Measures of Hangzhou Municipality on Supervision and Administration of Pesticide Residues in Vegetables
Article 1 In order to ensure the safety of vegetable production, protect people's health and protect the ecological environment, these Measures are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the supervision and management of pesticide residues in vegetables within the urban area of Hangzhou. Third agricultural administrative departments at all levels are responsible for the management of pesticide use in the process of vegetable production and the monitoring of pesticide residues in vegetables in the field.

The municipal technical supervision department is responsible for the monitoring of pesticide residues in listed vegetables.

The municipal administrative department for industry and commerce is responsible for the supervision and management of the vegetable trading market.

Environmental protection, health, commerce and other relevant departments shall, according to their respective responsibilities, coordinate the implementation of these measures. Article 4 District and township (town) people's governments shall be responsible for the publicity and education of professional ethics of vegetable producers and the safe use of pesticides, organize technical guidance, guide vegetable producers to use pesticides safely and rationally, and ensure the safety of vegetable production.

The villagers' committee shall be equipped with corresponding pesticide management personnel to control the use of pesticides in vegetables. Fifth relevant departments should vigorously promote new measures and technologies to prevent and control pests and diseases, such as pesticides with high efficiency, low toxicity and low residue, biological pesticides, drip irrigation and insect nets. Actively develop, produce and sell pollution-free and pollution-free vegetables. Article 6 Any unit that engages in pesticide business within this Municipality must obtain a pesticide business license issued by the municipal administrative department of agriculture and a business license issued by the administrative department for industry and commerce before it can operate.

The sales staff of pesticide business units must have professional knowledge of pesticide management and use, and be trained and qualified by the municipal administrative department of agriculture. When selling pesticides, salespeople should attach instructions for use with the goods, and have the obligation and responsibility to introduce the scope of use, control targets, methods of use and safe intervals of pesticides to vegetable producers. Article 7 It is strictly prohibited to sell highly toxic and residual pesticides such as methamidophos, phorate, carbofuran, omethoate, methyl 1605 and their mixed preparations and other banned pesticides announced by the municipal administrative department of agriculture in vegetable areas. Eighth vegetable producers must buy pesticides from business units that hold pesticide business licenses and business licenses. Article 9 Vegetable producers must strictly abide by the relevant provisions on the safe and rational use of pesticides, correctly prepare and apply pesticides according to the contents of labels and instructions, do a good job in safety protection, and shall not expand the scope of use without authorization to prevent pesticide pollution and pesticide poisoning accidents. Article 10 It is strictly prohibited to use highly toxic and residual pesticides such as methamidophos, phorate, carbofuran, omethoate, methyl 1605 and their mixed preparations on vegetables and other prohibited pesticides as stipulated by the municipal administrative department of agriculture.

Land with high toxicity and pesticide residue shall not be used for growing vegetables during the pesticide residue period. Article 11 Vegetable producers shall properly keep pesticides and mark them, and shall not mix them with vegetables.

Boxes, bottles and bags for packaging pesticides should be recycled by sales units and disposed of according to relevant regulations. It is forbidden to hold vegetables. Twelfth vegetables that have used pesticides must be harvested and sold after the expiration of the safety interval. Thirteenth vegetables with excessive pesticide residues shall not be listed for sale.

Organizers of vegetable wholesale markets and farmers' markets shall establish corresponding management systems for listed vegetables, equip them with special detection equipment or tools, and determine special personnel to be responsible for pesticide residue detection of listed vegetables; Vegetables with excessive pesticide residues shall not be sold, and shall be treated uniformly according to regulations. Article 14 The municipal technical supervision department shall conduct unscheduled detection of pesticide residues in vegetables on the market, and publish the detection results. For vegetables with excessive pesticide residues, the administrative department for industry and commerce shall order the market organizers or operators to destroy them uniformly; For local vegetables, the administrative department of agriculture shall also order vegetable producers to suspend the listing of similar vegetables. Article 15 Organizers of vegetable wholesale markets and farmers' markets shall establish and improve internal management systems, strengthen publicity and education of vegetable operators and employees, urge them to abide by these management measures, and seriously accept the supervision and inspection of relevant departments. Sixteenth the following acts shall be punished in accordance with the following provisions:

(a) in violation of the provisions of article sixth and article seventh of these measures, the administrative department of agriculture or the administrative department for industry and commerce shall order it to stop selling, and may impose a fine of not more than 50 thousand yuan.

(two) in violation of the provisions of article ninth, tenth, eleventh and twelfth of these measures, the administrative department of agriculture shall order it to make corrections, and may impose a fine of more than 2000 yuan in 200 yuan.

(three) in violation of the provisions of these measures, the sales of vegetables with pesticide residues exceeding the standard shall be fined 100 yuan to 1000 yuan by the administrative department for industry and commerce according to the seriousness of the case; Impose a fine of not less than 5,000 yuan on the unit from 500 yuan; If the circumstances are serious, the administrative department for industry and commerce shall revoke the entry transaction certificate and business license according to law.

(four) the organizers of vegetable wholesale markets and farmers' markets failed to perform their corresponding management duties, which led to the listing and sale of vegetables with excessive pesticide residues. The administrative department for industry and commerce shall order them to make corrections and may impose a fine of more than 5,000 yuan in 500 yuan. Seventeenth in violation of these measures, the sale and use of highly toxic pesticides caused environmental pollution, the environmental protection department shall be punished in accordance with the provisions of relevant laws and regulations; Causing economic losses, it shall be liable for compensation according to law; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated by judicial organs according to law.
