Regulations of Jilin Province on the Administration of Small Food Workshops, Restaurants, Grocery Stores and Food Vendors
Chapter I General Provisions Article 1 In order to standardize the production and operation behaviors of small food workshops, restaurants, grocery stores and food vendors, promote the healthy development of the industry, ensure food safety, and ensure public health and life safety, these Regulations are formulated in accordance with the Food Safety Law of People's Republic of China (PRC), the Implementation Regulations of the Food Safety Law of People's Republic of China (PRC) and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the production, operation, supervision and management activities of small food workshops, restaurants, grocery stores and food vendors within the administrative area of this province. Where laws and administrative regulations provide otherwise, such provisions shall prevail. Article 3 The term "small food workshops" as mentioned in these Regulations refers to individual operators engaged in food production and processing with fixed production and processing sites, few employees and simple production conditions, equipment and technology.

The term "small food and beverage outlets" as mentioned in these Regulations refers to individual operators who have fixed business premises, small business area, small business scale, few employees and poor operating conditions and are engaged in catering services.

The term "small grocery store" as mentioned in these Regulations refers to individual operators who have a fixed business place, a small business area, a small business scale and few employees and are engaged in food retail.

The term "food vendors" as mentioned in these Regulations refers to individual operators who engage in food sales or make and sell food on the spot at designated places and within designated time.

Where small food workshops, restaurants, grocery stores and food vendors are mixed, the market supervision and management department shall determine the business type according to the highest food safety risk level and the priority order of operating food varieties.

The specific identification standards for food workshops, restaurants, grocery stores and food vendors shall be formulated by the market supervision and administration department of the provincial people's government. Article 4 The supervision and management of food workshops, restaurants, grocery stores and food vendors shall follow the principles of overall planning, prevention first, risk management, whole-process control and social co-governance, and establish a scientific and strict supervision and management system. Article 5 The people's governments at or above the county level shall be responsible for the supervision and management of food safety within their respective administrative areas, lead, organize and coordinate the supervision and management of food safety in small food workshops, restaurants, grocery stores and food vendors within their respective administrative areas, and establish and improve the management coordination mechanism, the whole process supervision and management mechanism and the information sharing mechanism. Review and assess the food safety supervision and management work of the people's government at the next lower level and the relevant departments of food safety supervision and management at the same level.

The food safety committees of the people's governments at all levels and their offices are responsible for coordinating and guiding the food safety work of small food workshops, restaurants, grocery stores and food vendors within their respective administrative areas, promoting the improvement of relevant policies and measures, and urging relevant departments to implement food safety supervision and management responsibilities.

Township (town) people's governments and sub-district offices shall, in accordance with laws, regulations and the provisions of the people's governments at higher levels, do a good job in food safety related to food workshops, restaurants, grocery stores and food vendors within their respective jurisdictions.

Village (neighborhood) committees shall assist relevant departments and township (town) people's governments and sub-district offices to supervise and manage small food workshops, restaurants, grocery stores and food vendors. Article 6 The market supervision and administration department of the people's government at or above the county level shall be responsible for the food safety supervision and administration of small food workshops, restaurants, grocery stores and food vendors within their respective administrative areas.

The urban management department of the people's government at or above the county level shall be responsible for the supervision and management of food workshops, restaurants, grocery stores and food vendors in outdoor public places within their respective administrative areas.

The health department of the people's government at or above the county level shall be responsible for timely reporting the food safety hidden danger information found in the food safety risk monitoring of food workshops, restaurants, grocery stores and food vendors within their respective administrative areas, and reporting to the health department of the people's government at the same level and the people's government at a higher level in accordance with the regulations.

The relevant departments of the people's governments at or above the county level shall be responsible for the supervision and management of small food workshops, restaurants, grocery stores and food vendors within their respective administrative areas. Article 7 People's governments at or above the county level shall comprehensively manage small food workshops, restaurants, grocery stores and food vendors to improve food safety. Encourage and support small food workshops, restaurants and grocery stores to improve production and operation conditions; Encourage and support food vendors to enter markets, shops and other fixed places to operate. Article 8 Small food workshops, restaurants, grocery stores and food vendors are encouraged to set up trade associations or join relevant food trade associations.

Small food workshops, restaurants, grocery stores, food vendors' associations or related food industry associations should strengthen industry self-discipline, promote the construction of industry integrity, provide training, consultation, rights protection and other services for members, publicize and popularize food safety legal knowledge, and guide their legitimate production and operation. Article 9 Small food workshops, restaurants, grocery stores and food vendors shall engage in production and business activities according to law, be honest and self-disciplined, be responsible for the food safety of their production and business operations, ensure that the food they produce and business is hygienic, non-toxic and harmless, accept social supervision and assume social responsibilities.

Any organization or individual has the right to report food safety violations in the production and operation of food workshops, restaurants, grocery stores and food vendors. If it is verified, it will be rewarded in accordance with relevant regulations.

The department that accepts the report shall protect the lawful rights and interests of the informants and keep them confidential.
