Measures for the implementation of the minimum living guarantee for urban residents in Tangshan City

Article 1 In order to standardize the minimum living guarantee system for urban residents and ensure the basic living of urban residents in this Municipality, these Measures are formulated in accordance with the Regulations of the State Council on Minimum Living Guarantee for Urban Residents and the Measures for the Implementation of Minimum Living Guarantee for Urban Residents in Hebei Province, combined with the actual situation of this Municipality.
Article 2 All families with agricultural registered permanent residence within the administrative area of this Municipality and whose per capita monthly income is lower than the local minimum living standard can enjoy the minimum living guarantee in accordance with these measures.
Article 3 The people's governments at all levels shall be responsible for the minimum living guarantee for urban residents.
City, county (city), the District Civil Affairs Department is responsible for the management of the minimum living guarantee for urban residents within their respective administrative areas; City, county (city), district finance, statistics, prices, auditing, labor and social security departments, within the scope of their respective duties, responsible for the work related to the minimum living guarantee for urban residents.
Street offices and township (town) people's governments are responsible for the specific management of the minimum living guarantee for urban residents.
Community residents' committees (including residents' committees or family members' committees and villagers' committees) are entrusted by the civil affairs departments to undertake the daily service of the minimum living guarantee for urban residents.
Article 4 The minimum living guarantee system for urban residents adheres to the principle of combining government guarantee with social assistance and encouraging self-help through labor.
Fifth people's governments at all levels should strengthen the construction of the minimum living security institutions for urban residents and ensure the funds needed for the work.
Article 6 The funds needed for the minimum living guarantee for urban residents shall be included in the fiscal budget by the people's government at the same level, and shall be managed by special accounts for special purposes.
Seventh in violation of the relevant provisions of the minimum living guarantee for urban residents, any unit or individual has the right to report and accuse to the civil affairs department or other relevant departments.
Article 8 The minimum living standard for urban residents shall be formulated by the municipal and county (city) civil affairs departments in conjunction with the finance, statistics, price and other departments at the same level, and shall be implemented after the approval of the people's government at the same level, according to the expenses of clothing, food and housing necessary for the basic living of local urban residents, and with due consideration for the expenses of water, electricity, gas (coal burning) and education for minors.
When the minimum living standard for urban residents needs to be adjusted, it shall be re-approved in accordance with the provisions of the preceding paragraph.
Article 9 A family refers to a social life organization between relatives who have legal support, support and maintenance relationships based on legal facts such as marriage, consanguinity and adoption.
A family consists of the following members:
(1) husband and wife;
(2) Parents or adult children living together;
(3) Unpaid income that minor children or adult children need to be supported by their parents when they go to university abroad;
(4) Other persons who have the relationship of maintenance, support and maintenance as stipulated by law.
Article 10 The income of family members includes the following:
(1) Wages, bonuses, allowances and subsidies;
(2) Retirement fees, resignation fees, basic living expenses for laid-off workers, one-time economic compensation for the termination of labor contracts, unemployment insurance benefits and subsidies for workers' survivors;
(3) alimony, alimony and alimony;
(four) other family income should be calculated.
Regular pensions, regular quantitative subsidies, disability pensions (health care payments) and preferential payments enjoyed by entitled groups are not included in family income.
Eleventh family members per capita monthly income is calculated according to the actual income.
(a) the actual income of employees is calculated according to the standard wage of the employer or the amount agreed in the labor contract;
(two) the actual income of laid-off workers, unemployed workers and those who receive retirement and resignation fees is calculated according to the relevant standards published by the government;
(3) Laid-off workers and unemployed people who have other incomes during the period of receiving basic living expenses and unemployment insurance benefits, or unemployed people who are self-employed, shall be calculated according to the local minimum wage standard determined by this province.
Twelfth city residents to apply for minimum living security, should apply to the local community residents committee and provide the following documents:
(1) an application;
(two) proof of household registration and family income;
(3) Other certificates related to examination and approval.
Thirteenth community residents' committees shall, within seven days after receiving the application, investigate and verify the applicant's family economic situation and actual living standard, and report it to the neighborhood office or the township (town) people's government for examination after discussion and consent by the residents' representatives.
