Chapter I General Provisions

Article 3 The transportation departments of provinces and cities divided into districts shall be in charge of the work of expressway within their respective administrative areas. Highway management organizations in provinces and cities divided into districts shall be specifically responsible for road management and maintenance management in expressway, and exercise other management responsibilities according to the decision of the transportation departments at the same level.
The traffic management department of the provincial public security organ is in charge of the traffic safety management in expressway, and may designate the traffic management department of the municipal public security organ with districts to undertake relevant management work.
Provincial development and reform, construction, land and resources, industry and commerce, environmental protection, price and other relevant departments, the people's governments at all levels along expressway and their relevant departments shall be responsible for the management of expressway in accordance with their respective responsibilities.
Article 4 The municipal people's governments of provinces and districts shall, in accordance with the responsibilities and requirements stipulated in the laws and regulations on road traffic safety, establish and improve the coordination mechanism for traffic safety in expressway, formulate the traffic safety management plan and implementation plan for expressway, and organize their implementation.
Article 5 The rights of enterprises or other organizations engaged in business management activities in expressway (hereinafter referred to as expressway business units) to collect fees, operate advertisements and operate service facilities according to law shall be protected by law.
Expressway business units shall actively cooperate with and assist the relevant people's governments and their administrative departments to do a good job in the management of expressway.
Article 6 All units and individuals must abide by highway laws, regulations and these Measures, and may not destroy, damage or illegally occupy land in expressway and expressway and ancillary facilities in expressway.
Article 7 All units and individuals must abide by the laws, regulations and these measures on road traffic safety, maintain traffic order in expressway and prevent traffic accidents.
Chapter II Maintenance and Management
Eighth expressway business units responsible for the maintenance of expressway and its ancillary facilities, to ensure that it is in good technical condition.
Expressway business unit does not have the qualification for conservation in expressway, it shall entrust expressway conservation unit with corresponding qualification for conservation through bidding according to law, and report it to the provincial expressway management institution for the record.
Ninth expressway business units shall, in accordance with the provisions of the national and provincial departments in charge of transportation, prepare the maintenance plan and annual plan of expressway, and organize their implementation. Expressway maintenance plan and annual plan shall be submitted to the provincial highway management agencies for the record.
Tenth expressway maintenance operations shall conform to the standards and norms prescribed by the state.
Expressway maintenance personnel should wear uniform safety identification uniforms when working. Construction signs, safety signs and guide signs shall be set in the construction site according to regulations, and protective measures shall be taken to ensure the safe and smooth flow of vehicles. Work vehicles and machines should turn on yellow warning lights.
Vehicles passing through the maintenance work site in expressway must follow the set guide signs to avoid working vehicles, machinery and personnel.
Eleventh expressway management agencies should strengthen the supervision and inspection of expressway maintenance work, found that expressway and its ancillary facilities can not meet the prescribed technical standards, it should be ordered to expressway business units to make corrections within a time limit; If it is found that the maintenance operation and on-site management in expressway are not standardized, it shall be ordered to make corrections by the business unit in expressway or the highway maintenance unit entrusted by it.
Chapter III Road Administration
Twelfth prohibit the following acts that damage and pollute expressway, endanger the security of expressway and affect the smooth flow of expressway:
(a) set up stalls, borrow soil, burn, pile up articles, dump garbage, set up obstacles, dig ditches to divert water, and use expressway ditches to discharge pollutants within the scope of land use in expressway and expressway;
(2) Digging sand, quarrying, taking soil, dumping wastes, blasting, drilling, etc. It will be carried out within 200 meters around large and medium-sized bridges and ferries in expressway, within 100 meters above the tunnel and within a certain distance outside the tunnel and on both sides of expressway;
(3) Building buildings and ground structures beyond the needs of expressway's construction, maintenance and protection in the building control area of expressway;
(four) damage or unauthorized removal, alteration of ancillary facilities in expressway;
(5) People in the car throw objects outside the car;
(6) Objects dropped by vehicles or their loads contact the ground and are dragged;
(seven) other acts stipulated by laws, regulations and rules.
