Legal basis: Article 4 of the Measures for the Judgment and Handling of Falsification of Environmental Monitoring Data refers to the act of intentionally interfering with the normal development of environmental monitoring activities by taking advantage of a certain position or work convenience, resulting in distortion of monitoring data, including the following situations: (1) stopping, changing, increasing or decreasing environmental monitoring points without the consent of the approving department or deliberately changing the attributes of environmental monitoring points; (two) to interfere with the sampling port or the surrounding local environment by artificial occlusion, blockage, spraying, etc.; (3) artificially manipulating, interfering with or destroying the production conditions and pollution source purification facilities of pollutant discharge units, so that the production or pollution situation is inconsistent with the actual situation; (four) diluted discharge or bypass discharge, or discharge some or all pollutants through non-standard sewage outlets to avoid the monitoring of automatic monitoring facilities; (5) Damaging or damaging monitoring equipment stations, communication lines, information collection and transmission equipment, video equipment, power equipment, air conditioners, fans, sampling pumps, sampling pipelines, monitoring instruments or meters and other monitoring or auxiliary facilities; (6) intentionally changing, concealing or abandoning the monitoring sample or changing the nature of the monitoring sample by diluting, adsorbing, absorbing, filtering or changing the storage conditions of the sample; (seven) intentionally omitting key projects or deliberately changing the monitoring methods of key projects without justifiable reasons; (eight) deliberately changing or interfering with the environmental conditions or operating conditions of instruments and equipment; (9) Deliberately deleting, modifying, adding or interfering with data and applications stored, processed and transmitted in monitoring equipment; Changing the settings of relevant calibration or test parameters of the instrument without authorization, resulting in the inconsistency between the calibration parameters of the instrument and the test parameters; Set the upper and lower limits and fluctuation range of data acquisition and transmission without authorization, or change the transmission parameters of data signals at will; (ten) artificial use of reagents and standard samples to interfere with the instrument; (eleven) without the provincial and municipal environmental protection departments for the record, the hidden automatic monitoring equipment can secretly modify the parameters and monitoring data of the automatic monitoring equipment through special codes, key combinations, remote login, remote control and simulation; (twelve) deliberately untrue or selective recording of original data; (thirteen) tampering with or destroying the original records, or not transmitting the original data in accordance with the specifications; (fourteen) unreasonably modify or accept the original data, or selectively evaluate the monitoring data, publish the monitoring report or publish the results, so that the evaluation conclusion is distorted; (fifteen) unauthorized modification of data (all data related to the whole process of monitoring); (sixteen) to meet the requirements of quality assurance laws and regulations or related technical specifications, tampering with some data; (seventeen) other circumstances suspected of tampering with monitoring data.
