Regulations on Ecological Environment Protection and Construction in Liujiaxia Reservoir Area of Linxia Hui Autonomous Prefecture
Article 1 In order to strengthen the construction and management of Liujiaxia Reservoir Ecological Environment Protection Zone, maintain ecological balance and promote the sustainable utilization of environmental resources in the reservoir area, these Regulations are formulated in accordance with relevant laws and regulations and in combination with the actual situation in the reservoir area. Article 2 The ecological environment protection zones in Liujiaxia Reservoir Area (hereinafter referred to as the Reservoir Area) are divided into key protection zones and planning management zones.

Linxia Hui Autonomous Prefecture People's Government (hereinafter referred to as the state people's government) shall organize relevant parties to prepare detailed plans for the reservoir area, determine the scope of protection, and make an announcement after approval. Article 3 All organizations and individuals engaged in management, development, production and life in the ecological environment protection zone of the reservoir area must abide by these regulations. Fourth autonomous prefecture people's government of the reservoir area ecological environment construction management institutions (hereinafter referred to as the competent department of the reservoir area) is responsible for the coordination, service, unified planning, supervision and management of the reservoir area ecological environment protection and construction.

The state government and the administrative departments of agriculture, forestry, animal husbandry, hydropower, transportation, construction, environmental protection, land and resources, tourism and other relevant counties and districts in the reservoir area shall, according to their respective functions and duties, cooperate with the competent departments of the reservoir area to do a good job in environmental protection in the reservoir area according to law. Article 5 The construction of ecological environment protection zones in reservoir areas shall follow the following principles:

(a) the principle of unified planning, contiguous management, rational development and combination of prevention and control;

(two) the principle of linking the construction of the reservoir area with the local national economic and social development planning, the overall land use planning, the water transport development planning and the urban planning;

(three) the principle of overall planning, highlighting key points and comprehensive management;

(four) the principle of who invests in development and who operates and manages;

(five) the development and utilization should pay attention to the principle of maintaining the original features of natural landscape and human landscape, and the layout, shape, height, scale, style and color of construction projects should be coordinated with the surrounding environment. Every year, the maintenance funds of the reservoir area extracted from Liujiaxia Power Station and the government's investment in ecological environment protection are earmarked for the ecological environment protection infrastructure projects in the reservoir area. Article 7 The key protected areas in the reservoir area shall be integrated with engineering measures and biological measures, and comprehensive management and protection shall be gradually implemented.

Within the scope of environmental protection in the reservoir area, the state, county and township (town) environmental protection construction target responsibility system shall be implemented.

Under the premise of unified planning, the county people's government is specifically responsible for the implementation of the ecological environment protection planning in this area. The construction scheme of Sheung Shui and small water conservancy projects should be subject to the whole basin management. Eighth units and individuals that develop and construct projects in the reservoir area that are conducive to the protection of the ecological environment shall enjoy the preferential policies formulated by the state and counties in addition to the relevant laws and regulations of the state. Ninth units and individuals are encouraged to engage in aquaculture, commerce, catering, entertainment, tourism, shipping and other business activities in the protected areas. Article 10 Support units and individuals are encouraged to lease barren hills, slopes, wasteland and beaches around the reservoir, and the government gives financial support to various infrastructure construction.

The contract period for barren hills, wasteland, barren slopes and barren beaches is 50 years, which can be inherited and subcontracted according to law during the contract period, and the contract can be continued after the contract expires.

If the barren hills, slopes, wasteland and beaches that have signed the contract have been idle for more than 2 years, they shall be recovered by the employer and re-contracted for lease. Eleventh in the key protected areas, without approval, no unit or individual may build permanent buildings.

Existing buildings or facilities that do not conform to the plan in key protected areas shall be demolished or relocated within the prescribed time limit. Twelfth all units and individuals have the obligation to protect the ecological environment of the reservoir area, and have the right to stop and report acts of pollution and destruction of the ecological environment. Thirteenth units and individuals in the reservoir development and construction projects, shall submit the project environmental impact assessment report and soil and water conservation plan report (table). The construction of villages and towns in the reservoir area should also meet the relevant requirements of the overall planning of the reservoir area. Fourteenth new construction, renovation and expansion projects in the reservoir area should strictly implement the examination and approval system of environmental impact assessment report (table) and water and soil conservation plan report (table). Construction shall not be carried out without approval.

Development and construction projects, in the process of its construction caused by vegetation destruction, environmental pollution, vegetation restoration and environmental pollution control or compensation by the project builders. It is forbidden to open up wasteland, cut down trees and graze at will.

It is forbidden to dig sand, quarry and borrow soil in key protected areas. Nineteenth reservoir soil and water conservation project management unit shall be responsible for the maintenance and management of the project, to ensure the normal operation of engineering facilities, prohibit the following acts:

(a) blasting rocks, drilling wells, building houses, piling up waste, etc. Within the scope of management and protection of soil and water conservation projects;

(two) damage or occupation of soil and water conservation projects, shipping terminal projects and their ancillary facilities;

(three) the purchase of soil and water conservation projects, shipping, power plant safety operation set up a variety of testing equipment, facilities and occupation of observation sites.