Thirteenth to engage in the following activities, should be approved by the highway management agencies; If traffic safety is affected, the consent of the traffic administrative department of the public security organ shall also be obtained:
(a) due to the construction of railways, airports, communication facilities, water conservancy projects and other projects need to occupy, dig expressway or divert expressway;
(2) Crossing expressway to build bridges, aqueducts or erect and bury pipelines and other facilities, and erecting and burying pipelines, cables and other facilities within the scope of land use in expressway;
(3) Building buildings and ground structures needed for the construction, maintenance and protection of expressway in the building control area of expressway, or laying pipelines, cables and other facilities;
(four) iron wheeled vehicles, tracked vehicles and other equipment that may damage the road surface in expressway, and it is really necessary to drive on the expressway;
(five) the vehicle exceeds the load limit standard in expressway, and it is really necessary to drive on the expressway.
The licensing authority for the matters specified in the preceding paragraph shall be determined in accordance with the relevant provisions of the Regulations on Highway Management in Zhejiang Province.
Article 14 If the activities specified in Article 13 of these Measures cause damage to expressway and its land and ancillary facilities or cause other losses to business units in expressway, it shall be repaired, rebuilt or compensated in accordance with the relevant provisions of the state and this province. Fifteenth expressway management agencies to review the matters stipulated in Article thirteenth of these measures, it shall solicit the opinions of expressway business units; Expressway business units have objections, expressway management agencies shall organize relevant parties to negotiate, and organize relevant professionals to demonstrate when necessary. If a hearing should be held according to law, the highway management institution shall organize the hearing in accordance with the procedures prescribed by relevant laws.
Highway management agencies shall, according to the opinions, consultation, argumentation and transcripts of the hearing, make a decision of approval or disapproval in a timely manner.
Sixteenth expressway business units should be in a prominent position in expressway entrance and tunnels and other related facilities, set up expressway limit load, limit height, limit width, limit length standard signs. Expressway business units shall refuse illegal over-limit transportation of vehicles.
Highway management agencies can carry out over-limit transportation inspection on passing trucks in expressway entrances and exits, service areas, over-limit transportation checkpoints and other places approved by the provincial people's government. Vehicles carrying goods in the past should drive to the designated place according to the guiding signs and accept the inspection of highway management agencies.
Seventeenth buildings and ground structures built in the construction control area of expressway for the construction, maintenance and protection of expressway shall not be used for other purposes; If it is no longer used, it should be removed immediately.
Eighteenth expressway business units responsible for setting up and maintaining traffic signs and markings.
The setting of traffic signs and markings shall conform to the standards prescribed by the state, and shall be adjusted in time according to the changes in the road network structure of expressway.
Traffic signs and markings on traffic accident-prone sections shall be adjusted through consultation by the management organization of expressway in conjunction with the traffic management department of the provincial public security organ and the business unit of expressway, and the business unit of expressway shall be responsible for the implementation.
Nineteenth in expressway City, the setting of non-expressway signs within the scope of land use shall conform to the standards formulated by the provincial department in charge of transportation and approved by the expressway administration.
Twentieth in expressway along the planning and construction of new towns, development zones, etc. , should keep a specified distance from the expressway, and avoid corresponding on both sides of the expressway; Involving the construction control area of expressway, it shall solicit the opinions of the provincial highway management agencies and the municipal transportation departments with districts in advance.
Twenty-first caused damage to expressway and its affiliated facilities, the parties shall immediately report to the expressway administration, accept its on-site investigation, and bear the liability for compensation according to law.
In violation of highway management laws, regulations and the provisions of these measures, highway damage shall be dealt with by highway management agencies according to law.
Twenty-second expressway management agencies should strengthen the management of road administration in expressway, stop and investigate violations of laws, regulations and the provisions of these measures.
When performing official duties, road management personnel shall wear signs and hold relevant certificates; Expressway city road management special vehicles should be set up unified signs and warning lights.
Twenty-third expressway under construction shall be governed by the provisions of this chapter on the management of building control areas and advertising signs in expressway.
