Article 6 The following engineering and construction projects, including the investigation, design, construction, supervision of the project and the procurement of important equipment and materials related to the construction of the project, shall be subject to bidding if they meet one of the scale standards stipulated by the state and the province:

(1) Infrastructure projects and public utility projects relating to the social public *** interests and public safety;

(2) Projects which All or part of the use of financial funds or into the financial management of the government's special construction fund projects;

(3) government-financed projects;

(4) state-owned funds accounted for a controlling or dominant position in the project;

(5) the use of international organizations or foreign governments, loans, assistance to the funds of the project;

(6) the laws, regulations and rules Provide for other projects that should be subject to bidding.

The specific scope of infrastructure projects and public utility projects that have a bearing on the interests of the public and public safety shall be implemented in accordance with the relevant state regulations.

Article VII of Article 6 of these Regulations shall be bidding the scale of construction projects, the state has provisions from its provisions; the state does not have provisions or the state has provisions but need to be made in accordance with the actual situation in the province to make the provisions of the refinement of the provincial development and reform department in conjunction with the relevant administrative departments to formulate, reported to the Provincial People's Government for approval after the implementation of the project.

Article 8 If one of the following circumstances is not suitable for bidding, the bidding may not be invited:

(1) involving national security, state secrets or disaster relief;

(2) the use of poverty alleviation funds to implement the work for food;

(3) the need to adopt irreplaceable patented or specialized technology;

(vii) where the investor of the concession project that has been selected through bidding is able to construct, produce or provide services on its own in accordance with the law;

(viii) where there is a need to procure the works, goods or services from the original successful bidder, which would otherwise affect the requirements of the construction or the functionality of the support;

(ix) in other special cases as stipulated by the State.

The projects listed in the preceding paragraph, belonging to the state regulations need to fulfill the project approval, approval procedures for projects that must be tendered by law, shall be approved by the project approval, approval department; other projects by the bidder to apply for approval by the relevant administrative departments; the provincial people's government to determine the local key projects, shall be approved by the provincial people's government.