Sub-district offices or township (town) people's governments shall complete the publicity and audit work within fifteen days after receiving the application materials, and report the audit opinions to the civil affairs department of the people's government at the county level for approval.
The civil affairs department of the people's government at the county level shall make a decision on whether to approve the application of the minimum living guarantee applicant within seven days. Meet the conditions, issued a "Tangshan city residents minimum living guarantee card"; Do not meet the conditions, notify in writing and explain the reasons.
Fourteenth approved to enjoy the minimum living allowance for residents, according to the following provisions:
(a) for urban residents without family income, give full subsidies in accordance with the local minimum living standard for urban residents;
(two) for urban residents who still have a certain income, but their family income is not up to the minimum living standard, the difference subsidy shall be given according to the local minimum living standard for urban residents.
Fifteenth any of the following circumstances, shall not enjoy the minimum living allowance:
(a) the actual living standard of the family is significantly higher than the local minimum living standard;
(two) the applicant and his family members refused or did not cooperate with the minimum security staff to investigate and verify the relevant situation;
(three) laid-off, unemployed and unemployed people who have the ability to work twice refused to accept employment introduction from labor service agencies.
Sixteenth urban residents enjoy the minimum living allowance for urban residents from the second month approved by the civil affairs department, and the security fund is paid monthly by the subdistrict office or the township (town) people's government.
Seventeenth enjoy the protection of family income changes, should take the initiative to report the changes to the community residents committee.
Neighborhood offices or township (town) people's governments shall organize community residents' committees to review the protection of families on a quarterly basis. Do not meet the conditions, approved by the civil affairs department at the county level to stop the payment of security funds, and to recover or cancel its "Tangshan city residents minimum living guarantee certificate"; To still meet the conditions, but the family income changes, according to the procedures for security reduction procedures.
Eighteenth street offices, township (town) people's governments or community residents' committees shall establish and improve the minimum living security public welfare activities stations and points, and organize public welfare activities or labor at least once a month.
Urban residents who have the ability to work within the age of employment but are not yet employed shall participate in public welfare activities or labor regularly organized by the community residents' committees in their places of residence during the period of enjoying the minimum living guarantee for urban residents.
If the minimum living security object does not participate in community public welfare activities or labor for two consecutive times without justifiable reasons, the family security fund for that month will be cancelled.
Nineteenth city minimum living guarantee object with the "Tangshan city residents minimum living guarantee Jinling evidence" and ID card to enjoy the following benefits:
(a) children go to school, reduce fees;
(two) to the hospital registration fee, enjoy the treatment of poverty alleviation ward.
Twentieth city residents minimum living security staff have one of the following acts, shall be given administrative sanctions by the civil affairs department or the supervision department; Suspected of a crime, transferred to judicial organs:
(1) Failing to sign a consent form for families meeting the minimum living guarantee conditions for urban residents, or deliberately signing a consent form for families not meeting the minimum living guarantee conditions for urban residents;
(two) false, impersonator security;
(three) dereliction of duty, embezzlement, misappropriation, withholding, arrears of the minimum living guarantee for urban residents.
Twenty-first residents who enjoy the minimum living allowance for urban residents have one of the following acts, and the civil affairs department of the people's government at the county level shall give criticism and education to recover the security fund they have applied for; If the circumstances are bad, a fine of more than one time and less than three times the amount of impersonator shall be imposed:
(a) take false, concealment, forgery and other means to cheat to enjoy the minimum living allowance for urban residents;
(two) during the period of enjoying the minimum living allowance for urban residents, the family income has improved, and the management examination and approval authorities have not been informed in accordance with the regulations, and they continue to enjoy the minimum living allowance for urban residents.
Twenty-second units or individuals that provide false certificates for applying for the minimum living guarantee for urban residents shall be given a warning by the civil affairs department of the people's government at the county level and may be fined 1000 yuan.
Article 23 Whoever refuses to accept the decision made by the civil affairs department of the people's government at the county level not to approve the enjoyment of the minimum living allowance for urban residents or to reduce or stop the minimum living allowance for urban residents and the administrative punishment given may apply for administrative reconsideration according to law; If you are still dissatisfied with the reconsideration decision, you may bring an administrative lawsuit according to law.