Chapter IV Traffic Safety
Twenty-fourth prohibit the following persons and vehicles from entering expressway:
(1) pedestrians;
(2) Non-motor vehicles;
(3) Motorcycles, tractors, agricultural transport vehicles, battery cars, wheeled special-purpose mechanical vehicles and full-trailer tractors;
(four) motor vehicles without damage to hazard warning flashlights, fog lights, seat belts, warning signs and taillights;
(5) overloaded vehicles;
(six) the design of motor vehicles with a top speed of less than 70 kilometers per hour.
The provisions of the preceding paragraph shall not apply to personnel, special vehicles and machinery engaged in maintenance, road administration, fault cleaning and accident rescue in expressway.
Twenty-fifth vehicle drivers and passengers wearing seat belts entering expressway must wear seat belts in accordance with the regulations.
Twenty-sixth vehicles from the ramp into expressway, should increase the speed in the acceleration lane, and turn on the left turn signal, and shall not interfere with the normal driving of vehicles in expressway.
When the vehicle leaves expressway, it shall drive into the lane connecting the exit according to the exit warning sign and slow down; When leaving expressway from the ramp, turn on the right turn signal, drive into the deceleration lane and leave.
Twenty-seventh vehicles need to overtake or change lanes, you must turn on the turn signal in advance, and you must change the distance light at night, and drive into the corresponding lane after confirming safety.
Article 28 When parking due to traffic jam ahead, you should keep a proper distance from the vehicle in front of the same lane, turn on the hazard warning flash, and do not occupy the emergency parking zone and shoulder. Drivers and other passengers are not allowed to get off at will.
Twenty-ninth vehicles driving on the expressway, shall not have the following acts:
(a) reversing, retrograde or crossing the central divider to turn around;
(two) riding, pressing the lane boundary or driving on the shoulder;
(three) overtaking on the ramp, acceleration lane or deceleration lane;
(4) Driving in the emergency lane under non-emergency circumstances;
(five) parking due to special circumstances such as failure and traffic jam;
(six) test drive or learn to drive a vehicle.
Article 30 When a vehicle has a traffic accident on the expressway, or the steering, lighting and signaling devices fail, or other faults make it unable to run normally, the driver should immediately turn on the hazard warning flash (the width indicator and the tail light must be turned on at the same time at night), move the vehicle to a place that does not hinder traffic, and set a warning sign for the faulty vehicle at the rear of the vehicle150m; If it is really impossible to move, the hazard warning flash should be turned on continuously. Personnel on board should be quickly transferred to the right shoulder or emergency lane, and call the police quickly.
It is forbidden to overhaul vehicles in expressway driveway.
Thirty-first expressway business units found that passing vehicles were overloaded or carrying dangerous chemicals in violation of relevant regulations, they should refuse to pass, and report to the traffic management department of the public security organ in time, and the traffic management department of the public security organ should investigate and deal with them according to law.
Article 32 If a business unit in expressway needs to close more than 1 lane due to maintenance and other construction operations, and the operation time lasts for more than 12 hours, or works at night, the business unit in expressway shall report to the traffic management department of the public security organ in advance and take corresponding measures such as protection, warning or announcement.
Where the construction operation requires semi-closed road sections or traffic interruption, the business unit in expressway shall obtain the consent of the traffic management department of the public security organ and the management organization in expressway in advance, and take corresponding protection, warning and guidance measures. Except in case of emergency, expressway business units shall announce to the public 5 days in advance through major mass media, and prompt passing vehicles through electronic display screens.
Thirty-third expressway wrecker, rescue work, by the expressway business unit is responsible for the implementation, and accept the traffic management department of the public security organ and the expressway management organization on-site organization and scheduling.
The traffic administrative department of the public security organ, the administrative department of expressway and the business unit of expressway shall not restrict the parties involved in a faulty vehicle or an accident vehicle from going to their designated units to repair the vehicle.
Thirty-fourth expressway business units towing, towing faulty vehicles, accident vehicles, in accordance with the standards approved by the provincial price department to collect fees from the vehicle parties, and shall not raise the fees without authorization.
When towing a faulty vehicle or an accident vehicle, the vehicle shall be towed to the nearest exit from the initial towing place or the place agreed with the vehicle parties or the accident vehicle handling place designated by the traffic management department of the public security organ in accordance with the requirements of proximity, safety and convenience.
