Article 1 In order to strengthen the management of domestic waste, improve the living environment in urban and rural areas, and promote the construction of ecological civilization and the sustainable development of economy and society, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Law of the People's Republic of China on the Promotion of Circular Economy, and the Regulations on the Administration of City Appearance and Environmental Sanitation, combined with the actual situation of this province.
Article 2 These Regulations shall apply to the planning and construction of source reduction, classification, delivery, collection, transportation, treatment and related facilities and their supervision and management activities within the administrative area of this province.
The term "domestic waste" as mentioned in these Regulations refers to the solid waste generated in daily life or activities providing services for daily life, and the waste that is regarded as domestic waste according to laws and administrative regulations.
Article 3 The management of domestic waste shall follow the principles of government promotion, participation of the whole people, overall planning of urban and rural areas, suiting measures to local conditions and simplicity, and establish and improve the whole process classification system of domestic waste, such as classified delivery, classified collection, classified transportation and classified treatment, so as to promote the reduction, recycling and harmlessness of domestic waste.
Article 4 The people's governments at or above the county level shall strengthen their leadership over the management of domestic waste within their respective administrative areas, incorporate the management of domestic waste into the national economic and social development plan, establish and improve the comprehensive coordination mechanism of domestic waste management, and incorporate the required funds into the fiscal budget at the corresponding level. Domestic waste management should be included in the performance evaluation system of local governments.
Township People's governments and sub-district offices are responsible for the construction of classified delivery and collection facilities of rural domestic garbage within their respective jurisdictions, do a good job in the supervision of classified delivery, classified collection, classified transportation and other related work of domestic garbage in accordance with the requirements of the people's governments at higher levels, and guide the village (neighborhood) committees to do a good job in the reduction and classification of domestic garbage at the source.
Fifth provincial housing and urban construction departments are responsible for overall coordination and guidance of the province's domestic waste management, as well as urban domestic waste management; Provincial agricultural and rural authorities are responsible for the management of rural domestic waste in the province.
Districts of the city, county (city, district) city appearance and environmental sanitation department is responsible for the management of urban domestic waste within their respective administrative areas, districts of the city, county (city, district) agricultural and rural departments or other departments determined by the people's government at the same level are responsible for the management of rural domestic waste within their respective administrative areas; In areas where urban and rural integrated management of domestic waste is implemented, the competent department of city appearance and environmental sanitation is responsible for the management of domestic waste. The department responsible for the management of urban and rural domestic waste as stipulated in this paragraph is hereinafter referred to as the domestic waste management department.
The competent department of development and reform is responsible for coordinating the implementation of the extended producer responsibility system, improving the charging mechanism for domestic waste treatment, and formulating policies to promote the reduction, recycling and harmless treatment of domestic waste at the source in conjunction with relevant departments.
The competent department of economy and information technology is responsible for promoting the green packaging of products in the field of industry and information technology, cultivating leading enterprises for comprehensive utilization of renewable resources, and guiding relevant industrial enterprises to carry out comprehensive utilization of domestic waste.
The competent department of cultural tourism is responsible for the supervision and management of the source reduction and classified delivery of domestic waste in scenic spots and hotels (hotels).
The market supervision and management department is responsible for the supervision and management of the source reduction and classified delivery of domestic garbage in farmers' markets and agricultural products wholesale markets, and strengthens the supervision and management of over-packaging of commodities in conjunction with relevant departments.
The competent department of commerce is responsible for the supervision and management of source reduction and classified delivery of domestic waste in shopping malls, supermarkets and catering service places, establishing a recycling system coordinated with domestic waste recycling, rationally arranging recycling outlets of renewable resources, and promoting source reduction in the field of e-commerce.
The postal administration department is responsible for promoting the standardization, reduction and recycling of postal and express packaging.
The competent department of ecological environment is responsible for the supervision and management of pollution prevention and control of domestic garbage disposal.
Other relevant departments of the people's governments at or above the county level shall, in accordance with their respective duties, do a good job in the supervision and management of domestic waste in this industry.
The people's governments of cities and counties (cities, districts) with districts may, according to local conditions, make provisions on the specific responsibilities of relevant departments in the supervision and management of domestic waste.
