chapter I general provisions article 1 these regulations are formulated in accordance with the law of the people's Republic of China on safety in production and relevant laws and administrative regulations, in combination with the actual situation of this province, in order to strengthen the work of safety in production, prevent and reduce production safety accidents, ensure the safety of people's lives and property, and promote sustained and healthy economic and social development. Article 2 These Regulations shall apply to the safety production and related supervision and management of units engaged in production and business operations within the administrative area of this province.

if relevant laws and regulations have other provisions on fire safety and road traffic safety, railway traffic safety, water traffic safety, civil aviation safety, nuclear and radiation safety and special equipment safety, such provisions shall apply. Article 3 Work safety in production should adhere to the people-centered principle, establish the concept of safe development, adhere to the policy of safety first, prevention first and comprehensive management, adhere to the principle of graded responsibility and territorial management, follow the principle of managing industries, businesses, production and operation, and ensure safety, strengthen and implement the main responsibility of production and business units, and establish a mechanism of responsibility of production and business units, employee participation, government supervision, industry self-discipline and social supervision. Article 4 The production and business operation entity is the main body responsible for production safety, and the main person in charge of the production and business operation entity is fully responsible for the production safety work of the entity.

production and business operation entities shall abide by relevant laws and regulations on safety in production, establish and improve the responsibility system and rules and regulations on safety in production, strengthen the management of safety in production, improve the conditions for safety in production, promote the scientific, standardized and information-based construction of safety in production, raise the level of safety in production and ensure safety in production. Article 5 The people's governments at or above the county level shall strengthen their leadership over the work of production safety, support and urge all relevant departments to perform their duties of supervision and administration of production safety according to law, establish and improve the coordination mechanism of production safety, and coordinate and solve major problems existing in the work of supervision and administration of production safety in a timely manner.

people's governments at or above the county level shall formulate safety production plans according to the national economic and social development plans and organize their implementation. Safety production planning should be linked with urban and rural planning.

the people's governments of townships and towns, sub-district offices, development zone management committees and other agencies of the people's governments should make it clear that the relevant institutions are responsible for the supervision and management of production safety, and equip them with personnel for the supervision and management of production safety. According to their duties, they should strengthen the supervision and inspection of production safety in production and business units within their respective jurisdictions and assist the relevant departments of the people's governments at higher levels to perform their duties of supervision and management of production safety according to law. Article 6 The emergency management department of the people's government at or above the county level shall, in accordance with the law, implement comprehensive supervision and management of production safety within its administrative area, and perform the duties of supervision and management of production safety in industries and fields within its scope of duties.

other relevant departments of the people's governments at or above the county level shall, in accordance with relevant laws, regulations and the provisions of these regulations, supervise and manage the work safety in relevant industries and fields within their respective functions and duties.

the emergency management departments of the people's governments at or above the county level and the departments that supervise and manage the work of production safety in relevant industries and fields are collectively referred to as departments responsible for the supervision and management of production safety. Article 7 Trade unions shall supervise the work of production safety according to law.

the trade union of the production and business operation entity shall organize employees to participate in the democratic management and supervision of the work safety of the entity according to law, and safeguard the legitimate rights and interests of employees in the work safety. The production and business operation entities shall listen to the opinions of the trade unions when formulating or amending the rules and regulations related to production safety.

in the production and business operation units that have not formed a trade union, employees' representatives shall participate in the management and supervision of production safety in their own units. Article 8 People's governments at all levels and their relevant departments shall take various forms to strengthen the publicity and education of laws, regulations and knowledge about safety in production, enhance the awareness of safety in production of the whole society, and improve the ability of safety prevention and self-help and mutual assistance.

the news media should strengthen the publicity of public welfare in production safety, and conduct supervision by public opinion on violations of laws and regulations on production safety. Article 9 Relevant associations and organizations shall strengthen industry self-discipline, provide information exchange, technical consultation, education and training services for production and business units in accordance with laws, regulations, rules and articles of association, and promote production and business units to strengthen production safety management. Article 11 People's governments at or above the county level and relevant departments shall, in accordance with relevant regulations, commend and reward units and individuals that have made remarkable achievements in improving safety production conditions, promoting standardization construction of safety production, preventing safety accidents, participating in emergency rescue, reporting illegal acts of safety production and hidden dangers of major accidents, and researching and popularizing advanced science and technology of safety production. Chapter II Safety in Production of Production and Business Units Section 1 General Provisions Article 11 Production and business units shall establish and improve the responsibility system for safety in production, define the responsible personnel, responsibility scope and assessment standards at all levels and positions, form a responsibility system for safety in production including all personnel and all production and business activities, strengthen supervision and assessment of the implementation of the responsibility system for safety in production, and ensure the implementation of the responsibility system for safety in production. Twelfth production and business units shall, in accordance with the actual situation of the unit and the relevant provisions of the state, formulate rules and regulations and operating procedures for safe production.

mining, metal smelting, construction, road transport units and units where the production, management, storage, abandonment and disposal of dangerous goods and the amount of dangerous goods used constitute major hazards shall establish, improve and implement the following rules and regulations on production safety:

(1) the responsibility system for production safety and the system of assessment, reward and punishment;

(2) the regular meeting system of production safety;

(3) safety production inspection system;

(4) the safety management system of production and business premises, equipment and facilities with great danger and harmful factors;

(5) monitoring and management system for dangerous operations and major hazard sources;

(6) occupational health management system, labor protection articles allocation and management system;

(7) the management system of safety production risk control and accident hidden danger investigation;

(8) emergency management system;

(9) production safety accident reporting and handling system;

(11) safety production file system;

(11) safety production input and cost management system;

(12) the safety management system for contractors and lessees;

(13) Safety production education, training and certificate system;

(14) other rules and regulations to ensure safety in production.
