Regulations of Shijiazhuang Municipality on the Classification and Management of Domestic Waste

chapter I general provisions article 1 these regulations are formulated in accordance with the law of the people's Republic of China on the prevention and control of environmental pollution by solid waste, the regulations on the administration of city appearance and environmental sanitation and other laws and regulations, and in combination with the actual situation of this municipality, in order to strengthen the classified management of domestic waste, improve the urban and rural environment, and promote the construction of ecological civilization and sustainable economic and social development. Article 2 These Regulations shall apply to activities such as source reduction, classified release, classified collection, classified transportation, classified treatment, resource utilization, supervision and management of domestic garbage within the administrative area of this Municipality.

The implementation plan for classified management of domestic waste in this Municipality shall be determined by the Municipal People's Government and announced to the public. Article 3 The term "domestic waste" as mentioned in these Regulations refers to the solid waste generated in daily life or activities providing services for daily life, and the solid waste regarded as domestic waste according to laws and administrative regulations. Article 4 Domestic waste in this Municipality is divided into the following four categories:

(1) Recyclable materials refer to unpolluted domestic waste suitable for recycling, including waste paper, waste plastics, waste glass products, waste metal, waste rubber, waste fabrics, waste furniture, waste household appliances and electronic products;

(2) harmful waste refers to the domestic wastes that cause direct or potential harm to human health or the natural environment, including waste batteries, waste lamps, waste medicines, waste films, waste chemicals for daily use, waste paints, solvents and their packages;

(3) Kitchen waste refers to perishable domestic waste containing organic matter, including household kitchen waste generated in daily life of residents; Kitchen waste generated by collective canteens of institutions, enterprises and institutions and enterprises engaged in catering business activities in food processing, catering services, unit feeding and other activities; Other kitchen waste generated by farmers' markets and agricultural products wholesale markets;

(4) Other wastes refer to other domestic wastes other than recyclables, harmful waste and kitchen waste.

Article 5 The classified management of domestic waste shall follow the principles of government promotion, participation of the whole people, overall planning of urban and rural areas, territorial responsibility, suiting measures to local conditions and simplicity, so as to improve the level of reduction, recycling and harmlessness of domestic waste. Article 6 The people's governments at or above the county level shall incorporate the classified management of domestic waste into the national economic and social development plan, include the required funds in the fiscal budget at the corresponding level, establish and improve the comprehensive leadership and coordination mechanism, and make overall plans to promote the classified management of urban and rural domestic waste.

township people's governments and sub-district offices are responsible for the daily management of domestic waste classification within their respective jurisdictions, exercise the administrative law enforcement power of domestic waste classification management in accordance with the relevant provisions of the state and this province, and guide villagers' committees and residents' committees (communities) to organize and mobilize units and individuals within their respective jurisdictions to participate in domestic waste source reduction and classification activities.

Villagers' committees and residents' committees (communities) should urge and mobilize units and individuals within their jurisdiction to take the initiative to carry out the activities of reducing and classifying domestic waste sources by formulating village regulations and residents' conventions. Article 7 The municipal urban management department is the competent department of domestic waste classification management in this Municipality, and the county (city, district) people's government shall specify the competent department of domestic waste classification management within its jurisdiction (hereinafter referred to as the competent department of domestic waste classification).

the municipal competent department of domestic waste classification is responsible for formulating the management objectives, schemes and standards of domestic waste classification in this municipality, and guiding and supervising the domestic waste classification work of relevant departments of the municipal government and people's governments of counties (cities, districts). County (city, district) domestic waste classification department is responsible for the management of domestic waste classification in this area.

other relevant departments of the people's governments at or above the county level shall, in accordance with the division of responsibilities, do a good job in the classified management of domestic waste. Eighth units, families and individuals should consciously abide by the relevant provisions of the management of domestic waste classification, fulfill the obligations of source reduction and classified release, and assume the responsibility of domestic waste producers.

Article 9 People's governments at or above the county level and their relevant departments, township people's governments, sub-district offices, villagers' committees and residents' committees (communities) shall strengthen publicity and education on the classification of domestic waste, popularize relevant knowledge, and cultivate the habit of domestic waste classification in the whole society. Article 11 People's governments at or above the county level shall support the research, development, application and popularization of new technologies, new processes, new materials and new equipment for classified delivery, classified collection, classified transportation and classified treatment of domestic waste, and use scientific and technological means such as information networks to improve the whole-process classified coverage and intelligent level of domestic waste. Eleventh units or individuals that have made outstanding contributions and outstanding achievements in the management of domestic waste classification, the people's governments at or above the county level may, in accordance with the relevant provisions of the state and the province, give awards. Chapter II Planning and Construction Article 12 The municipal and county (city, district) domestic waste classification authorities shall, jointly with the relevant departments of development and reform, natural resources, ecological environment, commerce, etc., formulate a special plan for domestic waste treatment facilities according to the local population, urban and rural domestic waste treatment targets, and combined with the production and treatment of domestic waste, and organize the implementation after being approved by the people's government at the same level.

the special planning of domestic waste treatment facilities should be incorporated into the national spatial planning according to law and linked with other relevant planning.