Sixth village (neighborhood) committees should do a good job in the publicity and guidance of the source reduction and classified delivery of domestic waste, and organize, mobilize and urge the village (neighborhood) people to carry out the source reduction and classified delivery of domestic waste.
Encourage the reduction of domestic waste at the source, and incorporate the requirements of classified delivery into village regulations.
Seventh renewable resources, property services, environmental sanitation, ecological environment, accommodation, catering, e-commerce, express delivery, tourism, domestic service and other related industry associations. Industry self-discipline norms should be formulated, and member units should be urged and guided to carry out the work of source reduction and classified delivery of domestic waste.
Article 8 The science and technology department shall take measures to support the scientific and technological innovation in the classified treatment of domestic waste, popularize and apply advanced technologies, processes and equipment, promote the intelligent classification of domestic waste, and improve the level of reduction, recycling and harmless treatment of domestic waste.
Article 9 People's governments at all levels and relevant departments shall take measures to strengthen the propaganda of source reduction, whole-process classified management and resource utilization of domestic waste, and popularize the knowledge of domestic waste classification.
Guidance institutions for spiritual civilization construction should strengthen the publicity and education of civilized catering and refuse to waste, advocate a simple and moderate, green and low-carbon lifestyle, and incorporate the classification of domestic garbage into mass spiritual civilization creation activities.
Trade unions, * * * Communist Youth League, women's federations and other relevant people's organizations and mass organizations should give full play to their respective advantages, and promote the source reduction and classified delivery of domestic garbage.
Radio, television, newspapers, Internet and other news media should carry out public welfare propaganda on the knowledge of domestic waste classification and pollution prevention and control, enhance the awareness of source reduction and classification of domestic waste in the whole society, and conduct public opinion supervision on violations of domestic waste management.
Operators or managers of farmers' markets, wholesale markets for agricultural products, shopping malls, supermarkets, airports, stations, docks, tourist attractions, parks, accommodation service places, catering service places, public cultural facilities, entertainment places, etc. Domestic waste should be classified and publicized in various forms.
Article 10 The competent education department shall incorporate the knowledge of source reduction, classified release, recycling and harmless treatment of domestic waste into the educational contents of schools at all levels.
Encourage the management department of domestic waste to set up a popular science education base for domestic waste classification, and incorporate it into the social practice education base in accordance with the regulations.
Eleventh provincial housing and urban construction departments in conjunction with the provincial agricultural and rural departments to establish urban and rural domestic waste management information system. The municipal domestic waste management department with districts shall establish an information management system for the whole process of domestic waste source reduction, cleaning and cleaning, classified delivery, classified collection, classified transportation and classified treatment, and connect with the provincial urban and rural domestic waste management information system in real time.
Twelfth units and individuals should practice a green and low-carbon lifestyle, reduce the generation of domestic waste, develop the habit of domestic waste classification, fulfill the obligation of domestic waste classification according to law, and have the right to report units and individuals that violate the regulations on domestic waste management.
Guide and mobilize social organizations and volunteers to participate in the work related to domestic waste classification.
Chapter II Planning and Construction
Article 13 The management department of domestic waste shall, jointly with relevant departments, organize the preparation of special plans for domestic waste treatment in the local area according to the relevant national and provincial regulations and requirements, combined with the local population, region, domestic waste production and treatment objectives, and report them to the people's government at the same level for approval before implementation.
The special plan for the treatment of domestic waste shall conform to the land and space planning, and define the layout, scale and standards of the facilities for classified delivery, classified collection, classified transportation and classified treatment of domestic waste, as well as the recycling outlets of renewable resources, centralized sorting centers and trading markets.
The preparation of the special plan for domestic waste disposal shall take the form of seminars, demonstration meetings and hearings to listen to the opinions of experts and the public. The draft plan shall be publicized to the public for not less than twenty days.
Fourteenth domestic waste management departments shall, in conjunction with relevant departments, formulate annual plans for the construction of domestic waste classified delivery, classified collection, classified transportation and classified treatment facilities according to the special plan for domestic waste treatment.
