We began to analyze the five links that constitute murder. The so-called murder must meet the following requirements:
1, knowing that the target is a living body;
2. I have the idea of ending the other person's life; 3. Take and implement homicide measures;
4. The target is dead;
5. I have no regrets.
Case 1: Walking on ants.
Analysis: If at least condition 4 is met, condition 5 may be met, but condition 1, 2,3 is not met, so it does not constitute homicide. The result is relatively mild. So driving during the day or driving at night belongs to this situation.
Case 2: Mosquito control.
Analysis: the conditions of careless or conditioned reflex mosquito killing were not completely met, and the result was slightly heavier than that of case 1, but not serious; Killing mosquitoes is killing. The consequences are very serious. So if you see a mouse or rabbit in front of you while driving, you don't brake or dodge, but you take the initiative to crush it, which obviously constitutes a serious homicide.