Article 24. Abuse, beating the minimum living security staff of urban residents, disturbing the office order, refusing or obstructing the staff of state organs to perform official duties according to law, shall be punished by the public security organs in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security; Those suspected of committing a crime shall be transferred to judicial organs for handling.
Twenty-fifth counties (cities) can formulate detailed rules for implementation according to these measures.
Twenty-sixth the implementation since February 6, 2003. The original Interim Measures for the Minimum Living Security for Urban Residents in Tangshan (Tang [1998] No.24) and the Detailed Rules for the Implementation of the Minimum Living Security for Urban Residents in Tangshan (Tang Zhengban [1998] No.7) shall be abolished at the same time.

In order to better standardize the minimum living guarantee for urban residents in our city, according to the Operating Rules for Minimum Living Guarantee for Urban Residents in Hebei Province and the Measures for Minimum Living Guarantee for Urban Residents in Tangshan City, the Operating Rules for Declaration, Approval and Management of Minimum Living Guarantee for Urban Residents in Tangshan City are formulated.
I. Application
(1) application conditions
Where the administrative area of this Municipality has permanent residence in cities and towns and the per capita monthly income of family members is lower than the local minimum living standard, families can apply for minimum living standard to the community neighborhood committee where the household registration is located.
In any of the following circumstances, it does not meet the minimum requirements:
1. Unemployed, unemployed and laid-off workers who have the ability to work within the working age refuse to accept employment positions provided by employment agencies for three times without justifiable reasons;
2, drug abuse, gambling and still do not repent;
3. Children choose schools at their own expense;
4, the per capita use area of family housing exceeds the local per capita use area by more than 3 times (if the family population is less than 3 people, it will be counted as 3 people) or newly renovated housing within two years;
5. Owning and using high-end consumer goods such as automobiles, motorcycles and air conditioners, and drinking pure water, mineral water and other household consumption levels are significantly higher than the minimum living standard;
6. The total monthly telephone consumption (including monthly rent) is higher than the local minimum living standard18% for two consecutive months;
7. Collecting or investing in securities with high value.
8. Frequent visits to restaurants and entertainment places for consumption;
9, the applicant and his family members refused or did not cooperate with the minimum security staff to investigate and verify the situation or provide false proof materials;
10, whose minimum living allowance qualification has been cancelled for less than half a year due to failure to fulfill the obligations promised by the minimum living allowance object;

(2) materials required by the applicant
The applicant shall submit a written application for enjoying the subsistence allowance to the community neighborhood committee where the household registration is located (the style is attached). The written application must specify the age, relationship with the head of the household, physical condition, work unit, income, home address and housing situation of each family member. If there are dependents, also write down the income of the dependents and their spouses. At the same time, provide the following supporting materials:
1, ID card, household registration book, real estate license and their copies;
2. If family members and their dependents have a work unit or have left or retired, they must provide an employee income survey letter filled out by the work unit or the endowment insurance institution;
3 laid-off workers should provide proof of laid-off unemployment and relevant proof materials of their income;
4. If the family members and their dependents are self-employed, the market management department of the place of residence or the community neighborhood committee or street office shall issue relevant certificates of income;
5. If the domicile is inconsistent with the place of residence, apply to the community neighborhood committee where the domicile is located every year, and provide proof of family income and living conditions issued by the community neighborhood committee of the place of residence;
6. Other relevant certificates that need to be provided. Such as: student's school certificate, employee's survivor's allowance certificate, etc.
Second, the identification of family members.
Family members generally include people who have legal support (support, support) and live together.
Identification of family members under special circumstances:
(1) Husband, wife and their minor children, whether they live together or not, are regarded as the same family;
(two) there are students in the family who are studying in foreign universities, and they can be regarded as family members with the school certificate;
(three) adults who have established a family, although the household registration and the dependents are in the same household registration book, but do not live together, can be counted separately as independent families;
(four) people who have no legal support (support, support) live together and are not regarded as family members;
(five) missing, absconding, serving a sentence is not regarded as family members.
Third, the calculation of family income.
The calculation of family members' income follows the principle of "calculation according to actual income". On-the-job employees who apply for the minimum living guarantee shall be calculated according to the standard salary of the employer or the amount agreed in the labor contract (except for pension insurance, medical insurance, unemployment insurance and housing accumulation fund that individuals should pay); Laid-off workers from state-owned enterprises and those who receive unemployment insurance benefits and pensions shall calculate their income according to the relevant standards promulgated by the government.
