Article 2 The term "Muslim food" as mentioned in these Regulations refers to food produced and operated according to the muslim food customs of Hui, Uygur, Baoan, Dongxiang, Kazak, Salar, tatar, Uzbekistan, Tajik, Kirgiz and other ethnic minorities (hereinafter referred to as Hui and other ethnic minorities). Article 3 These Regulations shall apply to the production and operation of halal food and its supervision and management activities within the administrative area of this province.
Muslim canteens set up in organs, enterprises and institutions shall be implemented in accordance with the relevant provisions of these regulations. Article 4 All ethnic groups have the freedom to maintain and reform their own customs and habits. The whole society should respect the muslim food customs of Hui and other ethnic minorities.
any unit or individual has the right to report any violation of these regulations to the administrative department of ethnic affairs and other relevant administrative departments, and the department that accepts the report shall handle it promptly. Article 5 People's governments at or above the county level shall encourage the development of halal food industry, develop halal food with local characteristics, give priority to supporting famous brand and time-honored halal food production and operation enterprises and individual industrial and commercial households, and give preferential treatment in investment, taxation and credit in halal food industrialization according to state regulations.
the people's governments of cities and counties where Hui and other ethnic minorities live in concentrated communities should incorporate the construction of Muslim food production and marketing outlets into the overall urban and rural construction plan. Article 6 The provincial people's government shall incorporate the funds for the supervision and administration of halal food into the fiscal budget; The people's governments of cities and counties (cities, districts) with districts shall set up special funds for the supervision and management of halal food according to the needs of their work. Seventh people's governments at or above the county level shall be responsible for the implementation of these regulations.
the departments and institutions of industry and commerce, health, quality and technical supervision, commerce, food and drug supervision and quarantine of the people's governments at or above the county level shall, according to their respective functions and duties, do a good job in supervision and management related to the production and operation of halal food. Eighth ethnic affairs, culture, press and publication departments and mass media should strengthen the publicity of relevant laws, regulations and muslim food customs of Hui and other ethnic minorities, so as to enhance mutual understanding and respect among ethnic groups.
enterprises and individual industrial and commercial households that produce and operate halal food should train and educate their employees about the special requirements and taboos of production operation. Article 9 An enterprise engaged in the production and operation of halal food shall meet the following conditions:
(1) It has independently set up production workshops, warehouses, sales places and special processing and production instruments, measuring instruments, inspection equipment, storage containers and means of transportation;
(2) At least one person in charge of the enterprise is a citizen of Hui and other ethnic minorities, and the proportion of employees of Hui and other ethnic minorities shall not be less than 1.5%;
(3) The legal representatives of enterprises engaged in halal meat industry and catering industry shall be citizens of Hui ethnic minorities, and the proportion of employees of Hui ethnic minorities shall not be less than 31%;
(4) Employees in slaughtering, purchasing, batching, cooking, storage and transportation should be Hui and other ethnic minority citizens;
(5) The supervision and management system of halal food production and operation is sound;
(6) Other conditions stipulated by laws and regulations. Article 11 Individual industrial and commercial households engaged in the production and operation of halal food shall meet the following conditions:
(1) The owners shall be Hui and other minority citizens;
(2) Employees in slaughtering, purchasing, batching, cooking, storage and other jobs should be Hui and other ethnic minority citizens;
(3) having special tools and places for the processing, production, sale, storage and transportation of Muslim food;
(4) other conditions stipulated by laws and regulations. Eleventh halal food production and operation enterprises and individual industrial and commercial households shall clearly indicate the halal logo on their shop names, signboards and product packages.
after being certified by a legally established halal food certification body, halal food production and marketing enterprises can use halal certification marks in the packaging and advertisements of their products.
non-halal food production and operation enterprises and individual industrial and commercial households are not allowed to use halal signs, signs or publish halal food advertisements. Article 12 The production and marketing of halal food shall conform to the laws, regulations and standards of the state on food safety and hygiene management.
the finished products, raw materials and auxiliary materials purchased by enterprises and individual industrial and commercial households that produce and operate halal food shall meet the requirements of halal food. Finished products, raw materials and auxiliary materials purchased from other places shall be accompanied by valid proof of halal. Thirteenth enterprises and individual industrial and commercial households engaged in the production and operation of halal meat industry shall be subject to quarantine and inspection according to the customs of muslim food.
Muslim livestock and poultry shall be slaughtered at designated points. The provincial people's government shall, according to the actual situation of this province, formulate the planning for the establishment of Muslim livestock and poultry slaughtering plants (fields), which shall be organized and implemented by the municipal and county people's governments according to the planning. Article 14 Where bazaars, shopping malls, supermarkets, hotels, restaurants and other places engage in halal food, they shall set up special areas for halal food or special counters and stalls, and the personnel engaged in halal food shall not be mixed with those engaged in non-halal food.