Article 35 The traffic administrative department of the public security organ shall be responsible for organizing the expressway administrative agency and the expressway business unit to formulate the emergency plan for traffic management of emergencies in expressway, establish the emergency coordination mechanism, and organize drills when necessary. Expressway emergency traffic management plan should be linked with the local emergency plan.
The emergencies mentioned in the preceding paragraph refer to natural disasters, bad weather, major traffic accidents and other emergencies that seriously affect or may seriously affect traffic safety.
Thirty-sixth in case of emergency, the traffic management department of the public security organ may take traffic control measures such as speed limit, lane change, traffic restriction and temporary suspension of traffic. , expressway business units shall promptly remind the passing vehicles of relevant traffic control information; If it is really necessary to close expressway, the traffic administrative department of the public security organ shall decide to implement it after soliciting the opinions of the business units in expressway, and make an announcement to the public in advance; In case of traffic jam, the management organization of expressway and the business unit of expressway shall actively assist the traffic management department of the public security organ to divert traffic.
After the emergency is eliminated, the traffic administrative department of the public security organ shall stop the implementation of traffic control, immediately open the closed expressway, and make an announcement to the public in time.
Article 37 The provincial department in charge of transportation is responsible for organizing the traffic management and meteorological departments of public security organs and the business units in expressway to establish and improve the information monitoring service network in expressway, so as to realize the enjoyment of the network and provide the society with information services such as traffic and meteorology in expressway.
Chapter V Fees and Services
Thirty-eighth expressway toll period, the determination and adjustment of toll standards, in accordance with the provisions of the "Regulations" management of toll roads.
Thirty-ninth expressway charges to implement the province's networking, unified settlement and management. Provincial transportation authorities are responsible for organizing expressway business units to formulate networking schemes, charging procedures and settlement norms in accordance with relevant state regulations, and organize their implementation and supervision.
Fortieth new expressway projects should be based on the needs of network operation and management in expressway, expressway, in accordance with the provisions of the standard construction of communication, monitoring, charging and other management systems and facilities.
Expressway, which has been completed and opened to traffic, does not have the facilities specified in the preceding paragraph, and the expressway business unit shall be responsible for the construction.
Forty-first units responsible for the unified fee settlement in expressway shall regularly publish the fee settlement information to the business units in expressway. Expressway business units have the right to inquire about their own fee settlement information.
Forty-second in addition to the provisions of laws and regulations are exempt from vehicle tolls, vehicles must pay tolls in expressway. For vehicles that refuse to pay, evade paying or underpay vehicle tolls, expressway business units have the right to require them to pay back; Those who refuse to pay fees have the right to refuse their passage.
The parties to the vehicle shall pay the vehicle toll with the pass card or other pass certificate issued by the expressway business unit. It is forbidden to forge, exchange or use forged passes. Damaged or lost access cards should be compensated.
Forty-third expressway business units must open a sufficient number of toll crossings, equipped with corresponding toll collectors, to ensure the rapid and safe passage of vehicles, and shall not cause traffic jams.
Expressway business units must ensure the normal use of lighting, ventilation and other facilities in expressway, and shall not stop using them at will, and shall not affect the safe passage of vehicles.
Forty-fourth expressway business units should establish and improve various rules and regulations, operate according to law, standardize fees and provide quality services.
Expressway business units shall strengthen the business training and professional ethics education for toll station staff, and the toll collectors shall hold relevant certificates, be courteous to customers and standardize their services.
Forty-fifth expressway service area business units shall provide refueling, maintenance, rest, catering and other services for vehicles and personnel entering the service area. Engaged in various service activities, shall abide by the provisions of relevant laws, regulations and rules, and accept the supervision and inspection of the relevant competent departments.
Vehicles and personnel entering the service area shall abide by the management systems of the service area and maintain the good order of the service area.
The provincial department in charge of transportation shall formulate the management and service standards of expressway service area and announce them to the public.
Chapter VI Legal Liability
Forty-sixth acts in violation of the provisions of these measures, the highway law, road traffic safety law and its implementation regulations, toll road management regulations and other laws and regulations have been punished, from its provisions.