In special circumstances, such as the actual income is difficult to verify, the income shall be verified according to the following funds:
(a) the on-the-job workers and laid-off workers of state-owned enterprises, due to long-term losses, suspension of production, semi-suspension of production and other reasons, have not received wages or basic living expenses in full for more than six consecutive months, and can not be reissued after being confirmed by the local labor and social security and economic and trade departments and issued with certificates, according to the actual income;
(II) If the laid-off workers of state-owned enterprises have other income through self-employment after receiving the basic living expenses for laid-off, their income (the sum of living expenses of laid-off workers and self-employment income, the same below) shall be calculated from the minimum wage standard;
(three) the unemployed have other income during the period of receiving unemployment insurance benefits, and their income is calculated according to the minimum wage standard;
(4) Healthy young adults (male 18-52 years old, female 18-48 years old) who have neither self-employed nor applied for employment, their income is calculated according to the minimum living standard (except those who have babies or patients to take care of at home). Because there are no jobs and can not be employed, with the proof of the labor and employment department can be calculated according to the actual income.
(five) self-employed, with relatively stable working hours or workplaces, with the minimum wage as the starting point to calculate income. Temporary employment, no stable working hours or workplace, income is calculated according to the minimum living standard. If it is difficult to verify the income of self-employed persons with disabilities, their income shall be appropriately reduced in accordance with the provisions of this paragraph;
(six) the one-time economic compensation and resettlement fees obtained by the employees of the enterprise after the termination of labor relations shall be deducted from the social endowment insurance premiums payable from the date of termination of labor relations to the statutory retirement age, and the balance shall be used for family life. Only after deduction according to the minimum living standard can you apply for minimum living allowance (except that the compensation is used to purchase means of production and engage in production and operation);
(seven) due to urban construction, reconstruction, demolition and other reasons to receive a one-time housing demolition compensation income, the purchase of housing balance, the balance according to the provisions of this section (six);
(eight) families who have been converted into urban residents due to land acquisition shall receive one-time resettlement compensation income, and the balance after paying social endowment insurance shall be implemented according to the provisions of Item (six) of this article. There are still contracted land, according to the average income of land in the previous year;
(nine) families receiving other one-time compensation fees may refer to item (six) of this article. If the one-time economic compensation is used up due to force majeure, it will no longer be regarded as family income;
(ten) if there are both urban residents and rural residents in the family members, the per capita income of the family shall be calculated together. The per capita income is lower than the guarantee standard, and only urban residents are guaranteed. The income of rural residents shall be implemented with reference to the corresponding regulations;
(eleven) * * * family members with foreign accounts, combined with the calculation of family per capita income. The per capita income is lower than the guarantee standard, and only residents with urban hukou in this city are guaranteed. Residents with foreign accounts shall be handled with reference to relevant regulations;
(12) Disabled people who can't take care of themselves, have no income, and their monthly per capita income exceeds the minimum living standard, but their family life is really difficult, can enjoy the security fund appropriately;
(13) The calculation method of maintenance (support, assistance) maintenance fee is: if the maintenance (support, assistance) obligor takes the family as the unit and the per capita income does not reach 1.5 times the minimum living standard, the maintenance (support, assistance) maintenance fee will not be paid. For families whose per capita income reaches 1.5 times the minimum living standard, the sum of the excess part is divided by the total number of dependents (support, assistance), and the number is the number of dependents (support, assistance).
The expenses for maintenance (assistance and maintenance) decided by the court shall be calculated according to the judgment standard of the court. If there is an agreement on the support fee, it shall be calculated according to the agreed standard.
If the actual payment of maintenance (assistance) is higher than the above standard, it shall be calculated according to the actual payment;
(fourteen) pensions and courageous rewards for entitled groups are not counted as family income.
