely manner; In case of emergency, it shall be ordered to stop production and immediately report to the relevant person in charge for handling;
(six) to participate in the review of the design scheme of the new construction, reconstruction, expansion and overhaul projects of this unit, to participate in the project safety evaluation review, project acceptance and trial operation, and to be responsible for reviewing the qualifications, conditions and licenses of contractors and lessees;
(seven) to organize and implement the prevention and control of occupational hazards in the unit, and to implement the prevention and control measures of occupational hazards;
(eight) to organize and implement the publicity, education and training of safety production in this unit, and summarize and popularize the advanced experience of safety production;
(nine) to supervise the use and management of labor protection articles in this unit;
(ten) to organize or participate in the investigation and handling of production safety accidents in this unit, and to undertake the statistics, analysis and reporting of production safety accidents;
(eleven) other safety management work.
Article 11 The decision-making bodies and relevant responsible persons of production and business operation entities shall support the safety production management institutions and safety production management personnel to perform their duties of safety production supervision and management, organize safety production management personnel to participate in post qualification training, and arrange no less than 72 hours of off-the-job training time every year.
Article 12 Mines, construction units, production, management and storage units of dangerous chemicals, fireworks and firecrackers, and explosives for civil use, and dangerous production and business units such as road and water passenger and cargo transportation business units shall establish a risk allowance system for safety production management posts, and full-time safety production management personnel shall enjoy the risk allowance for safety production management posts.
Thirteenth production and business units shall, in accordance with the relevant provisions of the state and the province, extract the safety production expenses, and the safety production expenses must be included in the annual budget of the unit.
Safety production expenses shall be earmarked for the following safety production work:
(1) Expenditure on the improvement, transformation and maintenance of safety facilities and equipment;
(2) Expenditure on providing necessary emergency rescue equipment, equipment and labor protection articles for field workers;
(3) Expenditure for inspection and evaluation of production safety;
(4) Expenditure on evaluation, rectification and monitoring of major hazard sources and major accidents;
(5) Expenditure on safety skills training and emergency rescue drills;
(six) other expenses directly related to production safety.
Fourteenth production and business units shall pay the risk of mortgage for safe production in accordance with the relevant provisions of the state and the province. Risks of special expenses for emergency rescue and disaster relief and after-treatment after mortgage production safety accidents.
Risk of mortgage special account for safety production is stored for special purposes, and its use and management are subject to inspection and supervision by the safety production supervision and management department, the finance department and the audit department; The production and business operation entity shall not delay (postpone) storage, save less or not for any reason, nor shall it apportion it to employees in any form.
Article 15 Production and business operation entities shall conduct safety education and training for employees in accordance with the relevant provisions of the state and the province, establish a safety education and training system for new employees, a special safety education and training system for employees who have left their posts and transferred to other posts, and a re-education and retraining system for employees, improve the safety education and training assessment files for employees, and keep them properly after being signed by the appraisers and the employees themselves.
Special operations personnel shall, in accordance with the relevant provisions of the state and province, be trained in safety technology theory and practical operation by special operations personnel training institutions, pass the examination organized by the safety production supervision and management department, and obtain the qualification certificate for special operations before taking up their posts. The training, assessment and qualification certificate issuance of special equipment operators shall be implemented in accordance with the relevant regulations of the State Council.
Sixteenth production and business units shall formulate corresponding safety education and training contents according to different positions, including:
(1) Laws, regulations and rules relating to production safety;
(2) Safety production rules and regulations, operating procedures and related technical specifications. ;
(three) the post safety operation skills and the dangerous and harmful factors existing in the post;
(four) the use, maintenance and storage of safety facilities, equipment, tools and labor protection articles;
(five) awareness of production safety accidents and emergency measures, self-help and mutual rescue knowledge;
(six) other knowledge and skills of production safety that should be possessed.
Seventeenth production and business units should carry out standardized operation of post safety production in all links and posts in the production process, and educate employees to strictly abide by the rules, regulations, standards and operating procedures of post safety production.
