Chapter I General Provisions

Article 3 The State Administration for Industry and Commerce is in charge of the national registration of individual business households.
Administration for Industry and Commerce of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the registration and management of individual industrial and commercial households in the region.
Municipal and county administrations for industry and commerce, as well as large and medium-sized cities, are responsible for the registration of individual businesses within their jurisdiction. Chapter II Application for Establishment, Change and Cancellation of Registration
Article 4 To apply for registration of an individual industrial and commercial household, the applicant may submit the application in the following ways:
(1) by going to the industrial and commercial office where the place of business is located;
(2) by going directly to the place of registration of the registration authority;
(3) by letters, telegrams, telexes, facsimiles, electronic data interchange and e-mails . If the application is made in this way, the applicant shall submit the original application materials to the registration authority within 5 days after the issuance of the application.
Article 5 An application for registration of the establishment of an individual industrial and commercial household shall be submitted with the following documents:
(1) an application for registration of the establishment of an individual industrial and commercial household signed by the applicant;
(2) proof of the applicant's identity;
(3) proof of the place of business;
(4) other documents required to be submitted by the state laws and regulations.
If the company engages in the business that is required by laws and administrative regulations to be submitted to the relevant departments for approval, it shall submit the approval documents of the relevant departments.
Article 6 An application for change of registration of an individual industrial and commercial household shall be submitted with the following documents:
(1) an application for change of registration of an individual industrial and commercial household signed by the applicant;
(2) proof of the new place of business shall be submitted in the case of an application for change of place of business;
(3) other documents stipulated by the state laws and regulations.
Engaged in the laws and administrative regulations shall be submitted to the relevant departments for approval of the business, shall submit the approval documents of the relevant departments.
Article 7 An application for deregistration of an individual industrial and commercial household shall be submitted with the following documents:
(1) an application for deregistration of an individual industrial and commercial household signed by the applicant;
(2) other documents prescribed by national laws and regulations.
Article 8 Where an agent is entrusted to apply for the establishment, change or cancellation of registration, the applicant's power of attorney and the agent's proof of identity or qualification shall be submitted.

Article 11 The registration authority accepts the application for registration, shall send the applicant a notice of acceptance.

Article XII of the application does not belong to the scope of individual business registration, the registration authority shall promptly decide not to accept, and explain the reasons to the applicant.
Article 13 If the application materials submitted by the applicant are complete and conform to the legal form, the registration authority shall register the application on the spot.
According to the statutory conditions and procedures, the need to verify the substantive content of the application materials, the registration authority shall assign two or more staff to verify, and fill in the application materials verification report.
Article 14 Except for on-the-spot registration, the registration authority shall make a decision on whether to grant registration within 15 days from the date of accepting the application for registration.

Article 16 In any of the following cases, the registration authority that made the registration of an individual industrial or commercial household or its superior authority may revoke the registration of an individual industrial or commercial household at the request of an interested party or on the basis of its authority:
(1) Where the staff of the registration authority abuses their power or neglects their duties in making the registration;
(2) Where the registration authority exceeds its legal authority in making the registration;
(2) Where the registration authority exceeds its legal authority in making the registration;
Any of the above circumstances may lead to the revocation of registration.
(ii) granting registration beyond the legal authority;
(iii) granting registration in violation of the legal procedures;
(iv) granting registration to an applicant who does not have the qualification to apply for registration or who does not meet the legal conditions;

If the applicant obtains the registration of an individual industrial or commercial household by cheating, bribery or other improper means, the registration shall be revoked.
If the revocation of the registration of an individual industrial or commercial enterprise in accordance with the provisions of the preceding two paragraphs may cause significant damage to the interests of the public ****, it shall not be revoked.
Article 17 Where the registration authority makes a decision on revocation of registration, it shall issue to the original applicant a letter of decision on revocation of registration of an individual industrial or commercial household.
Article 18 In any of the following cases, the registration authority shall, in accordance with the law, carry out the registration procedures for deregistration of individual business households:
(1) Individual business households operated by individuals, where the proprietor is dead or incapacitated;
(2) The registration of an individual business household has been revoked in accordance with the law, or the individual business license has been revoked in accordance with the law;
(3) Individual business households are unable to operate due to force majeure;
(3) Individual business households are not able to operate due to force majeure. force majeure that makes it impossible for the individual industrial and commercial household to operate;
(iv) other circumstances stipulated by laws and regulations that the registration of the individual industrial and commercial household should be canceled.
Article 19 in accordance with the provisions of Article 18 (a), the registration authority shall make a decision on the cancellation of registration of individual businesses, shall be issued to the original applicant's heir or guardian of the decision on the cancellation of registration of individual businesses.

Article 21 The registration authority shall provide the following materials of an individual industrial or commercial enterprise for public inspection:
(1) materials relating to the establishment, change and cancellation of registration;
(2) materials relating to the inspection of license;
(3) materials relating to the acceptance of administrative punishment.
Article 22 The registration authority shall not disclose to the public the registration materials of individual industrial and commercial households involving state secrets, commercial secrets and personal privacy. Chapter VI Supplementary Provisions
Article 23 These provisions shall August 1, 2004 shall come into force.