Three. Acceptance and preliminary examination of community neighborhood committees
The community neighborhood committee shall set up a low-income appraisal group with the participation of community neighborhood committee cadres, residents' leaders and residents' representatives, and be responsible for accepting the applicant's application, household survey, appraisal, publicity and declaration; Entrusted by the county (city) and District Civil Affairs Bureau, Tangshan City Residents' Minimum Living Security Certificate (hereinafter referred to as "Minimum Living Security") and low-income passbook are delivered to those who are approved to enjoy the minimum living security. Please note that unauthorized services are not guaranteed. Details are as follows:
(a) the community neighborhood committee accepts the application for subsistence allowances, obtains relevant certification materials, and publicizes the subsistence allowance policy to the applicant.
(II) The minimum living security review group of community neighborhood committees (with more than 2 people) verifies the actual living conditions of family members such as employment, income, food, clothing, housing and transportation by means of household surveys and neighborhood visits, and forms household survey materials (styles such as attachments).
(three) the community residents' committee subsistence appraisal team to apply for subsistence allowances for families to conduct collective appraisal, to determine whether they meet the conditions of subsistence allowances. In line with the reporting conditions, after signing the "Application Approval Form", it shall be submitted to the sub-district office together with relevant materials. And publicize it on the community bulletin board. The review team believes that it does not meet the minimum requirements, and should fill in the reasons for not approving the minimum treatment in the notice, serve it on the applicant, and make a good policy explanation.
(four) the community neighborhood committee will complete the preliminary examination of the application materials within 7 days.
(five) to accept the application of poor households whose household registration and residence are not together, they should first entrust the community neighborhood Committee of their residence to investigate and verify their family life and employment, and issue proof materials. The neighborhood committee of the community in the place of residence shall cooperate with the investigation.
(six) low-income households in the administrative area of account migration, no longer go through the formalities of examination and approval, low-income files into the new civil affairs department.
(seven) the applicant is a collective account, and the unit where the account is located shall perform the functions of the community neighborhood Committee.
Four, the street office audit
Sub-district offices have set up a low-income audit team attended by office cadres and relevant social personnel. The subsistence audit team is responsible for reviewing the materials reported by the community neighborhood committees, conducting household verification, obtaining relevant certification materials, and reviewing and reporting. Details are as follows:
(a) the subsistence audit team first reviewed the investigation materials and evaluation results reported by the community neighborhood committees, and assigned two or more members of the subsistence audit team to conduct household verification to form verification materials.
(2) The review team will complete the review within 15 days. Fill in the information of family members who meet the minimum requirements in the application approval form, and report it to the county-level civil affairs department after signing the audit opinion in the relevant column. At the same time, the audit opinions will be fed back to the community neighborhood Committee, and the community neighborhood Committee will be entrusted to make a second publicity. After examination, do not meet the minimum living conditions, will not be approved to fill in the "notice", commissioned by the community neighborhood committee to serve the applicant.
(3) Sub-district offices can directly accept applications for residents who have not set up community neighborhood committees in newly-built communities to enjoy the minimum living allowance, and perform the minimum living guarantee functions undertaken by community neighborhood committees.
Five, the county civil affairs department for examination and approval
The civil affairs department at the county level shall set up a subsistence allowance examination and approval team composed of the competent director and relevant department personnel. The examination and approval team is responsible for the examination and approval of the subsistence allowances reported by the street offices, making a decision on approval or disapproval within 7 days, and entrusting the street offices and community neighborhood committees to publicize and serve notices. Details are as follows:
(a) the competent department of subsistence allowances shall, under the auspices of the competent director, review the relevant materials of subsistence allowances reported by the street offices one by one to assess whether they meet the requirements of subsistence allowances. If necessary, it can be verified by external transfer or on-site verification.
(two) to meet the minimum conditions, approved to enjoy the minimum amount. Sign the examination and approval opinions and seal them in the relevant columns of the application approval form. Input the relevant information of the low-income households into the computer, fill in the relevant contents of the low-income guarantee, and entrust the community neighborhood Committee to deliver the low-income guarantee and the low-income guarantee passbook.
(3) For families that do not meet the minimum living guarantee conditions, the county civil affairs department shall fill in the Notice of Reasons for Not Approving and entrust the community neighborhood committee to serve on the applicant.
The civil affairs department at the county level shall report the minimum amount and home address enjoyed by the minimum target to the Municipal Civil Affairs Bureau for the record every month.
Management of intransitive verbs
(a) the implementation of dynamic management system.
