chapter I general provisions article 1 these regulations are formulated in accordance with the food safety law of the people's Republic of China and other relevant laws and administrative regulations, in combination with the actual situation of this province, in order to standardize the production and business operations of small food production and processing workshops, small restaurants and food vendors, ensure food safety, and safeguard public health and life safety. Article 2 These Regulations shall apply to the production, operation, supervision and management of small food production and processing workshops, small restaurants and food vendors within the administrative area of this province.

the specific identification standards for small food workshops, restaurants and food vendors shall be formulated by the food and drug supervision and administration department of the provincial people's government and announced to the public. Article 3 The people's governments at or above the county level shall lead, organize and coordinate the food safety supervision and management of small food workshops, restaurants and food vendors in their respective administrative areas, and establish and improve the food safety supervision and management mechanism combining self-discipline, social supervision and administrative supervision of producers and operators; Organize to deal with food safety emergencies in small food workshops, restaurants and food vendors; Improve and implement the responsibility system and evaluation mechanism of food safety supervision and management, strengthen food safety publicity, and provide guarantee for food safety supervision and management.

township people's governments and sub-district offices shall, in accordance with their duties as stipulated in these regulations, do a good job in food safety supervision and management of small food workshops, small restaurants and food vendors.

village (neighborhood) committees assist relevant departments, township people's governments and sub-district offices to do a good job in food safety supervision and management, and can strengthen food safety management and publicity through village rules and regulations, so as to improve the food safety awareness of village (neighborhood) people. Article 4 The food and drug supervision and administration department of the people's government at or above the county level shall, in accordance with the responsibilities determined by the people's government at the corresponding level, supervise and manage the food safety of small food workshops, restaurants and food vendors within their respective administrative areas.

the departments of health and family planning, industrial and commercial administration, quality and technical supervision and urban management of the people's governments at or above the county level shall be responsible for the supervision and management of small food workshops, small restaurants and food vendors within their respective administrative areas. Article 5 People's governments at or above the county level shall take measures to support the healthy development of small food workshops, small restaurants and food vendors that produce and operate local traditional and high-quality specialty foods.

the people's governments of cities, autonomous prefectures and counties (cities, districts) divided into districts shall make overall planning and rational distribution, encourage and support small food workshops and food vendors to improve their production and operation conditions and enter centralized production and operation places. Article 6 Small food workshops, restaurants and food vendors engaged in production and business activities shall abide by laws and regulations on food safety, be honest and self-disciplined, ensure that the food produced and operated is hygienic, non-toxic and harmless, be responsible to the society and the public, accept social supervision and assume social responsibilities. Seventh to encourage small food workshops, small catering and food vendors to join the relevant food industry associations. Food industry associations should strengthen industry self-discipline, establish and improve industry norms and reward and punishment mechanisms in accordance with the articles of association, promote the construction of industry integrity, guide legitimate production and operation, and publicize and popularize food safety knowledge.

consumer associations and other consumer organizations shall conduct social supervision according to law on acts that violate the provisions of these regulations and harm the legitimate rights and interests of consumers. Chapter ii small food workshops article 8 the establishment of a small food workshop shall meet the following conditions:

(1) having a fixed place suitable for the scale of production and operation and the variety of food, and keeping a prescribed distance from toxic and harmful places and other pollution sources;

(2) Having production facilities, equipment and health protection measures that are suitable for the variety and quantity of food produced and operated and meet the requirements of food safety;

(3) It has a reasonable equipment layout and technological process, and food raw material processing and food processing, packaging, storage and other areas are set separately;

(4) having a management system to ensure food safety;

(5) The trial-produced food has passed the inspection. Article 9 The establishment of a small food workshop shall apply to the food and drug supervision and administration department of the local people's government at the county level for a small food workshop license, and provide the following materials:

(1) an application;

(2) a copy of the applicant's identity certificate;

(3) a copy of the business license;

(4) description of equipment layout and sanitary facilities of the production and business operation site;

(5) List of major equipment and facilities for food production and operation and description of technological process;

(6) rules and regulations to ensure food safety, including incoming inspection records, sales records, health management of employees, and handling of food safety accidents;

(7) certification materials issued after self-inspection or entrusted by a qualified statutory inspection agency. Article 11 The food and drug supervision and administration department of the people's government at the county level shall, within ten working days from the date of receiving the application materials, examine the materials submitted by the applicant and conduct on-site verification when necessary. License those who meet the requirements according to law, and inform the local township people's government or sub-district office in writing of the license information; Do not permit those who do not meet the conditions and explain the reasons in writing. Eleventh food workshop license is valid for three years. If the expiration of the validity period needs to be extended, an application shall be filed with the issuing authority 31 days before the expiration of the validity period. The issuing authority shall make a decision on whether to approve the extension before the expiration of the validity period; If no decision is made within the time limit, it shall be deemed to be granted.

if the information specified in the food workshop license changes, an application for change shall be submitted to the issuing authority within ten days; Where the production and business operation place moves out of the jurisdiction of the food and drug supervision and administration department that originally issued the license, it shall re-apply for a small food workshop license.

no fees shall be charged for the license of small food workshops.
