Township (town) people's governments and sub-district offices are responsible for the prevention and control of air pollution in their respective jurisdictions. Article 5 The competent department of ecological environment administration of the people's government at or above the county level shall exercise unified supervision and management over the prevention and control of air pollution.
Other relevant administrative departments of the people's governments at or above the county level shall, in accordance with the provisions of these regulations and their respective responsibilities, supervise and manage the prevention and control of air pollution. Article 6 This province implements the system of total amount control and concentration control of air pollutants. The discharge of pollutants into the atmosphere shall conform to the national and local emission standards and the total emission control indicators of major air pollutants. Article 7 People's governments at or above the county level and their relevant departments shall take measures to encourage and support scientific and technological research on the prevention and control of air pollution, train environmental protection professionals, popularize advanced and applicable technologies and develop environmental protection industries. Article 8 Units and individuals have the right and obligation to protect the atmospheric environment. Have the right to report and accuse acts of polluting the atmospheric environment, and have the right to report and accuse the departments exercising supervision and management rights and their staff members of failing to perform their duties according to law; Abide by the laws and regulations on the prevention and control of air pollution, consciously fulfill the legal obligations and professional ethics of air pollution prevention and control, establish the awareness of atmospheric environmental protection, practice the green lifestyle, and reduce the discharge of pollutants into the atmosphere.
People's governments at or above the county level shall encourage and support social organizations and the public to participate in public welfare activities for the prevention and control of air pollution, and may employ social supervisors to help supervise the prevention and control of air pollution. Article 9 People's governments at all levels and their administrative departments, social organizations, schools, news media, mass autonomous organizations and other units shall carry out publicity and education on laws and regulations on the prevention and control of air pollution and popular science knowledge, advocate civilized, economical and green consumption patterns and living habits, and promote the formation of an atmosphere in which the whole society protects the atmospheric environment. Chapter II General Provisions Article 10 The competent department of market supervision and management and ecological environment administration of the province may, in accordance with the law and in combination with the atmospheric environmental quality and economic and technical conditions of the province, formulate and publish atmospheric environmental quality standards, atmospheric pollutant emission standards and harmful substances control standards in coal and fuel that are higher than the national standards. Article 11 The municipal people's governments of provinces and districts and their relevant departments shall, when organizing the preparation of special plans related to industry, energy, transportation, urban construction, natural resources development, etc., comprehensively consider the possible impact of the implementation of the plans on the atmospheric environment, and conduct environmental impact assessment according to law before reporting for examination and approval. Twelfth new construction, expansion and reconstruction projects, environmental impact assessment should be carried out according to law.
After the competent administrative department of ecological environment at or above the county level publicizes the acceptance of the environmental impact report of the construction project, if the public has great opinions or thinks that it has a significant impact on the atmospheric environment, it shall organize a hearing to openly listen to the opinions of interested parties and the public, and the results of the hearing shall serve as an important basis for approving the environmental impact assessment.
The competent administrative department of ecological environment at or above the county level shall not approve the environmental impact assessment documents of construction projects that have not obtained the total emission index of major air pollutants. Article 13 The air pollution prevention and control facilities of a construction project shall be designed, constructed and put into use at the same time as the main project, and meet the requirements of environmental impact assessment documents.
Units that discharge pollutants into the atmosphere shall ensure the normal operation of air pollution prevention and control facilities and shall not dismantle or stop operation without authorization. Fourteenth enterprises, institutions and other producers and operators that discharge pollutants into the atmosphere shall set up air pollutant discharge outlets in accordance with the provisions of the state and this province.
It is forbidden to use the emergency discharge channel of air pollutants or take other means to evade supervision for the purpose of evading supervision in non-emergency situations. Fifteenth enterprises, institutions and other producers and operators that discharge pollutants into the atmosphere shall pay environmental protection tax according to law. Article 16 Enterprises and institutions that discharge industrial waste gas and air pollutants containing toxic and harmful substances into the atmosphere, operating units of central heating facilities and other enterprises and institutions that need to obtain pollutant discharge permits shall, before discharging air pollutants, apply to the competent administrative department of ecological environment at or above the county level for pollutant discharge permits according to law.
The pollutant discharge permit shall specify the name, type, concentration, total amount and reduction, discharge mode, control measures and monitoring requirements of pollutants.
The total emission and reduction shall be approved by the competent department of ecological environment administration at or above the county level according to the total emission plan of air pollutants and relevant technical specifications.
Units that discharge pollutants into the atmosphere shall take measures such as technological transformation and improvement of environmental protection facilities, and implement the approved total emission control targets and the reduction of major air pollutants.