Community neighborhood committees should keep abreast of the changes in family income of low-income residents through visits and follow-up surveys; Street offices should review the families that have enjoyed the minimum living allowance every quarter; Civil affairs departments at the county level should organize forces to conduct a spot check on the minimum living standard every six months. Community neighborhood committees and neighborhood offices should promptly investigate and verify the problems reflected by the masses.
The minimum target family members and income changes, after the community neighborhood committees, neighborhood offices audit, audit, posting publicity, signed opinions, reported to the county civil affairs departments for change procedures. The civil affairs department at the county level shall, in accordance with the examination and approval procedures, go through the formalities of raising or lowering the security fund or terminating the subsistence allowance in a timely manner. Fill in the changes and adjustments in the change column of the application approval form, sign the audit opinion in the "minimum living allowance" audit column to stop issuing the minimum living allowance, and timely recover the "minimum living allowance" and load it into the family minimum living allowance file.
The minimum target should actively cooperate with the minimum staff review. After the family situation changes, it shall immediately report the changes of family income, residence and employment to the local community neighborhood Committee, and provide relevant certification materials.
(two) the system to ensure the participation of the object in public welfare activities.
Urban residents who have the ability to work within the age of employment but are not yet employed, while enjoying the minimum living guarantee for urban residents, should participate in public welfare activities or labor regularly organized by community neighborhood committees. Community neighborhood committees should register low-income residents who have the ability to work within the age of employment but have not yet been employed. The attendance system shall be implemented for public welfare activities, and registration shall be made on the attendance sheet and subsistence allowance after participating in the activities. Those who fail to participate in the activities on time should be registered and filed, and whether they are employed or self-employed should be investigated. Those who fail to pay without reason shall stop paying or reduce the security fund according to the provisions of the Measures for Minimum Living Security.
The labor that the security object participates in should be of a public welfare nature, such as cleaning up graffiti, maintaining the community environment, caring for flowers and plants, participating in public security joint defense and other public welfare labor, organizing vocational training, learning current affairs or carrying out cultural and sports activities beneficial to physical and mental health. Personnel participating in public welfare activities shall not be replaced by other personnel.
Community neighborhood committees organize public welfare activities at least once a week for no less than 4 hours.
(3) Standardize the fund management and distribution system.
Before the end of the year, the civil affairs department shall, according to the number of minimum living allowances and the implementation of funds this year, put forward the budget plan for minimum living allowances for the next year, and incorporate it into the fiscal year budget according to legal procedures. Need to be adjusted in the implementation, the civil affairs department shall, according to the actual situation, prepare a budget adjustment plan, report it to the financial department at the same level for review, and implement it after approval by the people's government at the same level.
At the beginning of each quarter, the Municipal Civil Affairs Bureau cooperates with the Finance Bureau to allocate the security fund to the special accounts of counties (cities), districts and finances according to the annual appropriation plan and the security fund expenditure in the last quarter; At the beginning of each month, the civil affairs departments at the county level shall, according to the actual needs, prepare the expenditure plan of guarantee funds and report it to the finance department at the same level for review. According to the expenditure plan, the financial department shall timely allocate the minimum living allowance funds to the civil affairs department, and the civil affairs department shall distribute them to households or dial in the passbook of low-income households on the 5th of each month to 10. The balance of the deposit is included in the account carry-over.
The civil affairs department shall, in accordance with the provisions, regularly submit the use of subsistence allowances to the financial department, and prepare the final accounts at the end of the year and send them to the financial department for review.
With the Low Guarantee and the Low Guarantee passbook, the security object will receive the low guarantee at the designated bank outlets or sub-district offices every month, and the security personnel will register the low guarantee according to the regulations after receiving it.
(four) the establishment of a standardized minimum living security management system.

For those who fail to report, approve or serve the notice of disapproval within the prescribed time limit, the identification object is inaccurate, the handling procedures are not standardized, the publicity is not in place, the number of subsistence allowances is falsely reported or concealed, the complaint reporting problem is not handled in time, and it is not resolved according to the policy, and criticism and education are given depending on the circumstances. Staff dereliction of duty, favoritism, in accordance with the provisions of the "minimum measures" shall be investigated for the responsibility of the relevant personnel.