Fifteenth new construction, renovation, expansion of residential quarters, public buildings, public places and other construction projects, should be in accordance with the relevant national and provincial standards, supporting the construction of domestic waste classification and collection facilities, and with the main project synchronous design, synchronous construction, synchronous put into use.
The existing domestic waste sorting and collection facilities do not meet the relevant national and provincial standards, and should be gradually transformed according to the prescribed standards; If it is really impossible to reform according to the prescribed standards, with the consent of the domestic waste management department, the necessary domestic waste sorting and collection facilities can be reasonably equipped according to the needs.
No unit or individual may shut down, leave idle, dismantle or relocate the facilities for classified delivery, collection and storage of domestic garbage or change their uses without authorization.
Chapter III Source Reduction
Article 16 People's governments at all levels shall establish a mechanism for reducing the source of domestic waste covering production, circulation, consumption and other fields, and take measures to guide units and individuals to use recyclable, recyclable and degradable products to reduce the generation of domestic waste and promote resource conservation and recycling.
Seventeenth this province implements a total amount control system for domestic waste treatment.
The Municipal People's Government with districts shall, according to the population size and the level of economic and social development in the region, formulate a total amount control plan for domestic waste disposal, which shall be implemented after being approved by the Provincial Department of Housing and Urban-Rural Development. The total amount control plan shall include the total amount of domestic waste treatment, source reduction, reduction measures and time limit requirements.
Eighteenth provincial standardization departments should organize the formulation of local standards related to green packaging according to the needs of industry development, and relevant departments should promote the effective implementation of local standards according to their respective responsibilities.
Product producers, sellers and related service providers shall implement the national and provincial regulations on restricting excessive packaging of products, and reduce the excessive use of packaging materials and the generation of packaging waste.
Encourage producers and sellers to take measures such as trade-in and direct recycling to recycle their products and packaging. Enterprises that produce, sell or import products and packages listed in the compulsory recycling catalogue according to law shall recycle products and packages in accordance with relevant state regulations.
Article 19 Operators in e-commerce, express delivery, take-away and other industries should give priority to using green certified electronic waybills, adhesive tapes, packing boxes (bags) and other packaging products, provide recyclable packaging bags, actively recycle packaging materials, establish and apply systems such as points and preferential pricing, and guide consumers to use green packaging and reduced packaging.
Operators in e-commerce and take-away industries should use packaging materials with specifications and strength meeting the requirements of express delivery packaging to avoid or reduce the secondary packaging of express delivery enterprises.
Twentieth prohibit or restrict the production, sale and use of some plastic products. Prohibit or restrict the production, sale and use of plastic products directory and time requirements, by the provincial development and reform department in conjunction with the relevant departments in accordance with the provisions of the state combined with the actual situation of this province, and announced to the public.
No unit or individual may produce, sell or use plastic products in violation of the provisions of the preceding paragraph.
People's governments at all levels and relevant departments shall take measures to promote the application of recyclable, easily recyclable and degradable substitute products.
Business, market supervision and management, cultural tourism, agriculture and rural areas, postal management and other departments shall, in accordance with the responsibilities stipulated by the state and the province, do a good job in the supervision and management of prohibiting and restricting the production, sale and use of plastic products.
Twenty-first catering service providers should set up a sign of saving meals in a prominent position in catering service places, and guide consumers to rationally consume, order food moderately, pack after meals, and leave the table CD; Catering service places shall not provide disposable tableware voluntarily or free of charge, except those packaged after meals.
State organs, institutions and state-owned enterprises should take the lead in frugal and civilized catering, provide meals in accordance with the principles of health and simplicity, establish a dynamic management system for meals, prepare meals on demand and provide meals on demand, and put an end to food waste.
Accommodation service providers such as hotels (hotels) and homestays are not allowed to provide disposable items on their own initiative. Encourage hotels, homestays and other accommodation service providers to provide recyclable and hygienic consumer goods.
Twenty-second government procurement should give priority to the procurement of recyclable products, and gradually reduce the proportion of disposable goods.
State organs, institutions and state-owned enterprises should take the lead in using products, equipment and facilities that are conducive to environmental protection, increase the proportion of recycled paper, promote paperless office, reduce the use of disposable office supplies, and disposable cups should not be used in internal offices.
