chapter I general provisions article 1 these measures are formulated in accordance with the fishery law of the people's Republic of China and the relevant provisions of the state, combined with the actual situation of this province, in order to strengthen the supervision and management of fishing boats and fishing ports, maintain the order of fishery production and water safety, ensure the safety of people's lives and property, and promote the development of fishery production. Article 2 These Measures shall apply to all fishing boats and their personnel sailing, berthing and operating within the territory of this province, the design and manufacture of fishing boats and their marine products, fishing boat repair units, factories (points) and fishing ports. Article 3 The term "fishing boats" as mentioned in these Measures refers to production vessels engaged in fishing and aquaculture, as well as vessels serving fishery production, scientific research, teaching, supervision and fishing port special projects.
the term "fishing port" as mentioned in these measures refers to an artificial port or natural harbor that mainly serves fishery production and is used for fishing vessels to berth, shelter from the wind, load and unload catches and supplement fishing materials. Article 4 The fishery administrative department of the provincial people's government is in charge of the supervision and management of fishing boats and fishing ports in the whole province, and the fishery administrative departments of prefecture, city, prefecture and county (including county-level cities and districts) are in charge of the supervision and management of fishing boats and fishing ports in their respective jurisdictions.

Where a fishery administration, ship inspection and port supervision agency has been established in transboundary waters and fishing ports, the agency shall be specifically responsible for the safety supervision and management of fishing vessels and fishing ports within its jurisdiction. Article 5 The establishment of fishing vessel and fishing port management institutions shall solicit the opinions of the superior competent business department and be subject to its guidance and supervision in business.

Chapter II Management of Fishing Vessels Article 6 A licensing system shall be implemented for the design and construction of fishing vessels. Who is engaged in the design and repair of fishing boats, should have the corresponding facilities and technical conditions, and obtain the qualification certificate issued by the national or provincial fishery authorities before engaging in the design and repair of fishing boats within the approved scope.

Ninth fishing vessels sailing and operating in navigable waters must be equipped with duty crew members who can ensure the safe navigation of the ship and hold valid fishing crew certificates.
Fishermen (including fishermen) sent to work in fishing boats of Hong Kong, Macao, Taiwan and foreign nationalities must be trained by units authorized by the state and recognized by the fishing port supervision organs, pass the examination and obtain legal certificates. Article 11 Fishing vessels must be equipped with qualified signal, fire-fighting and lifesaving equipment according to regulations, abide by the rules for preventing collisions in inland rivers and other port and shipping laws and regulations, apply for fishing port entry and exit visas or regular sailing visas according to regulations, and accept safety inspections. Eleventh fishing vessels shall not exceed the approved navigation area or overload navigation. Fishing vessels are strictly prohibited from carrying passengers in violation of regulations. Twelfth fishing boat owners should actively participate in mutual insurance to enhance their self-protection ability. Article 13 In case of any of the following circumstances, the fishing port supervision authority has the right to prohibit a fishing boat from leaving Hong Kong or order it to suspend its navigation or operation and sail to a designated place:
(1) Violating relevant state laws, regulations or port and shipping rules;
(2) unseaworthiness or towage;
(3) The formalities are not clear after the water traffic accident;
(4) Failing to pay the due expenses to the competent authority or provide appropriate guarantee;
(5) there are circumstances that hinder traffic safety. Chapter III Management of Fishing Ports Article 14 The ownership, use and management of fishing ports are protected by law. The confirmation of fishing port shall be determined by the local people's government at or above the county level with the consent of the water conservancy, transportation, construction, land management and other departments, and then submitted to the fishery administrative department for publication. Fifteenth fishing port construction should be included in the national economic and social development plan of the fishing port. Fishing port construction funds into the local construction plan. The construction of a fishing port shall be uniformly planned and implemented by the provincial fishery administrative department; Two, three fishing port construction by the local, city, state and county (city, district) fishery administrative departments responsible for organizing the planning and implementation, the province to give appropriate support.

The collection, use and management of fishing port fees shall be implemented in accordance with the relevant provisions of the state and the province. The chapter of fishing port shall be formulated by the fishing port management agencies, approved by the government that recognizes the fishing port, and submitted to the provincial fishing port supervision department for the record.
