Labor law do catering on May Day have holidays
May Day Labor Day is a legal holiday, regardless of what industry, the day of the legal holiday to work should be paid 300% of the wages of overtime pay. May Day Labor Day holiday 3 days, of which the day of May 1 is a legal holiday to pay 300% overtime, the remaining 2 days are double holiday, if the work is not arranged for the transfer of 200% overtime pay.

Calculation of overtime pay for legal holidays: monthly salary ÷ 21.75 ÷ 8 × overtime hours × 3 times.

Calculation of overtime pay for working days: monthly salary ÷ 21.75 ÷ 8 × number of hours of overtime work × 1.5 times;

Calculation of overtime pay for double holidays: monthly salary ÷ 21.75 ÷ 8 × number of hours of overtime work × 2 times;

Evidence proving overtime work includes: attendance sheet, attendance card, overtime work authorization sheet, overtime work notice, and surveillance video, Witness testimonies, written records of work done during overtime, e-mails, etc.

Article 44 of the Labor Law: Where any of the following circumstances exists, the employer shall pay a wage higher than the wage for the worker's normal working hours in accordance with the following standards:

(1) If the employer arranges for the worker to extend his/her working hours, he/she shall be paid not less than 150% of the wage;

(2) If the employer arranges for the worker to work on his/her day off, and he/she is unable to arrange for a compensatory day off, he/she shall be paid not less than 150% of the wage.

(2) If a worker is assigned to work on a rest day and no compensatory time off can be arranged, the worker shall be paid not less than 200 percent of his or her wages;

(3) If a worker is assigned to work on a statutory vacation day, the worker shall be paid not less than 300 percent of his or her wages.