Encourage enterprises and social organizations to save and reuse office supplies and reduce the use of disposable supplies.
Twenty-third agricultural and rural areas, market supervision and management, commerce and other departments shall, according to their respective responsibilities, strengthen the management of fruit and vegetable production bases, farmers' markets, agricultural products wholesale markets, shopping malls and supermarkets, and promote the listing of clean vegetables and the entry of clean agricultural and sideline products into cities.
Conditional farmers' markets, agricultural products wholesale markets, shopping malls, supermarkets, etc. It can build perishable garbage treatment facilities that meet the specified requirements, establish corresponding management systems and ledgers, and treat perishable domestic garbage on the spot according to technical specifications and operating procedures.
In remote mountainous areas, islands and sparsely populated areas, agricultural and rural departments can organize the construction of perishable domestic garbage treatment facilities, and implement local resource utilization or harmless treatment according to local conditions. Township people's governments and sub-district offices are responsible for the operation and maintenance of rural perishable domestic waste treatment facilities.
Article 24 The competent commercial departments of cities and counties (cities, districts) divided into districts shall, jointly with the domestic waste management departments at the same level, promote the construction of renewable resource recycling outlets, centralized sorting centers and trading markets according to the special planning of domestic waste treatment in the region and the principle of overall planning and rational layout of urban and rural areas. The construction and operation of recycling outlets, centralized sorting centers and trading markets shall comply with the relevant provisions on environmental protection, safety and fire control.
The people's governments at or above the county level shall formulate special policies to support the recycling of renewable resources and promote the recycling of low-value recyclable materials in domestic garbage. The catalogue of low-value recyclable materials shall be formulated by the provincial commerce department in conjunction with the domestic waste management and finance departments at the same level.
Twenty-fifth guide and encourage leading enterprises in recycling renewable resources to establish a recycling network with reasonable layout, convenient sale and orderly acquisition through chain operation and authorized operation, so as to improve the level of intensification and scale.
Encourage the establishment of convenient recycling points in residential areas, villages, shopping malls, supermarkets and other places, and recycle renewable resources through trade-in, automatic recycling machines, online shopping and distribution of recycling packages.
Encourage renewable resource recycling operators to adopt modern information technology and recycle renewable resources through intelligent recycling.
Chapter IV Classified Delivery
Twenty-sixth domestic waste in this province is divided into the following four categories:
(1) Recyclable refers to domestic garbage that can be recycled, mainly including discarded paper, plastics, metals, packaging materials, textiles, electrical and electronic products, glass, etc. ;
(2) Perishable garbage refers to perishable domestic garbage generated in production and operation and daily life of residents, including discarded vegetables, fruits, meat, aquatic products, rice and flour food, edible oil, roasted seeds and nuts, etc. ;
(3) Hazardous waste refers to domestic waste that directly or potentially harms human health or the natural environment, mainly including waste batteries (nickel-cadmium batteries, mercury oxide batteries, lead batteries, etc. ), fluorescent tubes, mercury-containing thermometers, mercury-containing sphygmomanometers, drugs and their packaging, paints, solvents and their packaging, pesticides, disinfectants and their packaging, films and photographic papers.
(4) Other garbage refers to other domestic garbage except recyclable, perishable and hazardous wastes.
The competent department of housing and urban and rural construction of the province shall, in accordance with the provisions of the preceding paragraph, jointly with the relevant departments of the province, formulate and publish the catalogue for guiding the classification of domestic waste. The Municipal People's Government with districts may refine the classification according to the guidance catalogue and the actual situation in the region.
Promote the establishment of a waste classification and labeling system, and producers and sellers will gradually set up eye-catching waste classification and labeling on product packaging.
Twenty-seventh units and individuals that produce domestic garbage have the responsibility to classify domestic garbage. Domestic garbage shall be put into corresponding collection containers in accordance with regulations, and shall not be thrown, dumped, piled up or burned at will.
Twenty-eighth signs and signs of garbage collection containers shall comply with the relevant provisions of the state or province.
Encourage producers and operators engaged in environmental protection and recycling of renewable resources to set up special collection containers for specific types of recyclables and hazardous wastes.
