Chapter I General Provisions Article 1 In order to protect human health, maintain city appearance and environmental sanitation, strengthen the management of kitchen waste, and promote the harmless treatment and resource utilization of kitchen waste, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Regulations of the State Council on the Administration of City Appearance and Environmental Sanitation, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the collection, transportation, disposal and related management activities of kitchen waste within this Municipality. Article 3 The term "kitchen waste" as mentioned in these Regulations refers to food residue, food processing waste and waste edible oil produced in food processing, catering service, unit feeding and other activities in addition to residents' daily life.

The waste edible oil mentioned in the preceding paragraph refers to edible animal and vegetable oils and various oil-water mixtures. Article 4 The municipal administrative department of urban management (hereinafter referred to as the municipal administrative department of kitchen waste) is the administrative department of kitchen waste management in this Municipality. County (district, city) people's government is responsible for the management of city appearance and environmental sanitation (hereinafter referred to as the county (district, city) department in charge of kitchen waste), and carries out daily supervision on the kitchen waste treatment in this area, and accepts the guidance and supervision of the municipal administrative department of urban management.

Environmental protection, agriculture and animal husbandry, food and drug supervision, quality supervision, industry and commerce, public security and other relevant departments shall, according to their respective functions and duties, do a good job in the management of kitchen waste. Article 6 The treatment of kitchen waste shall follow the principles of government leading, social participation, market operation and comprehensive utilization.

The Municipal People's Government shall, according to the national economic and social development plan, increase the capital investment in the treatment of kitchen waste year by year. The specific measures shall be formulated separately by the Municipal People's Government.

County (district, city) people's government shall give policy and financial support according to the actual situation of kitchen waste treatment in this area. Article 7 Encourage, support and guide the scientific research and technological progress in the treatment of kitchen waste, promote the harmless treatment and resource utilization of kitchen waste, advocate civilized catering methods, and reduce the output of kitchen waste. Article 8 The municipal and county (district, city) departments in charge of kitchen waste shall establish a reporting system and accept the public's reports on illegal activities in the collection, transportation and disposal of kitchen waste. Chapter II Collection, Transportation and Disposal of Kitchen Wastes Article 9 The collection, transportation and disposal of kitchen wastes shall be franchised. Without permission, no unit or individual may engage in the collection, transportation and disposal of kitchen waste. Article 10 An applicant applying for the franchise of food waste collection and transportation shall meet the following conditions:

(1) The applicant is an enterprise legal person registered according to law with a registered capital of not less than 3 million yuan;

(two) a fully enclosed special collection container with the function of classified collection;

(three) there are more than ten special vehicles for the transportation of kitchen waste with the functions of preventing the spread of odor, preventing spillage and preventing dripping;

(4) Having a fixed office space and parking places for mechanical equipment and vehicles;

(5) Other conditions stipulated by laws and regulations. Article 11 An applicant applying for the franchise right of kitchen waste disposal shall meet the following conditions:

(1) The applicant is a legally registered enterprise legal person with a registered capital of not less than 20 million yuan;

(2) The location of the kitchen waste treatment facilities conforms to the urban and rural planning, and the planning permission documents have been obtained;

(3) The daily processing capacity is not less than100t;

(4) Having at least five personnel with professional titles above junior level, including technicians in environmental engineering, machinery and food safety;

(five) there are perfect facilities for the treatment of pollutants such as waste water, waste gas and waste residue, and the relevant systems for the normal operation of pollutant treatment facilities and the discharge of pollutants up to standard are established;

(6) Having an emergency plan to control pollution and emergencies;

(seven) other conditions stipulated by laws, regulations and rules. Article 12 The municipal competent department of kitchen waste shall make a decision on the license for the collection, transportation and disposal of kitchen waste through bidding, and issue a franchise license for the collection, transportation and disposal of kitchen waste to the winning enterprise.

The municipal department in charge of kitchen waste shall sign a franchise agreement for the collection, transportation and disposal of kitchen waste with the winning bidder, and clearly stipulate the operating period, business scope, service standards, termination and change of franchise rights, liability for breach of contract, etc. Article 13 Newly-established food processing enterprises, catering enterprises, unit canteens and other kitchen waste producing units shall sign an agreement on the collection and transportation of kitchen waste with the enterprises that have obtained the franchise right for the collection and transportation of kitchen waste before handling the environmental impact assessment and catering service license. If no agreement is signed, the environmental protection department shall not pass the environmental impact assessment, and the food and drug supervision and administration department shall not apply for the catering service license. Before the implementation of this Ordinance, if the kitchen waste generating unit that has obtained the relevant license has not signed an agreement on the collection and transportation of kitchen waste, the environmental protection department shall not handle the annual inspection of the sewage discharge permit.

The enterprise that has obtained the franchise right for the collection and transportation of kitchen waste shall file the signed agreement for the collection and transportation of kitchen waste with the municipal department in charge of kitchen waste every quarter. Fourteenth kitchen waste generating units shall comply with the following provisions:

(a) the establishment of kitchen waste disposal account, indicating the type, quantity and flow direction of kitchen waste;

(two) set up a clearly marked kitchen waste collection container, and keep the container intact, airtight and clean;

(3) Install anti-pollution facilities such as grease trap and slag remover and keep them in normal use;

(4) Kitchen waste and non-kitchen waste should be collected separately, and kitchen waste, food processing waste and waste edible oil should be collected separately.