Forty-seventh in violation of the provisions of Item (1), Item (5) and Item (6) of Article 12 of these Measures, which causes road surface damage, pollution or affects the smooth flow of roads in expressway, the highway management organization shall order it to stop the illegal act and may impose a fine of more than 2,000 yuan in 500 yuan; If the circumstances are serious, a fine of 2000 yuan to 5000 yuan may be imposed.
Article 48 Whoever, in violation of the provisions of Item (3) of Article 12 and Item (3) of Paragraph 1 of Article 13 of these Measures, builds or disposes of buildings, ground structures or lays pipelines, cables and other facilities without authorization, shall be ordered by the highway management agencies to dismantle them within a time limit, and may be fined between 5,000 yuan and 20,000 yuan; Those who refuse to be demolished may be fined between 20,000 yuan and 50,000 yuan, and may be forcibly demolished by highway management agencies, and the required demolition expenses shall be borne by the builder.
Article 49 Anyone who commits one of the following illegal acts shall be ordered by the highway management organization to stop the illegal act and may be fined between 65,438 and 65,438+10,000 yuan; If the circumstances are serious, a fine of 10000 yuan to 30000 yuan may be imposed:
(a) in violation of the provisions of Item (2) and Item (4) of Article 12 of these Measures, carrying out operations that endanger the safety of expressway or damaging, moving or altering the affiliated facilities of expressway without authorization;
(two) in violation of the provisions of the thirteenth paragraph (a), (two), (four) and (five) of these measures, engaging in related acts without authorization.
Article 50 Whoever, in violation of the provisions of Article 19 of these Measures, sets up off-highway signs without authorization or sets up off-highway signs that do not meet the standards shall be ordered by the highway management agencies to dismantle or correct within a time limit, and may be fined more than 5,000 yuan/kloc-0,000 yuan; Those who refuse to remove or make corrections may be fined between 654.38 million yuan and 20,000 yuan, and may be forcibly removed by highway management agencies, and the required removal expenses shall be borne by the setters.
Fifty-first expressway business units in violation of the provisions of the second paragraph of article thirty-fourth, the traffic administrative department of the public security organ or the expressway administrative agency shall order it to make corrections and refund the towing fee.
Fifty-second whoever, in violation of the provisions of the second paragraph of Article 42 of these measures, forges, replaces or uses forged pass documents shall be ordered by the highway management organization to make corrections and may be fined up to 2,000 yuan; If it constitutes a violation of public security administration, it shall be punished by the public security organ according to law.
Fifty-third expressway business units in violation of the provisions of the provisions of article forty-third, one of the following circumstances, the expressway management agency shall order it to make corrections; Those who refuse to correct or have other serious circumstances may be fined more than 2000 yuan 1000 yuan:
(a) did not open a sufficient number of toll crossings, causing traffic jams;
(two) unauthorized stop lighting, ventilation and other facilities, affecting the safe passage of vehicles.
Fifty-fourth expressway business units in violation of the provisions of these measures, not in accordance with national standards and norms for expressway maintenance, the provincial expressway management agencies shall be ordered to make corrections within a time limit; Refuses to correct, the provincial expressway management agencies can designate units for maintenance, maintenance costs borne by the business units in expressway, and can be directly deducted from the vehicle tolls.
Article 55. Staff members of traffic administrative departments, highway management organizations and traffic management departments of public security organs who neglect their duties, engage in malpractices for selfish ends or abuse their powers, which do not constitute a crime, shall be given administrative sanctions according to law.
Fifty-sixth acts in violation of the provisions of these measures, which constitute a crime, shall be investigated for criminal responsibility by judicial organs according to law.
Chapter VII Supplementary Provisions
Article 57 The meanings of related terms in these Measures are as follows:
(1) expressway: A trunk highway that conforms to the national highway engineering technical standards and is specially designed for motor vehicles to travel at high speed in different directions and lanes, and all entrances and exits are controlled.
(2) Ancillary facilities in expressway: protection, drainage, maintenance, greening, service, monitoring, communication, toll collection, power supply, water supply, lighting and traffic signs, markings and management facilities, equipment and special buildings and structures in expressway.
(3) The same amendment
The construction control area of expressway under construction shall be determined according to the standards specified in Item (3) of the preceding paragraph.
Article 58 These Measures shall come into force as of September 2005.
