Article 4 The planning department shall, in accordance with the requirements of the overall planning of this Municipality, rationally arrange buildings, structures and roads according to the division of functional areas when formulating urban planning, so as to prevent environmental noise pollution and ensure the quiet living environment. Article 5 The environmental protection departments of the municipal and district people's governments are the organs that exercise unified supervision and management over the prevention and control of environmental noise pollution.
The administrative departments of public security, transportation, railways and civil aviation shall, according to their respective responsibilities, supervise and manage the environmental noise pollution caused by motor vehicles, trains and aircraft. The public security department should also supervise and manage the noise pollution of social life. Article 6 All units and individuals have the obligation to protect the environment from noise pollution and the right to criticize, report and accuse those who cause environmental noise pollution. Units and individuals directly affected by noise pollution have the right to demand that the harm be reduced, eliminated and compensation be paid. Seventh units and individuals that have made remarkable achievements in the prevention and control of environmental noise pollution shall be commended and rewarded by the people's governments at all levels or the environmental protection departments and relevant competent departments. Chapter II Standards and Monitoring of Environmental Noise Article 8 The "Standards for Environmental Noise in Urban Areas" stipulated by the state must be strictly implemented in the special residential areas, residents, cultural and educational areas, first-class mixed areas, commercial centers, second-class mixed areas, industrial concentrated areas and other five types of living environment areas designated by this Municipality. Chapter III Management of Industrial Noise Article 12 New construction, reconstruction and expansion projects must comply with the relevant state regulations on environmental protection management of construction projects, include possible noise in environmental impact assessment, put forward preventive measures, and report to the environmental protection department for approval according to the examination and approval authority before design and construction. After completion, it can only be put into production or use after the environmental protection department that has approved the project has passed the inspection. Article 13 Whoever discharges industrial noise into the surrounding living environment must report and register the noise emission facilities and pollution treatment facilities owned by the environmental protection department that approved the project, and the types, quantity and noise intensity of noise sources that emit noise under normal working conditions, and provide relevant prevention and control materials. There are significant changes in the types, quantity and emission noise intensity of noise sources, or noise pollution treatment facilities need to be dismantled or left idle, and they should be reported to the environmental protection department that approved the project and obtained consent. Article 14 The boundary noise of factories, workshops and workplaces in various living environment areas of this Municipality shall not exceed the environmental noise standard of the local area; Those who exceed the prescribed standards and cause serious noise pollution shall be treated within a time limit in accordance with the principle of graded responsibility.