Eighteenth production and business units should adopt advanced technology and equipment, and use advanced management techniques and means to monitor the process of production and business activities, stop unsafe behaviors in time and eliminate hidden dangers of accidents.
Article 19 A production and business operation entity must meet the following requirements when equipping and using labor protection articles for employees:
(a) according to the safety standards, procedures, norms and actual work needs, provide employees with labor protection articles, which must be provided free of charge. It is forbidden to replace labor protection articles with cash or other articles;
(two) the quality of labor protection articles must meet the national standards or industry standards;
(3) The quantity of labor protection articles must meet the requirements and actual work needs;
(4) Educate and supervise employees to wear and use labor protection articles correctly.
Twentieth production and business units shall, in accordance with the relevant provisions, register and file major hazard sources, conduct regular inspections and tests, and strictly record them.
Production and business units shall adopt advanced technologies and equipment such as on-site dynamic control, remote data and image monitoring to monitor major hazard sources to ensure sensitive and efficient early warning control.
Production and business units shall, in accordance with the relevant provisions of the state, report the name, location, nature, possible hazards, relevant safety measures and emergency rescue plans of major hazard sources of their own units to the safety production supervision and management departments and relevant departments for the record.
Article 21 The production and business operation entities shall, in accordance with the provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Occupational Diseases, the Regulations on Labor Protection in Workplaces where Toxic Substances are Used and the Regulations on Safety in Production in Sichuan Province, establish and improve the occupational hazard protection system, occupational health files of employees and occupational monitoring files, create a working environment and conditions that meet the national occupational health standards and requirements, prevent and reduce occupational hazards in workplaces, and ensure employees to obtain occupational health protection.
Twenty-second shopping malls, hotels, restaurants, entertainment venues, schools, hospitals and other production enterprises and public gathering places, evacuation routes and safety exits. It shall conform to the requirements of the relevant national fire protection technical specifications and keep it unblocked, and its indicating signs shall be eye-catching, and the safety exits of the commercial part and the residential part of the commercial and residential building shall be set separately. It is forbidden to occupy evacuation passages, safety exits and set up obstacles.
The production area, living area and storage area of the production and business operation entity shall keep a prescribed safe distance. Workshops, shops and warehouses that produce, manage, store and use dangerous goods shall keep a safe distance from the staff dormitory and shall not be located in the same building as the staff dormitory.
Twenty-third production and business units should carry out regular maintenance and maintenance of safety facilities and equipment, and conduct regular inspections. Maintenance, maintenance and testing must be recorded and signed by relevant personnel. Maintenance, maintenance and inspection records shall include the name of safety facilities and equipment, the time, personnel and problems of maintenance and inspection, and the retention period shall not be less than 3 years.
Twenty-fourth production and business units engaged in lifting, blasting, climbing, foundation pit, slope excavation, slope masonry, drilling and other dangerous operations. Special safety management systems and measures should be formulated in advance, special personnel should be arranged for on-site safety management, dangerous operators should be supervised to operate in accordance with relevant regulations, and measures should be taken in time to eliminate hidden dangers of accidents.
The catalogue of hazardous operations shall be determined and published by the provincial safety production supervision and management department.
Twenty-fifth production and business units shall formulate and implement their own emergency rescue plans for production safety accidents and emergency treatment measures for operating posts, and organize at least one emergency rescue plan drill every year.
Twenty-sixth in accordance with the provisions of relevant laws, regulations and rules, production and operation, transportation, storage, construction, intermediary and other activities shall be carried out only after obtaining the administrative license for safe production, and the production and business operation entity must obtain the administrative license for safe production according to law; After obtaining the administrative license, the conditions of safety production license must be continuously met, and it shall not be reduced or missing.
Twenty-seventh dangerous construction projects (including sub-projects of the project) shall be carried out in accordance with the provisions of laws, regulations and rules for safety conditions demonstration and safety evaluation; If it is required by the state to be evaluated by a qualified safety evaluation agency, a professional evaluation must be carried out.