Twenty-ninth urban residential areas and other residential areas should be classified to set up garbage collection containers such as recyclable, perishable and hazardous waste. Conditional residential quarters can set up special collection containers according to the specific types of recyclables and hazardous wastes.
Villages should classify perishable garbage and other garbage and set up collection containers, and set up collection containers for recyclables and hazardous wastes as needed.
Catering service places, farmers' markets, agricultural products wholesale markets and cold chain warehousing and logistics enterprises shall set up garbage collection containers such as perishable garbage; Among them, the perishable garbage collection containers set up in catering service places should be sealed.
Public buildings, public places, urban roads and commercial facilities shall be provided with recyclable materials and other garbage collection containers.
Thirtieth the establishment of domestic waste classification management responsibility area system, all kinds of responsibility area management responsible person in accordance with the following provisions:
(a) the residential area of the realty service enterprise, which is responsible for the realty service enterprise; The owners' committee is responsible for the self-management of residential quarters; The village (neighborhood) committees shall be responsible for the residential areas that have not hired property service enterprises or established owners' committees;
(two) office buildings, shopping malls, all kinds of markets, accommodation, catering and other business places, by the management unit;
(three) subway stations, airports, stations, docks, parking lots, bus stations and their management scope, by the management unit;
(four) railways, highways, urban roads, subways, tunnels, underground passages, rivers, lakes and other waters, which are in the charge of the management unit;
(five) parks, squares, tourist attractions, public cultural facilities, entertainment venues and other public places, by the management unit;
(six) the construction site of the construction project shall be the responsibility of the construction unit, and the land for the construction project that has not yet started shall be the responsibility of the construction unit;
(seven) the administrative areas of organs, organizations, military units, schools, hospitals and other enterprises and institutions shall be in charge of this unit;
(eight) the village road, by the villagers committee is responsible for.
In accordance with the provisions of the preceding paragraph, the person in charge of management cannot be determined, or the relevant units have objections to the determination of the person in charge of management, which shall be determined by the local township people's government and sub-district offices; Cross administrative regions, determined by the relevant people's government through consultation; If negotiation fails, it shall be decided jointly by the domestic waste management department at the next higher level and * * * *.
Thirty-first domestic waste classification management responsible person shall perform the following obligations:
(a) the establishment of domestic waste classification responsibility system and daily management system;
(two) to carry out the knowledge propaganda of domestic waste classification, and to guide and supervise the units and individuals to classify domestic waste;
(three) in accordance with the relevant provisions, set up, clean and maintain domestic garbage collection containers;
(4) handing over the classified domestic garbage to the domestic garbage collection and transportation unit that meets the prescribed conditions;
(five) to persuade the units and individuals that do not put domestic garbage in accordance with the regulations, and urge them to make corrections; Refuses to correct, promptly report to the local township people's government, street offices or domestic waste management departments.
Township people's governments and sub-district offices shall supervise the management responsible persons within their respective jurisdictions to perform their management duties, and shall be punished according to law in violation of the provisions on classified delivery of domestic waste, and shall report to the domestic waste management department in a timely manner. If the property service enterprise is the person in charge of management, the property administrative department shall incorporate the performance of its management duties into the content of industry supervision.
Chapter V Classified Collection, Transportation and Disposal
Thirty-second municipal solid waste, the city appearance and environmental sanitation department is responsible for organizing the collection and transportation. Units engaged in the collection and transportation of municipal solid waste shall meet the conditions prescribed by the state.
Village committees are responsible for organizing the collection of rural domestic garbage, and township people's governments and sub-district offices are responsible for organizing transportation.
Thirty-third units that collect and transport domestic garbage shall abide by the following provisions:
(a) the use of sealed cars and boats that meet the requirements of the classification marks and labels of domestic waste;
(two) the classified collection of domestic garbage shall be transported to the designated place according to the prescribed frequency and time, and the domestic garbage shall not be discarded or left behind along the way;
(three) shall not be classified and mixed collection and transportation of domestic garbage;
(four) establish a management ledger, record the source, category, quantity and destination of domestic waste, and submit information to the domestic waste management department on a regular basis.
