Regulations of Suihua Municipality on the Administration of Kitchen Waste
Article 1 In order to strengthen the management of kitchen waste, ensure food safety and promote the recycling of resources, these Regulations are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes, the Regulations on Food Safety in Heilongjiang Province and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the production, delivery, collection, transportation, disposal, supervision and management activities of kitchen waste within the urbanization management area of this Municipality. The determination and adjustment of specific areas shall be decided by the people's governments at or above the county level and announced to the public. Article 3 The term "kitchen waste" as mentioned in these Regulations refers to food residue, food processing waste, expired food, waste edible oil and other wastes generated by kitchen waste generating units outside the daily life of residents in catering services, collective feeding, food production and processing, etc. Units that produce kitchen waste include hotels, restaurants, hotels, restaurants, canteens, small-scale food business and food production enterprises, and small-scale food production and processing workshops. Waste edible oils and fats refer to inedible animal and vegetable oils and various oil-water mixtures. Article 4 The management of kitchen waste shall follow the principles of government leading, social participation and comprehensive utilization, and implement fixed-point delivery, unified collection, transportation and centralized disposal. Article 5 People's governments at all levels shall strengthen their leadership in the management of kitchen waste within their respective administrative areas, and establish a linkage mechanism for information sharing and law enforcement. Article 6 The competent department of city appearance and environmental sanitation of people's governments at all levels shall be responsible for the supervision and management of the transportation, collection, transportation and disposal of kitchen waste within their respective administrative areas. Development and reform, market supervision, ecological environment, agriculture and rural areas, business environment, finance, public security, commerce and other relevant departments are responsible for the supervision and management of kitchen waste within their respective responsibilities. Seventh people's governments at or above the county level shall incorporate the construction of kitchen waste disposal facilities into the city appearance and environmental sanitation planning. Article 8 The Municipal People's Government shall adhere to the principle of rational distribution and effective allocation of resources, and guide the planning of kitchen waste disposal projects across administrative regions in accordance with the model of regional overall planning and construction. Encourage cross-administrative cooperation in the treatment of kitchen waste. Without the construction of centralized kitchen waste disposal facilities, it can be included in the centralized kitchen waste disposal facilities in the nearby administrative areas. Article 9 Encourage and guide to reduce the amount of kitchen waste by saving meals, listing clean vegetables, cleaning agricultural and sideline products into the city, and improving food processing technology. Party and government organs, state-owned enterprises and institutions should take the lead in practicing economy, oppose food waste, implement standardized meals in official activities, and scientifically and rationally arrange the quantity and form of meals. Consumers' associations should guide consumers to establish a safe, healthy, reasonable and green food consumption concept, advocate diet saving, rational consumption and reasonable diet, and encourage consumers to supervise food waste. The catering industry association shall play the role of self-discipline, guidance and service, formulate the industry non-waste convention, and urge its member units to take necessary measures to prevent catering waste. Catering service units shall post or place food-saving labels in a conspicuous position in the business premises, and provide snacks and other meal services with different specifications and packages according to the needs of consumers; Appropriate rewards can be given to consumers who save meals; No minimum consumption shall be set, and consumers shall not be induced or misled to order too many dishes. The Food Safety Committee of the people's government at or above the county level shall coordinate and guide the work of saving and opposing food waste, and urge the relevant departments of the people's government at the corresponding level to perform relevant duties. The relevant departments shall, within the scope of their respective functions and duties, undertake the supervision and management of strict economy and opposition to food waste, supervise and inspect catering service units and canteens of party and government organs, enterprises and institutions to implement measures to avoid food waste, and criticize and educate the phenomenon that bad habits are not changed and serious food waste is caused. Article 10 The relevant departments of the people's governments at all levels shall strengthen the management of social credit, collect the information of units or individuals that violate the regulations on the management of kitchen waste into the public credit information platform, and take disciplinary measures against the untrustworthy subject according to the law and regulations. Public credit institutions should establish credit repair, objection appeal and other mechanisms to protect the legitimate rights and interests of the parties. Article 11 The competent department of city appearance and environmental sanitation of the people's governments at all levels shall, jointly with the relevant units, establish a joint disciplinary mechanism for dishonesty, and impose joint disciplinary action on serious untrustworthy units and their legal representatives, principal responsible persons and persons directly responsible who violate the provisions on the management of kitchen waste under any of the following circumstances within the validity period of information disclosure:

(a) in violation of the provisions on the management of kitchen waste, resulting in major food safety accidents, or adverse food safety incidents;

(2) Obtaining the franchise right for the management, collection, transportation and disposal of kitchen waste by illegal means such as collusive bidding or borrowing qualification bidding;

(3) The food waste franchisee violates laws, regulations and national mandatory standards, seriously damages the public interests, or causes major quality and safety accidents or sudden environmental incidents;

(four) other circumstances in which laws, regulations and state regulations should be included in the joint punishment.

When the administrative organ announces the list of subjects with serious dishonesty, it shall also announce the reasons for being included in the list, the conditions for delisting and the remedies. Twelfth city state organs and organizations authorized by laws and regulations with the function of managing public affairs, according to laws and regulations, take one or more of the following administrative disciplinary measures against the joint disciplinary object:

(a) as the key supervision object in daily supervision, strengthen supervision and increase the proportion and frequency of spot checks;

(two) in the administrative management to cancel the convenience measures that have been enjoyed;

(three) to restrict participation in the bidding activities of financial investment construction projects;

(four) restrict participation in infrastructure and public utilities franchise;

(five) to stop the implementation of financial support or related preferential policies;

(6) Restrict participation in commendation and reward activities organized by the government;

(seven) other disciplinary measures stipulated by laws and regulations.