The safety facilities of new construction, renovation and expansion projects of production and business units must be designed, constructed and put into production simultaneously with the main project in accordance with the following provisions:
(a) the design unit of a construction project shall, when compiling the project design documents, simultaneously compile the safety facility design documents (safety articles);
(two) production and business units in the preparation of construction project investment plan and financial plan, it should be included in the investment required for safety facilities at the same time;
(three) in accordance with the provisions of the state, the construction project that needs the approval of the relevant departments shall, at the same time, submit the safety facilities design documents (safety articles);
(four) the construction unit of the construction project shall carry out the construction in accordance with the requirements of the construction drawing design of safety facilities;
(5) In the commissioning stage of production equipment, the safety facilities should be debugged and assessed at the same time, and the operation effect should be evaluated;
(six) when the construction project is pre-accepted, the safety facilities shall be accepted at the same time;
(seven) safety facilities should be put into production and use at the same time as the main project.
Article 28 The contracting and leasing activities of production and business operation entities must comply with the provisions of laws and regulations. The contracting and leasing unit and the contracting and leasing unit shall sign a special safety production management agreement or stipulate their respective safety production management responsibilities in the contracting and leasing contract.
The safety production management agreement or contract or lease contract shall include the following safety production management contents:
(a) the responsibilities of production safety of both parties and the regional scope of their respective management;
(two) the contents of safety production management in the workplace;
(three) their respective responsibilities in production safety;
(4) Provisions on reporting production safety accidents and cooperating with investigation and handling;
(5) Other agreed contents.
Article 29 Production and business operation entities shall establish safety production inspection systems such as team inspection, workshop inspection, branch factory inspection, comprehensive inspection by comprehensive management department, key inspection organized by relevant responsible persons of headquarters (companies and factories) and mass inspection, and carry out daily safety production inspection based on post self-examination and self-correction, so as to find and correct illegal acts in time and eliminate hidden dangers of production safety accidents; For problems that cannot be handled in time due to material and technical conditions, preventive measures and rectification plans should be formulated and rectified within a time limit.
The production and business operation entity shall establish and improve the archives of safety production inspection and accident hidden danger rectification, and the contents, results and rectification of each inspection shall be recorded in the archives, and signed by the inspectors and reexaminers.
Safety production inspection includes the following contents:
(a) whether the rules and regulations of production safety are sound;
(2) Whether the facilities and equipment are in safe operation;
(three) the situation of safe production in toxic and harmful workplaces;
(four) whether the employees have the corresponding safety knowledge and operation skills, and whether the special operations personnel hold certificates;
(five) whether the employees abide by the rules and regulations of production safety and operating procedures in the process of operation;
(six) whether the equipped labor protection articles meet the national standards or industry standards, and whether the employees wear and use them correctly;
(seven) on-site production management and command personnel have illegal command, forcing employees to take risks;
(eight) whether the on-site production management and command personnel find and stop the illegal acts of employees in time;
(9) Detection and monitoring of major hazard sources;
(ten) production safety accidents;
(eleven) other safety matters that should be checked.
Thirtieth production and business units shall, according to the characteristics of production and business activities, set up full-time security officers in the production team to be responsible for the following safety work:
(a) daily safety education for team members;
(two) to urge the team members to abide by the rules and regulations of production safety and operating procedures;
(3) Supervise the team members to wear and use labor protection articles correctly;
(four) found unsafe conditions in production, timely report and properly handle;
(five) to assist in the implementation of production safety accident prevention measures and participate in the analysis and research of production safety accidents.
Thirty-first production and business units must report production safety accidents to relevant government departments in a timely manner according to law, and may not conceal or report them late. The main person in charge of the accident unit must immediately organize rescue, cooperate with the accident investigation team to carry out accident investigation and properly handle the aftermath of the accident.