Domestic waste collection and transportation units found that the domestic waste delivered by the person in charge of domestic waste classification was not classified according to the provisions, and should report to the local township people's government, neighborhood offices or domestic waste management departments in a timely manner.
Thirty-fourth people's governments at all levels or domestic waste management departments can carry out the cleaning, collection, transportation and treatment of domestic waste by purchasing services.
Encourage and support social capital to participate in the cleaning, collection, transportation and treatment of domestic garbage. People's governments at or above the county level can guide social capital to participate in the construction, renovation and operation management of domestic waste sorting facilities through franchising and cooperation between government and social capital.
Article 35 Domestic garbage shall be classified according to the following provisions:
(1) Recycling recyclable materials;
(two) perishable garbage through composting, anaerobic biogas production, biochemical treatment and other ways to make resources or harmless treatment;
(three) the hazardous waste in the city shall be treated harmlessly in accordance with the relevant provisions of the state and province; If it belongs to hazardous waste, it shall be treated as hazardous waste;
(four) other garbage through incineration, power generation and other ways to resource and harmless treatment.
Waste electrical and electronic products in domestic garbage shall be disposed of in accordance with relevant laws and regulations.
Except for emergency disposal, domestic garbage shall not be disposed of in landfill.
Thirty-sixth fly ash generated by domestic waste incineration facilities shall be treated harmlessly in accordance with the provisions of the state and the province on hazardous waste.
Article 37 Waste furniture and other bulky garbage with strong integrity can be recycled by making an appointment with recycling operators, or put in the place designated by the person in charge of domestic waste management in this area, and then recycled or treated harmlessly after classified collection, classified transportation and diversion.
Township people's governments and sub-district offices shall set up places for storing, transporting or sorting large pieces of garbage according to local conditions.
Thirty-eighth domestic waste disposal units shall comply with the following provisions:
(a) to maintain the normal operation of domestic waste treatment facilities and equipment, and to receive and treat domestic waste in accordance with relevant national and provincial standards;
(two) in accordance with technical specifications, operating procedures and pollution control standards, timely treatment of waste water, waste gas and waste residue;
(3) Establish a management ledger, truthfully record the source, type, quantity, destination and other information of the received recycled products, and submit the information to the domestic waste management department on a regular basis;
(four) establish and improve the environmental information disclosure system, and disclose the main pollutant emission data and environmental testing information of domestic waste treatment facilities to the public according to law.
Article 39 The municipal people's government divided into districts shall establish a charging system for domestic garbage disposal according to the principle that whoever produces it pays and whoever pays more.
The standards and methods of domestic waste treatment fees should be formulated according to local conditions, combined with the classification of domestic waste, reflecting differentiated management such as classified pricing and metering fees, and fully soliciting public opinions.
Units and individuals shall pay the domestic garbage disposal fee in accordance with the charging standards and charging methods stipulated by the Municipal People's Government with districts.
Fortieth domestic waste management departments should prepare emergency plans for domestic waste treatment and establish emergency mechanisms for domestic waste collection, transportation and treatment.
In case of unexpected events leading to the failure of normal collection, transportation or treatment of domestic waste, the relevant units shall immediately report to the domestic waste management department, which shall timely organize the disposal according to the emergency plan.
Article 41 The people's governments of cities and counties (cities, districts) divided into districts shall, in accordance with the principle of regional overall planning and * * * construction, establish a compensation mechanism and an emergency linkage mechanism for cross-regional treatment of domestic garbage.
Where domestic garbage is transferred across administrative regions at or above the county level, an agreement shall be reached through consultation between the transferor and the local people's government of the recipient. The people's government at the place where the relocation party is located shall compensate the people's government at the place where the receiving party is located by means agreed by both parties according to the transfer capacity.
Chapter VI Legal Liability
Forty-second acts in violation of the provisions of this Ordinance, the relevant laws and administrative regulations have legal liability provisions, from its provisions.
Forty-third in violation of the provisions of the second paragraph of article thirteenth of this Ordinance, the sale of plastic products, the market supervision and management department shall order it to correct, and impose a fine of not less than five thousand yuan but not more than fifty thousand yuan; If the circumstances are serious, a fine of not less than 50,000 yuan but not more than 100,000 yuan shall be imposed.
Forty-fourth in violation of the provisions of the first paragraph of Article 21 of these regulations, catering service providers provide disposable tableware voluntarily or free of charge, and the commercial and market supervision and management departments shall order them to make corrections; If the circumstances are serious, the market supervision and management department shall impose a fine of more than 1000 yuan and less than 10000 yuan.
In violation of the provisions of the third paragraph of article twenty-first, hotels (hotels) provide disposable supplies, which shall be ordered by the competent department of cultural tourism to make corrections; If the circumstances are serious, a fine of not less than 1,000 yuan but not more than 10,000 yuan shall be imposed.
Forty-fifth in violation of the provisions of the provisions of article twenty-seventh, the units and individuals did not classify the domestic waste, and the domestic waste management department shall order them to make corrections within a time limit; If the circumstances are serious, a fine of more than 200 yuan and less than 2,000 yuan shall be imposed on individuals, and a fine of more than 50,000 yuan and less than 500,000 yuan shall be imposed on units.
Forty-sixth in violation of the provisions of the first paragraph of Article 31 of these regulations, the person in charge of domestic waste classification management fails to perform the responsibility of domestic waste classification management, and the domestic waste management department shall order it to make corrections, and may impose a fine of more than 5,000 yuan in 500 yuan; If the circumstances are serious, a fine of not less than 5,000 yuan but not more than 30,000 yuan shall be imposed.
Article 47 In violation of the provisions of the first paragraph of Article 33 of these regulations, if the vehicles and boats used by domestic waste collection and transportation units do not meet the specified requirements, the domestic waste management department shall order them to make corrections and impose a fine of not less than 3,000 yuan but not more than 30,000 yuan.
In violation of the provisions of Item 2 and Item 3 of Paragraph 1 of Article 33 of this Ordinance, if the domestic garbage collection and transportation unit fails to transport the domestic garbage to the designated place in accordance with the prescribed frequency and time, or collects and transports the domestic garbage in a mixed way, the domestic garbage management department shall order it to make corrections and impose a fine of not less than 5,000 yuan but not more than 50,000 yuan; If the circumstances are serious, a fine of not less than 50,000 yuan but not more than 500,000 yuan shall be imposed.
Forty-eighth in violation of the provisions of the second paragraph of article thirty-eighth, the domestic waste disposal unit fails to deal with domestic waste in accordance with technical specifications and operating procedures, and the domestic waste management department shall order it to make corrections; If the circumstances are serious, a fine of 1 10,000 yuan or more and10,000 yuan or less shall be imposed.
Forty-ninth acts of administrative punishment in violation of the provisions of these regulations, which belong to the bad information stipulated in the Regulations of Zhejiang Province on the Administration of Public Credit Information, shall be recorded in the credit files in accordance with the relevant provisions.
Fiftieth domestic waste management departments and other relevant departments, township people's governments, sub-district offices and their staff have one of the following acts, and the competent department shall order them to make corrections; If serious consequences are caused, the directly responsible person in charge and other directly responsible personnel shall be punished by the competent authority according to law:
(a) failing to carry out publicity, education and training on the classification of domestic waste in accordance with the provisions;
(two) failing to perform the duties of supervision and management of domestic waste according to law;
(3) Failing to investigate and handle relevant complaints and reports according to law;
(four) other dereliction of duty, abuse of power, corruption.
Chapter VII Supplementary Provisions
Article 51 The term "municipal solid waste" as mentioned in these Regulations refers to the built-up areas of cities, towns (central cities) where the county people's governments are located and other towns within the administrative region of this province, areas where urbanization management is implemented such as economic development zones and industrial parks, and domestic waste in other areas designated and announced by the people's governments at or above the county level.
The term "rural domestic garbage" as mentioned in these Regulations refers to the domestic garbage in other areas outside the scope specified in the preceding paragraph.
Article 52 These Regulations shall come into force on May 1 20265438. The Measures for the Classified Management of Urban Domestic Waste in Zhejiang Province promulgated by the People's Government of Zhejiang Province shall be abolished at the same time.
